HomeMy WebLinkAbout85-133RESOLUTION 85-133 RESOLUTION OF THE CITY COUNCIL FINDING THE PREMISES LOCATED AT 409 E. FIFTH STREET, SANTA ANA, CALIFORNIA TO CONSTITUTE A PUBLIC NUISANCE AS DEFINED IN SANTA ANA MUNICIPAL CODE AND AUTHORIZING ABATEMENT OF SAME. WHEREAS, the City Council of the City of Santa Ana has provided, in Chapter 17 of the Santa Ana Municipal Code, for the abatement of a premise as a public nuisance; WHEREAS, as set forth in Section 17-23 of the Santa Ana Municipal Code, a hearing for the existence of a public nuisance at the premises located at 409 East Fifth Street, Santa Ana, California, was held on October 10, 1985; WHEREAS, at the conclusion of the October 30, 1985, the hearing officer found the following: 1. The conditions of the premises located at 409 East Fifth Street, Santa Ana, constitute a public nuisance within the meaning of Section 3479 of California Civil Code and as defined in Section 17-1 of the Santa Ana Municipal Code; 2. The premises located at 409 East Fifth Street, Santa Ana, have been damaged by fire and has become so dilapidated as to become a harbor for vagrants, criminal or immoral persons; 3. The building shall be abated by demolition. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: 1. The premises located at 409 East Fifth Street, Santa Ana, and the conditions therein constitute a public nuisance as defined in Section 3479 of the California Civil Code; 2. The premises has been damaged by fire and has become so dilapidated as to become a harbor for vagrants, criminal or immoral persons; 3. That the Community Preservation Officer of the City of Santa Ana is hereby authorized and directed to abate the conditions on the premises located at 409 East Fifth Street, Santa Ana, by demolition not earlier than 60 days from the adoption of this resolution; 4. The owner Ms. Sally Perrie shall have 30 days from receipt of service of this resolution or 60 days from the date of adoption of same, whichever is earlier, to abate the premises located at 409 East Fifth Street, Santa Ana, by demolition; 1 5. In the event Ms. Sally Perrie fails to abate by demolition the premises located at 409 East Fifth Street, Santa Ana, within the time period prescribed by this resolution, the cost to the City of Santa Ana for said abatement shall be assessed against said premises and collected through assessment proceedings in the manner provided in Chapter 17 of the Santa Ana Municipal Code. 6. The Clerk of the Council is directed to serve a copy of this resolution to the owner of record, Ms. Sally Perrie, P. O. Box 11367 Zephyr Cove, Nevada 89448, by certified mail, return receipt requested. ADOPTED this 18th day of November , 1985. DANIEL E. GRISET Mayor ATTEST: JANICE C.
