Hubbard, Henry H. Schlueter, Bob Brewer, A. A. Hall Absent: Councilmen Dale H. Helnly The Pledge of Allegiance was given. Invocation was given by Reverend Garland C. Lacey, Wilshire Presbyterian Church. Each member of the City Council having receiVed copies of the Minutes of April 17, 1961, reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Schlueter and carried. Sale of City property at northeast corner of Harvard and Fairview Avenues The Mayor announced this is the time set for the sale of a large R-1 (Single Family Residence District) lot, the approximate dimensions being 70 feet frontage on the north side of Harvard Street, 1~8+ feet along the easterly side of Fairview Street, north property line 82 feet, east property line 150+ feet, located at the northeast corner of Harvard and Fairview Streets. On motion of Councilman Hubbard~ seconded by Schlueter and carried, the Affidavit of Publication of Notice of Prop- erty Sale was received and filed. The Mayor asked the Clerk if any sealed bids had been received, and the Clerk stated there were none. The Mayor asked if there were any bids to be submitted from the floor. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Schlueter and carried, the following Resolution entitled: "Resolution No. 61-111 ordering the Street Superintendent to abate the public nuisance heretofore declared by the City Council of the City of Santa ~na, to-wit: Weeds which bear seeds of a wingy or downy nature and attain such a large growth as to become a fire menace when dry and which are noxious and dangerous, growing upon certain streets, side- walks and private property in the City of Santa Aha, by having the weeds referred to removed" was considered and passed by the following vote: Ayes, Councilmen Royal E. Heinly Appeal Application No. 21 of Elmer Fowler was presented on Variance Application No. 1470, to erect an eight-unit apartment house on property at 1509 No. Ross Street, in the R-2 District, wherein Planning C~ission recommended approval, subject to conditions. Applicant appeals the disqualification of parking stall No. 6 by Zon- lng Administrator on determination that it was inaccessible, and states that it is a usable stall. The Assistant Planner stated that the applicant had resolved the problem of the No. 6 Park~nE Stall and had requested withdrawal of the Appeal. On motion of Councilman Hubbard, seconded by Brewer and carried, Appeal Application No. 21 of Elmer Fowler was denied, and Variance Application No. 1470 granted, sub- Ject to conditions. On motion of Councilman Hubbard, seconded by Brewer and carried, the c~mication fram the planning Commission was received and filed, recommending approval of re- quest of Voorhees-Trindle-Nelson for the abandonment of a two-foot strip of land along the west side of Fairview Avenue, in accordance with Item "J" of Tentative Tract Map No. 3915, filed by McFadden Homes, and approved by City Council, Septemb ~e~l 19, 1960, subject to conditions. Heinly On motion of COuncilman Hubbard, seconded by Schlueter and carried, Preliminary Record of Survey Map No. 205, filed by Robert Elliott, creating two parcels located 1,000 feet west of Harbor Boulevard and on the north side of Sugar Avenue, was approved, subject to conditions. On motion of Councilman Hubbard, seconded by Schlueter and carried, the request of John M. Toups, Consulting Civi 1 Engineer, was granted for a one-year extension of. time to June 6, 1962, on Tentative Tract Map No. 3769, filed by B. J. Haupert, creating 76 lots located east of Gunther Street and 250 feet north of Camile Street, approved by the City Council on June 6, 1960, subject to conditions. On motion of Councilman Hubbard, seconded by Schlueter and carried, Revised Tenta- tive Tract Map No. 4002, filed by Practical Builders, creating 23 lots located 500 feet west of South Spruce Street and between Myrtle and Willits Streets, was ap- proved, subject to conditions. On motion of Cotulcilm~ Hubbard, secouded by Brewer and carried, Revised Tentative Tract Map No. 4163, filed by Norwood Homes, creating 64 lots located north of St. Andrew Place and approximately 650 feet west of Bristol Street, was approved subjeet to all conditions, with exception of Condition (1): "That Occidental Street be ex-i! tended westerly and southerly to Join existing Rene Drive." Councilman Heinly arrived at the meeting at 7:5© P.M. C~unication was presented from W. J. Gage, reference Preliminary Record of Sure'ye2 Map No. 203, creating three parcels located 1200 feet north of 17th Street on the east side of TuStin Avenue, approved by the City Council, February 20, 1961, sub- Ject to conditions, requesting that steps be taken to correct the condition of $1,000.00 per acre assessment as legally and morally unsound; and further stating his willingness to pay the exact cost per acre that all property owners in the area will pay, after a master drainage plan has been established. On motion of Councilman Hubbard, seconded by Schlueter and carried, the request was denied for correction in drainage charge, and the AdminiStrative Staff instructed to so advise the applicant. On motion of Councilman Hubbard, seconded by Heinly and carried, the request of the! Savage Constructian Company was granted to withdraw Tentative Tract Map No. 4040, creating twenty lots located east of King Street and fm~ediately west of the inter-~ sections of Washington Avenue, and 12th Street with King Street, subject to condi- tions, and to drop the zone application as escrow has been cancelled. On motion of Councilman Hubbard, seconded by Schlueter and carried, Map of Tract No. 3992, filed by B. I. C. Marsile, for dedication of Seventeenth Street, Sherry Lane, Nineteenth Street, Millwood Street and alley for public use for highway pur- poses; also all vehicular access rights on Seventeenth Street, excepting at inter- sections, and drainage easements as shown, a~ bond in the sum of $41,865.00 were approved; license fee in the amount of $~00.00 accepted, and agreement covering improvements ordered signed. On motion of Councilman Hubbard, seconded by Brewer and carried, Map of Tract No. 4076, filed by Via Son~, Inc., for dedication as public highways Jackson and Eleventh Streets, was approved, subject to the filing of a bond in the amount of 191 ' $11,000.00 to be approved by the Attorney; license fee in the amount of $550.00 Agreements R. On motion of Councilman Hubbard, seconded by Brewer and carried, proper officials were authorized to execute the following agreements: With R. A. Diedrich Cc~pany, dated May 1, 1961, authorizing the payment of $2,358.00 for the construction of excess capacity sanitary sewer in the 01d Tustin Avenue Sewer, located north of Seventeenth Street and east of Tustin Avenue, and for the ten-year recovery of costs for off-site facilities for Tract No. 2493; Escrow Instructions With Moffatt & Nicho1, Engineers, dated May 1, 1961, to perform the necessary engineering work and coordination with the Atchison, Topeka and Santa Fe Railway Company and Southern Pacific Company, in connection with the First Street Grade Separation Project; and With F. Gerald English, dated May 1, 1961, to recover the cost of off-site sanitary sewer connection to existing City sewers within the property on the south- west corner of Seventeenth and King Streets. Cruz, 916 East Stafford Street. 194 Attorney Maurice E.Wright (catering trucks) Dog Leash Law Ordinance Commmnication was presented from Attorney Maurice E. Wright, 900 North Broadway, , stating he represents Dale N. Ftckes, owner and operator of a concession bar c~ the ground floor lobby of the Citizens National Bank Building, from which he sells end dispenses sandwiches, coffee and other foodstuffs, and requested that some ac-i tion be taken with regard to the pickup truck, with a panel box, which has been dispensing foodstuffs at the entrance of the lobby during the noon lunch period, to the detriment of his client's business. In addition, the presence of a caterin~ truck is not proper in the downtown area, and should be restricted to industrial or construction areas, where restaurants may not be available. Councilman Heinly . stated the removal of catering trucks off the streets would include bakery trucks, --~ ice-cream vendors and others, there is an Ordinance providing for the licensing of catering trucks, and asked Attorney Wright how he would propose to remedy the situ~- ation. Attorney Wright stated he will study the matter further and report back tol the Council on behalf of his client. On motion of Councilman Heinly, seconded by Nubbard and carried, the communication was received and filed. The matter of the Dog Leash Law, tabled by the City Council on July 5, 1960, was requested by Councilmau Brewer to be brought back on the table for consideration, and presented a proposed Ordinance amending Section 4115 of the Santa Aha Municipa~ Code. On motion of Councilman Brewer, seconded by Schlueter and carried, the mat- ter of the Dog Leash Law was brought back on the table. Councilman Heinly presen- ted a cO~mmunication from Mr. and Mrs. Philip N. LaRiviere, 505 Jonquil Road, stat- lng if the laws pertaining to licensed animals and innoculation were enforced by the Pound~ster, there would be no need of a leash law, and on motion of Councilma~ Nubbard, seconded by Brewer and carried, the coz~unication was received and filed. Councilman Brewer stated there are 8,000 to 9,000 dogs in the City, and only 2,263 licenses were issued. Further, in 1960, there were 620 people bitten by dogs in the City, and in the first four months of this year, 203 more people were bitten than for the same period last year. The Mayor asked for representation for and against a leash law, and 90 people stood in favor and three persons stood in pro- test. Mrs. Anna Mae Famularo, 2322 Ramona Drive, stated they were not asking for a leash law because other cities have one, but the constantly growing population of the City with the increase of dogs, demanded an Ordinance to tell the dog owner~ where to keep their pets, end that vicious dogs, promiscuously roaming the street, must be restrained and confined. Further, such a law is urged by the P.T.A. Council, the P.T.A. groups, the Mail Carriers' Association, newspaper carriers, and a petition signed by approximately 2,000 persons. Arthur R. Snell, Principal, Diamond Elementary School, 1031 W. St. Andrew Place, reported cases of children bitten on the school grounds, and the cost of impounding the animals, and stressed'. the need for a leash law. In opposition of a dog leash law were Alice Carter, 822 E. Fifth Street, who stated children are bitten by dogs because they tease them, and also questic~ed the need for licensing dogs if they are confined; Leroy ~ Simler, 609 E. Pomona Street, questioned any law that chains dogs, and said much more damage is made by children than by dogs; and Mrs. C. Evans, 925 So. Standard Avenue, said any additional laws would be in conflict with the present laws on thel books, and it is principally up to the people to enforce them. Edward J. Murphy, 1262 Hickory Street, representing the Mail Carriers Association of Santa Ana, told of fourteen dog bites having been reported to their Personnel Department since the first of the year, with enumerable instances of dog attacks where the clothing of the mail carriers was torn, and con- veyed the Postmaster's concern for the protection of his employees and his carriers Mrs. William Wertens, 2313 So. Ramona Drive, suggested if everyone paid a license fee for their dog, this would enable the hiring of another animal control man.
