A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA ADDING THE AIRPORT ENVIRONS ELEMENT TO
THE GENERAL PLAN
WHEREAS, the Orange County Airport Land Use Commis-
sion has adopted an "Airport Environs Land Use Plan" pursuant
to Section 21675 of the Public Utilities code of the State of
California; and
WHEREAS, the City Council of the City of Santa Ana
desires to amend the General Plan of the City of Santa Ana to
promote consistency of the said General Plan with the Airport
Environs Land Use Plan of the Orange County Airport Land Use
Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA that the General Plan of the City of Santa
Ana is hereby amended by adding an element, to be entitled the
"Airport Environs Element," which reads as follows:
AIRPORt ENVIRONS ELEMENT
A. Definitions
As used herein the following terms shall have the following
meanings:
(1) "OCALUC" means the Orange County Airport
Land Use Commission.
(2) "AELUP" Means the Airport Environs Land Use
Plan of the OCALUC.
(3) "CNEL" means the Community Noise Equivalent
Level, a noise measurement system commonly used for
planning and regulatory purposes.
(4) "Director" shall mean the Executive Director
of the Planning and Building Safety Agency of the City
of Santa Aha and his or her designated representatives.
(5) "Department" means the Planning Department of
the City of Santa Ana.
(6) "FAA" Means the Federal Aviation Administration.
(7) "FAR Part 77" means Part 77 (entitled "Objects
Affecting Navigable Airspace") of the Federal Aviation
Regulations as the same now exists or as hereafter amended.

B. Building Height
1. The Department shall maintain maps by which it
may be determined whether a proposed building or structure
requires notification of the FAA pursuant to § 77.13 of FAR
Part 77.
2. The proponent of any building or structure which
may require FAA notification shall be provided by the Depart-
ment with an information packet including FAR Part 77, FAA
Form 7460-1, and such other information as the Director deter-
mines to be appropriate to assist the proponent in complying
with FAA requirements.
3. NO building permits shall be issued for any pro-
posed building or structure unless the applicant demonstrates
to the reasonable satisfaction of the Director that one of
the following conditions applies:
(a) FAA notification is not required.
(b) The FAA has determined that the proposed
building or structure would not exceed any standard
of Subpart C of FAR Part 77 and would not be a hazard
to air navigation.
(c) The FAA has determined that the proposed
building or structure would exceed a standard of
Subpart C of FAR Part 77 but would not be a hazard
to air navigation; provided, however, that in such
event final approval of the building or structure
for occupancy or use shall be conditioned on com-
pliance with any lighting or marking requirements
of the FAA.
(d) The FAA has determined that further aero-
nautical study is necessary to determine whether the
proposed building or structure would be a hazard to
air navigation, and that the applicant has, within
30 days of receipt of notice of such determination,
requested such further study, and that at least 180
days have elapsed since such request without a final
determination by the FAA as to whether the proposed
building would be a hazard to air navigation.
(e) The applicant has modified the proposed
building or structure in such a way as to avoid
being a hazard to air navigation in accordance with
FAA advice, subject to any marking or lighting re-
quirements as specified in paragraph (c) hereinabove.
(f) The FAA has finally determined that the
proposed building or structure would be a hazard
to air navigation as proposed but the City Council,

4. Except as provided in paragraph 3(f) hereinabove,
no building permits shall be issued for any proposed build-
ing or structure which the FAA has finally determined
would be a hazard to air navigation as proposed.
5. The Director shall notify the OCALUC of any pro-
posed building or structure whenever the Department has been
informed that the FAA has determined that the building or
structure would exceed a standard of Subpart C of FAR Part 77.
Any comments received by the City from the OCALUC shall be con-
sidered by the City in its approval, disapproval or condition-
ing of the proposed project in any discretionary action applic-
able thereto.
C. Noise
1. The CNEL Contour Map, showing zones where aircraft
noise impact from John Wayne Airport are 60 CNEL or greater
and where it is 65 CNEL or greater, adopted by the OCALUC in
connection with its AELUP, is hereby incorporated by reference.
Any revised map showing such zones adopted in the future by
the OCALUC is likewise incorporated herein.
2. Residential units in any area of the City shown on
the CNEL Contour Map as 60 CNEL or greater shall be sufficiently
sound attenuated for present and projected noise exposures,
which shall be the energy sum of all noise impacting the
project, so as not to exceed an interior standard of 45 CNEL.
Residential units shall be indoor oriented so as to preclude
noise impingement on outdoor living activities.
3. Commercial and industrial buildings in any area of
the City shown on the CNEL contour map as 65 CNEL or greater
shall be sound attenuated against the combined input of all
present and projected exterior noise to meet the following cri-
teria:

time period.
4. Noise-sensitive uses, such as schools, hospitals and
libraries, are not permitted in any area of the City shown on
the CNEL Contour Map as 65 CNEL or greater.
D. Heliports and Helistops
1. Any application for development of a heliport or hell-
stop shall be forwarded to by the Department to the OCALUC for
review and comment.
2. In connection with any such application, the Depart-
ment shall provide, or require the applicant to provide, the
OCALUC with the following information:
(a) Location of the proposed heliport/helistop
(street address).
(b) Purpose of request: Personal, private, or
commercial use of heliport/helistop.
(c) Zoning of site.
(d) Description of area and adjoining properties.
(e) Approach/departure paths.
(f)
Anticipated number of approaches and departures
(counted separately),during a specified time in-
terval (day, week, month).
(g)
Potential for creating a nuisance due to noise
generated by the operation of helicopters.
(Noise study may be required).
(h) Potential for creating an accident hazard.
(i) Federal Aviation Administration Aeronautical
