HomeMy WebLinkAbout88-059365 RESOLUTION NO. 88-59 A RESOLLrFION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 26 WHEREAS, by Minute Order dated June 20, 1988, a public hearing was called for August 1, 1988, at the hour of 7:30 p.m., at the Council Chambers of the City Hall, 22 Civic Center Plaza, Santa Ana, California, to ascertain whether the public necessity, health, safety, or welfare required the removal of poles, overhead wires and associated overhead stcuctutes, and the under- ground installation of wires and facilities for supplying electrical communi- cation or similar or associated service, for the formation of the Underground Utility District No. 26 within that certain area of the City described as fol- lows: The area bounded northerly and southerly by lines 100 feet frcm the centerline of MacArthur Boulevard, bounded easterly by centerline of Newport-Costa Mesa Freeway, and westerly by a line 150 feet west of centerline of Main Street. e The area bounded northerly by centerline of Columbine Avenue, bounded southerly by a line 240 feet north of centerline of MacArthur Boule- vard, bounded easterly by a line 90 feet east of centerline of Main Street, and bounded westerly by centerline of Main Street. The area bounded northerly by a line 240 feet north of centerline of ~mcArthur Bo~ie~a~, bounded southerly by a line 100 feet north of centerline o~ MacArthur Boulevard, and bounded easterly and westerly by lines 90 feet from the centerline of Main Street. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana: 1. That pursuant to Santa Ana Municipal Code Sections 37-1 to 37-13, the above-described area is hereby declared an Undet~round Utility Dis- trict and is designated as Underground Utility District No. 26 of the City of Santa Aha. Attached hereto, marked Exhibit "A," and hereby incorporated as a part of this Resolution, is a map delineating the boundaries of said District. 2. That the City Council does hereby fix June 1, 1989 as the date on which affected property owners must be ready to receive underground ser- vice, and does hereby order the removal of all poles, overhead wires and asso- ciated overhead structures and the underground installation of wires amd facilities for supplying electric, c~munication, or similar or associated service within Underground Utility District No. 26 on or before June 1, 1990. 36-6 RESOLUTION NO. 88- 59 PAGE TWO 3. That the Clerk of the Council is hereby instructed t,.) notify all affected utilities and all affected property c~wners within Underground Utility District 26 of the adoption of this Resolution within ten (10) days after the date of such adoption. Such notification shall be made by mailing a copy of this Resolution, together with a copy of said Santa Ana Municipal Code Sections 37-1 to 37-13 to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. 4. That the City Council of the City of Santa Ana hereby finds and determines as follows, upon the basis of the evidence presented at said hearing; that the public necessity, health, safety, and welfare require the removal of poles, overhead wires and associated overhead structures within said area of the City, and the underground installation of wires and facilities for supplying electric, cowaunication, and similar or associated services, so as to elimi- nate hazards caused by fallen lines and poles and to improve visibility of pedestrian traffic to vehicle drivers.
