HomeMy WebLinkAbout88-009 129 1/22/88 RESOLUTION NO. 88- 9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING A CONFLICT OF INTEREST CODE FOR THE PROJECT AREA COMMITTEE OF THE PROPOSED BRISTOL CORRIDOR REDEVELOPMENT PROJECT WHEREAS, the Project Area Committee of the proposed Bristol Corridor Redevelopment Project, by its Resolution No. PAC-2, adopted November 24, 1987, adopted a Conflict of Interest Code in accordance with the Political Reform Act of 1974, a copy of which Code is attached hereto as Exhibit A and incorpo- rated herein by reference; and submitted Ana; WHEREAS, said Conflict of Interest Code has been for approval to the City Council of the City of Santa NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA that the Conflict of Interest Code for the Project Area Committee of the proposed Bristol Corridor Redevelopment Project, as set forth in Exhibit A, is hereby approved. PAC- ~ A RESOLUTION OF THE PROJECT AREA COMMITTEE FOR PROPOSED BRISTOL CORRIDOR REDEVELOP- MENT PROJECT OF THE CITY OF SANTA ANA ADOPTING A CONFLICT OF INTEREST CODE WHEREAS, the Project Area Committee for the proposed Bristol Corridor Redevelopment Project has been established by Resolution 87-78 of the City Council of the City of Santa Aha, adopted October 19, 1987; and WHEREAS, the Fair Political Practices Commission of the State of California, by its opinion number 86-001, dated May 12, 1987, has determined that members of a Redevelopment Project Area Committee are "public ~ficials" subject to the conflict of interest provisions of the Political Reform Act;. and WHEREAS, it Ks therefore necessary for the Project Area Committee for the proposed Bristol Corridor Redevelopment Project to adopt a Conflict of Interest Code in accordance with the Political Reform Act~ NOW, THEREFORE, BE IT RESOLVED by the Project Area Com- mittee of the proposed Bristol Corridor Redevelopment Project that the Conflict of Interest Code for said Project Area Committee shall consist of the model code set forth in Regu- lation 18730 of the Fair Political Practices Commission of the State of California, incorporated herein by reference, together with the following Appendix: 1. For purposes of the abovesaid model code and the Statement of Economic Interest forms (FPPC Form 730), all members of the Project Area Committee shall be considered "designated employees" who are required to file such State- ments of Economic Interest forms. Ail such members shall be considered to be in the same 'disclosure category,' which requires reporting of the types of interests hereinbelow described. 2. Each member of the Project Area Committee shall report any and all of the following types of economic interests held or received by such member during the period covered by such member's Statement of Economic Interests: (a) Any interest in real property which is located in or adjacent to the Project Area. (b) Any investment in a business entity which owns or leases real property or building space which is located in or adjacent to the Project Area. EXH 81T A ?.1 132 RESOLUTION NO. PAC- 2 PAGE TWO (c) Income received from any business entity which owns or leases real property or building space which is located in or adjacent to the Project Area. (d) Incon~ received from the rental of real property or building space which is located in'or adjacent to the Project Area. (e) Business positions in a business entity which owns or leases real property which is located or adjacent to the Project Area. in 3. For purposes of this Code, real property shall be deemed "adjacent' to the Project Area if it is contiguous to any parcel or parcels which are located in the Project Area or if it is separated from such parcel or parcels only by a street or-alley. 4. For purposes of this Code, the "Project Area' shall be that part of the City of Santa Ana which is designated as the Project Area in the proposed Redevelopment Plan for the Bristol Corridor Redevelopment Project as approved by the Planning Commission of the City of Santa Aha, as the same may be from time to time revised, until such time as a Redevelop- ment Plan for Such Project may be adopted by the City Council of the City of Santa Aha. If and when such a Redevelopment Plan is adopted by the City Council, the "Project Area" shall be that part of the City of Santa Ana designated as the Project Area in said adopted Redevelopment Plan.
