RESOLUTION NO. 88- 49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA SETTING DRAINAGE AREA FEES WHEREAS, sections 34-91 through 34-195 of the Santa Ana Municipal Code ("SAMC") establishes the authority for the City to establish fees to pay for drainage facilities required to meet drainage needs created by development; and WHEREAS, pursuant to SAMC section 34- 194, thirteen such drainage areas have been established within the City of Santa Ana; and WHEREAS, in accordance with SAMC section drainage area fee shall be specified by resolution Council; and 34-193, the of the City WHEREAS, the City Council does now find it necessary to increase the drainage area fees; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: the fees follows: 1. In the drainage areas of the City of Santa Ana, charged pursuant to SAMC section 34-193 shall be as Drainage Area Fee/Acre I $3260 II 3140 III 3525 IV 2335 V 3500 VI 2600 VII 3000 VIII 2380 IX 1870 X 2550 XI 3095 XII 1180 XIII 1030 330 RESOLUTION NO. 88-49 PAGE TWO 2. In accordance with SAMC section 34-191, the purpose of the drainage area fee is to provide for drainage facilities required to meet the drainage needs created by subdivision or other development of properties within local drainage areas which increase storm water runoff by coverage of absorption areas and increase demand for protection from storm waters. 3. In accordance with SAMC section 34-192, the use to which the abovesaid fee will be put is the construction, or reimbursement for construction, of drainage facilities within the local drainage area from which the fee was collected. The public facilities to be financed by the fee are identified in Exhibit A, attached hereto and incorporated herein. 4. The fee applies to all types of development pro- jects, including residential, commercial, office, and industrial, which will increase storm water runoff by coverage of absorption areas and increase demand for protection from storm waters. The use of the fee for drainage facilities and the need for such facilities is reasonably related to all types of development pro- jects which have such effects because all such development pro- jects generate storm water run-off or receive the benefit of protection from storm waters provided by such facilities. The restriction of the use of fees to drainage facilities which are within the local drainage areas from which the fees are derived assures that the fees derived from any given development project are used to provide those drainage improvements which most dir- ectly address the needs created by such development project. 5. As used hereinafter "project" means proposed construction activity which is subject to the payment of a drainage area fee under SAMC sections 34-191 through 34-195 and as to which construction pursuant to a validly issued building permit has not commenced as of the date of adoption of this resolution. 6. Ail previous resolutions of the City Council establishing or increasing drainage area fees are superseded by this resolution, and the fees established by this resolution shall apply to all projects, except as otherwise hereinafter provided. 7. Any project for which a building permit has been issued prior to the adoption of this resolution shall be ~ESOLUTION NO. 88-.49 PAGE THREE 331 subject to the drainage area fee which applied to such project immediately prior to the adoption of this resolution unless such building permit expires without commencement of construction.
