HomeMy WebLinkAbout89-028REL:mb(7) 3/14/88 Rev. 3/13/89 RESOLUTION NO. 89-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 88-19 TO ALLOW AN AUTO CARE CENTER AT VARIANCE WITH CERTAIN DEVELOPMENT STANDARDS AT 2402 SOUTH BRISTOL STREET WHEREAS, this Council held a public hearing on November 21, 1988 on Variance Application No. 88-19 to permit an auto care center at variance with applicable front yard setback, off-street parking and commercial landscape areas on the rear property line and parking lot interior, on property located at 2402 South Bristol Street in the C2 use district, which application came before this Council as appeal number 88-5 following its denial by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based on the evidence submitted at the abovesaid hearing, this Council finds and determines as follows: a. The proposed development, as conditioned herein, will be an improvement of the subject property and an enhancement of the surrounding neighborhood. b. Strict adherence to the applicable front yard set- back, off-street parking and commercial landscape areas on the rear property line and parking lot interior standards would make the proposed project infeasible to carry out. c. Because of special circumstance applicable to the subject property, the strict application of the zoning ordinances would deprive the property of privileges not at variance with the intent and purpose of the zoning ordinances. d. The granting of this variance is necessary for the presentation and enjoyment of one or more substantial property rights. RESOLUTION NO. 89-28 PAGE TWO e. The granting of this variance will not be materi- ally detrimental to the public welfare or injurious to surround- ing property. f. The granting of this variance will not adversely affect the General Business District land use designation for the area established by the General Plan of the City. 2. Variance 88-19 is hereby approved subject to the con- ditions, limitations and requirements set forth in Exhibit A, attached hereto and incorporated herein by reference. ATTEST: COUNCILMEMBE RS: Young Ac os t a Griset Absent May /~¥e McGuigan Ave Pulido Absent APPROVED AS TO FORM: City Attorney CONDITIONS OF APP£OVAL OF VA 88-19, APPEAL APPLICATION 88-$ The landscape plan shall be designed to visually and acoustically buffer adjacent residential uses and shall include a 10 feet wide minimum planter containing a buffer of 15 gallon trees planted 10 feet on center along the west property line. The hours of operation of the auto repair center shall begin no earlier than 7:00 am and end no later than 7:00 pm and all service bays shall be closed no later than 6:00 pm. All signs on-site, including the existing large pylon sign, shall conform to the City of Santa Aha Sign Ordinance and a sign program. The carwash shall be designed to be architecturally integrated with the overall project. All vehicles shall be removed from the property or shall be placed within closed service bays at night. All activity on site shall be conducted in such a manner as not to have a detrimental acoustical or visual effect on adjacent residential uses including the elimination of public address system use and.limited operation of air impact wrenches and other hilh noise generating equipment. The applicant shall deposit with the City funds equivalent to the cost of widening and improvini Bristol to 60 feet from centerline and said funds shall be utilized by the City for street widening purposes when Bristol is widened by the City from Warner to Center street. When street widening occurs, a fifteen feet wide landscgpe setback from the Bristol right-of-way line shall be provided except at the existing carwash. F. XHIBIT A
