Home My WebLink About88-001001 RESOLUTION NO. 8 8- 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING UNDERGRO3ND UTILITY DISTRICT NO. 25 WHEREAS, by Minute Order dated October 19, 1987, a public hearing was called for January 4, 1988, at the hour of 7:30 p.m., at the Council Cham- bers of the City Hall, 22 Civic Center Plaza, Santa Aha, California, to ascer- tain whether the public necessity, health, safety, or welfare required the removal of poles, overhead wires and associated overhead structures, amd the underground installation of wires and facilities for supplying electrical com- munication or similar or associated service, for the formation of the Under- ground Utility District No. 25 within that certain area of the City described as follows: Said certain area beir~3 bounded northerly by the center- line of Westminster Avenue, bounded southerly by a line 100 feet south of centerline of Hazard Avenue, bounded westerly amd easterly by lines 80 feet from the center- line of Harbor Boulevard, as shown on the attached Exhi- bit "A"; WHEREAS, notice of such hearin~ has been 0iven to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearin~ has been duly amd regularly held, and all persons interested have been 0iven an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Aha: 1. That pursuant to Santa Aha Municipal Code Sections 37-1 to 37-13, the above-described area is hereby declared an Underground Utility Dis- trict and is designated as Underground Utility District No. 25 of the City of Santa Aha. Attached hereto, marked Exhibit "A," and hereby incorporated as a part of this Resolution, is a map delineating the boundaries of said District. 2. That the City Council does hereby fix April 1, 1989 as the date on which affected property owners must be ready to receive underground ser- vice, and does hereby order the removal of all poles, overhead wires and asso- ciated overhead structures amd the underground installation of wires and facilities for supplyir~ electric, cut~,Lenication, or similar or associated service within Underground Utility District No. 25 on or before December 31, 1989. 3. That the Clerk of the Council is hereby instructed to notify all affected utilities and all affected property owners within Underground Utility District 25 of the adoption of this Resolution within ten (10) days after the date of such adoption. Such notification shall be made by mailing a copy of this Resolution, together with a copy of said Santa Aha Municipal Code Sections 37-1 to 37-13 to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. That the City Council of the City of Santa Aha hereby finds and determines as follows, upon the basis of the evidence presented at said hear- lng; that the public necessity, health, safety, and welfare require the removal of poles, overhead wires and associated overhead structures within said area of the City, and the underground installation of wires and facili- ties for supplying electric, cc~t~nication, and similar or associated ser- vices, so as to eliminate hazards caused by fallen lines and poles and to improve visibility of pedestrian traffic to vehicle drivers.
