A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA APPROVING CONDITIONAL
USE PERMIT NO. 89-2 TO ALLOW AN INDOOR
SWAP MEET, A SELF-STORAGE AND RETAIL/WHOLE-
SALE FURNITURE STORE, AND A GAS STATION/
CONVENIENCE MARKET ON PROPERTY LOCATED AT
3731 WEST WARNER AVENUE IN THE M-1 ZONE,
AND APPROVING VARIANCE NO. 89-2 TO WAIVE
CERTAIN LANDSCAPING AND LOADING AREA RE-
QUIREMENTS FOR SUCH PROPERTY.
WHEREAS, Conditional Use Permit Application No. 89-2
has been filed, to allow an indoor swap meet, a self-storage and
retail/wholesale furniture store, and a gas station/convenience
market on property located at 3731 West Warner Avenue in the M-1
zone; and
WHEREAS, Variance Application No. 89-2 has been filed,
to allow a waiver of the requirement for landscaping along prop-
erty zoned as Open Space, and the requirement for landscaping
in the interior of the parking area based on the number of park-
ing stalls, and the requirements for loading areas on the above-
said property; and
WHEREAS, this Council held a public hearing on June 19,
1989, on Conditional Use Permit Application No. 89-2 and Variance
Application No. 89-2, said applications having been brought be-
fore this Council on appeal following their denial by the Planning
Commission; and
WHEREAS, prior to taking this action, this Council re-
viewed and approved the negative declaration prepared for the
project;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing, this Council finds and determines as follows:
(a)
The proposed use of the property is compatible
with the industrial uses in the M-1 district
and will not adversely affect the development
of the surrounding area for industrial uses.
(b)
The proposed use of the property will benefit
the City by putting an otherwise vacant building
to productive use.

(c)
Therefore the proposed use will provide a
service or facility which will contribute
to the general well being of the neighbor-
hood and the community.
(d)
The proposed use, under the circumstance of
this particular case, will not be detrimental
to the health, safety or general welfare of
persons residing or working in the vicinity.
(e)
The proposed use will not adversely affect
the present economic stability or future
economic development of property in the
surrounding area.
(f)
With the approval of Conditional Use Permit
89-2 and Variance 89-2, the proposed use will
comply with the regulations and conditions
specified in Chapter 41 of the Municipal Code
for such use.
(g) The proposed use will not adversely affect the
General Plan of the City.
2. Also based upon the evidence submitted at the above-
said hearing, this Council further finds and determines as
follows:
(a
The landscaping requirements, if imposed in
strict conformity to Code requirements, would
unnecessarily and unreasonably reduce the area
available for off-street parking.
(b
Due to the nature of the proposed indoor swap
meet operation, the strict application of Code
requirement regarding loading areas would im-
pose an unreasonable and unnecessary burden on
such use.
(c
Therefore, there are special circumstances appli-
cable to the subject property due to which the
strict application of the zoning code would de-
prive the subject property of privileges not
otherwise at variance with the intent and purpose
of the provisions of the zoning code.

(d)
The granting of variance 89-2 is necessary for
the preservation and enjoyment of one or more
substantial property rights.
(e)
The granting of Variance 89-2 will not be materi-
ally detrimental to the public welfare or injuri-
ous to surrounding property.
(f) The grantinG of Variance 89-2 will not adversely
affect the General Plan of the City.
3. Conditional Use Permit 89-2 and Variance 89-2, as the
recitals to this resolution, are hereby approved, subject to the
conditions set forth in Exhibit A, attached hereto and incorpo-
rated herein, and subject to the following additional conditions:
(a)
Indoor swap meet operations shall be limited to
Saturdays, Sundays, and the two week period
December 11 through December 24 of each year.
(b)
There shall be no sale of alcoholic beverages on
the property unless a conditional use permit for
such purpose is approved by the City.

Prior to approval of site plan, complete the'
following:
Revise truck loading area and aisles at the
southwest corner of the building to provide
adequate turning radius and storage depth for
service truck use. The minimum acceptable turn
radius is 40 feet at this corner, with a 10 x
25 foot truck loading zone. Should the project
site be serviced by trucks with semi-trailers,
the minimum turning radius around the building
parameter shall be 50 feet.
Depic~ all drive approaches to be a wide flare
per City Standard #112C.
Prior to release of utilities, complete the following:
a. Improve Otis Avenue as follows:
Close three drive approaches with curb,
gutter and full uidth sidewalk per City
Standard 1101 and 1104.

Construct a new drive approach per City
Standard #lliC (W-35', A-45', X=4').
Note: May require the removal of
existing street trees.

Construct three street tree wells and
plant minimum 24-inch box trees per City
Standard 1124 at locations in accordance
w/th approved improvement plan.
Furnish ornamental street lighting uith
underground aervice or as directed by
City Engineer, '.
Remove "No Parking" zone on Otis Avenue.
Repair section of sunken sidewalk at east
end of Otis Avenue (in street knuckle)
adjacent to street tree.
Reconstruct the existing drive approach
that serves the nan aisle in front of the
building to City Standard

Construct a wheelchair ramp at the
northveat corner o£ #arner and Otis
Avenue and repair sections of cracked and
broken sidewalk and curb In this area.

Construct a new drive approach per City
Standard #ll2C

Construct the continuation of the
sidewalk at the northeast corner of
Harbor Boulevard and Warner Avenue for
the full curb return area including
construction of a wheelchair ra~p at the
corner.

Construct six street tree wells and plant
minimum 24-Inch box tree per City
Standard 1124 at locations in accordance
with approved improvement plan.
Furnish ornamental street tree lighting
vith underground service or as directed
by the City Engineer.

Improve Harbor Boulevard as follows:
I. Construct a full width sidewalk on Harbor
Boulevard from the end of the curb return
at Warner Avenue north approximately 40
feet to 50 feet to accommodate the
O.C.T.D. bus stop at this location.
Close the existing drive approach by
construction of an A.C. curb to match the
existing curb line and remove all A.C.
paving behind the curb within the public
right-of-way. Landscape the area to ,..
match existing.
