HomeMy WebLinkAbout87-071RESOLUTION NO. 87-71 7/14/87 RECORDED: I:O0~PAGE NO: F'"7- DEED J'JO. 7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA SUMMARILY VACATING A PORTION OF AN ALLEY EXTENDING NORTH FROM SECOND STREET BETWEEN BROADWAY AND SYCAMORE STREETS WHEREAS, this Council finds and determines as follows: (a) An easement for alley purposes, located north of Second Street between Broadway and Sycamore Street, was dedicated to the City of Santa Ana in 1979; (b) Due to a mistake in the description of said easement, the area of said easement includes a portion of the building located to the east of the intended alley; (c) The portion of said alley easement occupied by said building has been impassable for vehicular travel for a period of more than five (5) consecutive years, and no public money was ex- pended for maintenance on said alley portion during such period; (d) The portion of said alley easement occupied by said building constitutes excess right-of-way not required for street or highway purposes; (e) There are no in-place public utility facilities in the said alley portion; (f) The said alley portion is not useful as a nonmotor- ized transportation facility; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Pursuant to the provisions of Chapter 4 of Part 33 of Division 9 of the Streets and Highways Code of the State of California, and, in particular, Sections 8331 and 8334 thereof, that portion of an alley extending north from Second Street be- tween Broadway and Sycamore Street specifically described in Ex- hibit A, attached hereto and incorporated herein, is, under the facts, hereinabove recited, hereby vacated and, from the date this resolution is recorded in the office of the Recorder of Orange County, shall no longer constitute a street or alley or any portion thereof. The Clerk of the Council is hereby directed to cause a certified copy hereof, attested by her under seal, to be recorded forthwith in the office of the Recorder of Orange County.
