HomeMy WebLinkAbout89-002REL:mb(35) 12/27/88 RESOLUTION NO. 89- 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING CON- DITIONAL USE PERMIT NO. 88-24 TO ALLOW A CONVENIENCE STORE AT 2120 EAST MCFADDEN AVENUE IN THE M-1 USE DISTRICT. WHEREAS, the Planning Commission of the City of Santa Ana, on October 24, 1988, after duly noticed public hearing, approved Conditional Use Permit No. 88-24, to allow the con- version of an existing automobile service building into a con- venience store at 2120 East McFadden Avenue in the M1 use dis- trict; and WHEREAS, said conditional use permit was approved subject to certain conditions, one of which was a requirement to remove an existing non-conforming freestanding sign ("Con- dition A3"); and WHEREAS, the 88-6, has appealed the Council; and applicant, by Appeal Application No. imposition of Condition A3 to this WHEREAS, this Council held a public hearing on Decem- ber 19, 1988, on said Conditional Use Permit and said Condition A3 pursuant to said Appeal Application No. 88-6; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based on the evidence submitted at the abovesaid hearing, this Council finds and determines as follows: Se The proposed convenience store will promote usage of a currently underutilized parcel and represents a convenient motorist service not currently avail- able in the vicinity. The project site has been designed to facilitate on-site circulation, and the use would function compatibly with current on-site and surrounding land uses. Ce The addition of the convenience store to the existing service station represents a higher economic use of the property while providing an ancillary commercial use in an office/industrial area. ,-. 00; 004 RESOLUTION NOo 89-7' PAG~ T~O do The industrial zoning district conditionally per- mits commercial service uses. Should this applica- tion be approved, the proposed use will comply with regulations and conditions specified for such use. ee The granting of the conditional use permit will not adversely affect the General Plan of the City which designates this area as Industrial. fe The requirement that the existing nonconforming free- standing sign be removed is a reasonable condition in that no circumstances exist which warrant the continuation of a sign which does not conform to the City's sign regulations with regard to the new use of the subject property. 2. Conditional Use Permit No. 88-24 is hereby approved, subject to the limitations, requirements and conditions set forth in Exhibit A, attached hereto and incorporated herein. 3. PLANNING Provide a landscape planter along McPadden Avenue .and Village Nay at a minimum of t~elve (12) feet and eighteen (18) feet, respectively. Prior to the issuance of a building permit, a landscape plan must be ·pproved. Prior to the issuance of a building permit, remove the existing non-conforming freestanding sign. A planned sign program, must be approved prior to building plan check. Provide a pedestrian walkway along the north and west sides of the buildiqg. ReplaCe the proposed photo panel on the north elevation and replace ~ith matching exterior materials. B. PUBLIC WORKS AGENCY Prior to the issuance of a building permit, construct the following off-site street improvements: s) ConsIruct a new drive approach on Village #ay Joining with the existing approach on'southerly property per City St·nd·rd #112C. h) Reconstruct the flares on the easterly drive approach on McPadden Avenue to City Standard #112C and realign the drive such that the flire does not encroach more than five feet upon the curb return. c) Construct street tree wells and plant street trees ·s may be required per City St·nd·rd 124. d) The furnishing of ornament·l street lighting with underground service may be · prerequisite. to issuance of · building permit ·nd prior to the release of utilities (occupancy).
