HomeMy WebLinkAbout87-044REL:jd(~8) 2!7 4/13/87 Rev. 5/21/87(mb) RESOLUTION NO. 87-~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN OF THE CITY OF SANTA ANA (GPA 87-1) WHEREAS, the Planning Commission of the City of Santa Ana, after duly noticed public hearing, approved an amendment to the General Plan of the City of Santa Ana as hereinafter set forth; and WHEREAS, this Council has reviewed and considered the initial environmental study and negative declaration prepared for such proposed General Plan amendment; and WHEREAS, this Council, after duly noticed public hear- ing, concurs in the Planning Commission's approval of said Gen- eral Plan amendment; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA as follows: 1. Resolution No. 87-31 of this Council, adopted on April 20, 1987, is hereby rescinded. 2. The adoption of the abovesaid General Plan amend- ment will not have a significant effect on the environment, and the negative declaration prepared for said amendment is hereby ap- proved. 3. That certain map entitled "General Plan Amendment 87-1," on exhibit to this Council at the time of this Council's consideration of this Resolution, is incorporated herein by reference. The "Land Use Plan"'of the Land Use Element of the General Plan of the City of Santa Ana is hereby amended to desig- nate or redesignate those areas of the City of Santa Ana corre- sponding to the colored portions of said map to the land use designations set forth on said map. Those areas of the City of RESOLUTION NO. 87- &4 Page two Santa Ana corresponding to the uncolored portions of said map retain their current land use designations under the General Plan as previously amended. 4. The Land Use Element of the General Plan is amended by adding the following provisions thereto: "Residential developments in areas of the City of Santa Ana designated as "Multi-Use" shall be subject to the fol- lowing maximum densities: (a) Seventeenth Street west of the Santa Ana River 22 dwelling units per acre (b) Seventeenth Street east of the Santa Ana River 35 dwelling units per acre (c) Fourth Street 22 dwelling units per acre 5. The Clerk of the Council is directed to attest to the approval of the abovesaid map by this Council by appropriate notation on the face thereof and to retain the same as an official record of the City of Santa Ana. 6. Real Property which is the subject of a "Disposition and Development Agreement" or an "Owner Participation Agreement" which, prior to the date of this Resolution, has been approved by the Community Redevelopment Agency of the City of Santa Ana shall be subject to the density limitations of the General Plan as it existed prior to its amendment by this Resolution, provided it is developed in accordance with such agreement. 7. Any real property which on or before the date of this Resolution meets both of the following conditions shall be subject to the land use and density limitations of the General Plan as it existed prior to its amendment by this Resolution: (a Multiple-family residential development was approved for the property through any one of the following discretionary actions: (1) Adoption of a specific development plan. (2) Approval of a rezoning to the R3 (Multiple- family residential) use district. (3) Approval of a conditional use permit. (4) Approval of a tentative subdivision map. --2!9 RESOLUTION NO. 87-~4 Page Three (b) Application for a permit for such development has been filed pursuant to Chapter 3 of the Building Code; provided, however, this paragraph shall cease to apply to any de- velopment for which a conditional use permit has been approved if such conditional use permit is revoked for good cause or expires due to non-use, or to any development for which a tentative sub- division map has been approved if such tentative map expires without the approval of a final map or parcel map, or to any de- velopment for which the building permit application expires with- hout the issuance of the building permit, or to any development for which a building permit is issued if such building permit expires without the commencement of construction pursuant thereto.
