HomeMy WebLinkAbout90-065RESOLUTION NO. 90-065 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA INCREASING SEWER CONNECTION FEES WHEREAS, section 39-53 of the Santa Ana Municipal Code ("SAMC") requires payment of a fee for sewer connections to pay for the cost of sewer construction; and WHEREAS, said SAMC section 39-53 provides that the amount of the fee is based on an assessment per fixture units, except that in the case of parcels not previously connected to a public sewer the fee for the first occupancy unit benefitted by the sewer connection is based upon the standard cost of construction of a sewer main for a distance equal to the lineal street frontage of the subject parcel; and WHEREAS, in accordance with SAMC section 39-53, the assessment per fixture unit and the standard cost of sewer construction per lineal foot of street frontage is to be specified by resolution of the City Council; and WHEREAS, the City Council does now desire to increase the sewer connection fee; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. For purposes of SAMC section 39-53, the assessment per fixture unit is set at $48.00. 2. The purpose of the fee is to provide for sewers to meet the sanitation needs of the owners and occupants of property in the City. 3. The use to which the above said Fee will be put is the construction, or reimbursement for construction, of sewers. The public facilities to be financed by the Fee are identified in Exhibit A, attached hereto and incorporated herein. 4. The fee applies to all types of development projects, including residential, commercial, office and industrial, which require connection to the public sewer system. The use of the fee for sewers and the need for such facilities is reasonably related to all types of development projects because all such development projects generate sewage and require the protection from sewerage provided by sewers. AS used hereinafter "project" means proposed construction activity which is subject to the payment of a sewer connection fee under SAMC sections 34-191 through 34-195 and as to which construction pursuant to a validly issues building permit has not commenced as of the date of adoption of this resolution. 6. All previous resolutions of the City Council establishing or increasing sewer connection fees are superseded by this resolution, and the fees established by this resolution shall apply to all projects, except as otherwise hereinafter provided. 7. Any project for which a building permit has been issued prior to the adoption of this resolution shall be subject to the sewer connection fee which applies to such project immediately prior to the adoption of this resolution unless such building permit expires without commencement of construction.
