RESOLUTION NO. 85-96
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA DENYING CONDITIONAL
USE PERMIT APPLICATION NO. 85-11 TO
IALLOW RETAIL SALES IN THE M1 DISTRICT
AT 3400-3402 WEST MCARTHUR BOULEVARD
WHEREAS, the ~ity Council held a public hearing on
August 5, 1985 on Conditional Use Permit No. 85-11 to allow
retail sales in the M1 District on property located at 3400-
3402 West McArthur Boulevard, which application was brought
before this Council by Appeal No. 520 following its denial by
the Planning Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE
OF THE CITY OF SANTA ANA AS FOLLOWS:
CITY COUNCIL
1. Based on the evidence submitted at the abovesaid hear-
ing, this Council finds and determines as follows:
(a) The proposed use would be injurious to surround-
ing land uses from an aesthetic, parking and land use perspective.
Overcrowded parking and the intensification of operations at the
industrial complex would have a negative imuact on the general
appearance and perception of the area.
(b) The proposed use would inject an incompatible
low-end retail use into an established light industrial park,
inconsistent with economic development objectives for the area.
(c) The proposed use is inconsistent with the purpose
and intent of the General Plan, which is to promote quality
economic development and uphold development standards.
2. Conditional Use Permit Application No. 85-11 is hereby
denied.

3. The applicant shall have six (6) months to discontinue
the retail use on the subject property.
