MAN ASSESSMENT DISTRICT FOR THE MAINTENANCE AND IMPROVEMENT OF LANDSCAPING AND STREET LIGHTING WITHIN THE BOUNDARIES AND THE TERRITORY INCLUDED IN CITY OF SANTA ANA MAINTENANCE BENEF] AND TO LEVY AND C PURSUANT TO AND LIGHTING ~ING NOTICE Dlution No. 87-62, initiated District pursuant to the p Lghting Act of 1972 (Part 2, Division and Highways Code); and ordered the En¢ of said Code; No. 87-62 the City Council a report pursuant to Section 22565 WHEREAS, Engineer did prepare and file such a report and the same was approved by the City Council on February 5, , 1990 by Resolution No. 90-011 (the "Engineer's Report") NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require and it is the intention of the city Council of the City of Santa Ana to order the formation of an Assessment District and to levy and collect assessments pursuant to the provisions of said Landscaping and Lighting Act of 1972 (Part 2, Division 15 of said Streets and Highways Code). SECTION 2. That the improvements to be undertaken consist of the maintenance, replacement and irrigation of median and parkway landscaping; and the operation, maintenance, improvement and acquisition of street lighting facilities located on and along the public streets within the City. The proposed Assessment District, designated as "city of Santa Ana Landscaping and Lighting Maintenance Benefit District", generally encompasses all of the territories within the city of Santa Ana, except the areas of all public streets, avenues, lanes, alleys, rights of way, publicly used for public purposes. All railroad, gas, water and electric utility owned property and rights of way shall be included in the RESOLUTION NO. PAGE TWO 90-012 proposed district and assessed benefit derived, pursuant to Streets and Highway Code Section 22595. SECTION 3. That reference hereby is made to the report of the Engineer on file with the Clerk of the Council and open to inspection, for full detailed description of improvements, the boundaries of the Assessment District zones therein, and the proposed assessments upon ass~ parcels of land within the District. SECTION 4. That sail servicing and replacement, in the ,f the City of Santa Ana, will lying within the described District as said Asses~ defined in said Engineer's Re public benefit derived from landscaping and street lighting. SECTION 5. Notice given that on March 19, 1990, at 7:30 o'clock p.m. in Council Chambers located at 22 Civic Center Plaza, Santa , California, all interested persons may appear before the City Council and be heard concerning the formation of the District, the extent of the District, the services to be performed, the proposed assessment and all other matters relating thereto. Protests must be in writing and must be filed with the Clerk of the Council prior to the conclusion of the hearing. Any such protest shall state all grounds of the objection and if filed by the property owner shall contain a description sufficient to identify the property. SECTION 6. The Clerk of the Council shall cause notice of the hearing to be given by causing the Resolution of Intention to be published and mailed in the manner required by Part 2 of Division 15 of the Streets and Highways Code.
