Each member of the City Council having received copies of the Minutes of June 19, 1961, reading of the Minutes was dispensed with and approved on motion of Counc~l~n Hubbard, seconded by Schlueter and carried. Bid Postponment Construct Sewer in Tustin Avenue Project S-29 Reso. No. 61-161 Authorize Execution Agreement Joint Parti- cipation water delivery line "East Orange County Feeder No. 2" On motion of Councilman Brewer, seconded by Schlueter and carried, the oral request of the Manager was approved and action continued until the next meeting on the award for the construction of a sanitary sewer in Tustin Avenue, between First Street and a point approximately 610 feet north of Fourth Street, Project S-29. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Brewer and carried, the following Resolution entitled "Resolution No. 61-161 authorizing execution of agreement between the Metropolitan Water District of Southern California and various cities and districts within the County of Orange for a Joint parti- cipation in constructic~ and use ~,f,.a water delivery line known as 'East Orange County Feeder No. Hearing Protests or objections against assessment for improvements in Gold~nWest Avenue and other streets Assess.District ieso. Heinly The Mayor announced this is the time and place for hearing of appeals or objections to the confirmation of the assessment in the matter of the construction of certain improvements in Golden West Avenue and other streets, in Assessment District No.204. as described in Resolution of Intention No. 60-249, adopted by the City Council on December 5, 1960. The Mayor asked the Clerk if she was in possession of the affi- davit of publication~ affidavit of mailing, and affidavit of posting. The Clerk stated that Notices of the filing of the assessment and of the time and place for hearing were duly and regularly published, posted and mailed, all as prescribed by law, and that affidavits showing such compliance are on file in her office. On motion of Councilmmn Hubbard, seconded by Schlueter and carried, the affidavits were received and filed. The Mayor then inquired of the Clerk if any written ap- peals, protests or objections had been filed as to the work done, or as to the assessment, or as to any other matters pertaining to the proceedings. The Clerk reported one conmmnication had been received frcm Mrs. Mabel Coleman, 1142 Golden West Avenue, protesting the amount proposed to be assessed against parcel 109-O92-4 for the reason that no approach was installed for the driveway and approaches to all other lots were cumpleted. On motion of Councilman Hubbard, seconded by Brewer and carried, the written protest fron Mrs. Mabel Cole~m~ was received and filed. Mr. Sidney L. Lowry, Civil Engineer, 1020 Bush Street, stated he had performed the work on ASsessment District NO. 204, and investigated the complaint filed by Mrs. Colema~ and found the assessment to be in error, occasioned by the transposition of the figures between her assessment and the adjoining lot. The Resolution ordering changes and madific~tions corrects this assessment, together with other modificati~ which involve the description of land in No.49-A on the diagram, where a split in the property was made since the assessment roll was approved last July. The Mayor then announced that this is the time and place fixed for the hearing of all appeals protests or objections to the doing of the work, the assessment, or to the confirma tion of the assessment, by the Council, and asked if anyone present desired to be heard. No one present desired to be heard. The Council being of the opinion that certain changes and modifications in the assessment should be made, and the Council having unanimously waived the reading of the Resolution, on motion of Councilm-n Hubbard, seconded by Schlueter and car- ried, the following Resolution entitled: "Resolution No. 61-162 ordering changes and modifications in Assessment for the improvement of Golden West Avenue and other streets (Assessment District No. 204) in the City of Santa Ana, California" was considered and passedby the following vote: Ayes, Councilmen Royal E. Heinly This being the date set for hearing on the annexation of property consisting of approximately 10.10 acres, located on the north side of Santa Clara Avenue, betwee= East and West Grand Avenues, designated as "Grand Avenue West and Santa Clara N.E. Annex"; the Mayor asked the Clerk if any written protests had been received, and she replied there we re no n e. The hearing was closed. On motion of Council- man Hubbard, seconded by Brewer and carried, the following Ordinance entitled: "Ordinance declaring the annexation of that certain territory designated 'Grand Avenue West and Santa Clara N. E. Annex'" was introduced, considered and placed on file for second reading. This being the date set for hearing on the annexation of property consisting of approximately 22 acres, located on both sides of Sugar Avenue, beginning at a point approximately 650 feet east of Ward Street, designated "Sugar East of Ward Annex"; no protests were received and the hearing was closed. On motion of Councilman Hubbard, seconded by Schlueter and carried, the following Ordinance entitled: "Ordinance declaring the annexation of that certain territory designated 'Sugar East of Ward Annex'" was introduced, considered and placed on file for second reading. On motion of Councilman Hubbard, seconded by Schlueter and carried, the hearing on the proposed Budget for the fiscal year 1961-62 was postponed to the meeting of July 17, 1961. Attorney Samuel Dreizen, 711 W. 10th Street, representing property owners in the area, stated opposition to any change in the residential character of the northeastern area, and requested denial of the Variance. Holland was again presented on Variance Ap- plication No. 1493, to build two single-family dwellings on property at a location south of 1517 No. Parsons Place, in the R-1 District, wherein Applicant appeals the denial of the Zoning Administrator and requests reconsideration on Variance. Mrs. Jack Nishiwaki, 1509 No. Parsons Street, stated her property is next door to the proposed construction and the frontage of the parcel is too narrow for both parking and the ingress and egress of cars; further, an increased dwelling would create a problem in the use of the septic tank and the supply of private well water. Mrs. A~her Hartel, Jr., 4709 W. Sunswept Avenue, presented communications fr~n Mrs. Leo LaCascia, 4717 W. Sunswept Avenue, and Mr. and Mrs. Kenneth Holland, 4701 W. Sun- swept Avenue, in protest of the two dwellings, and on motion of Councilman Brewer, seconded by Hubbard and carried, the co~mmu~ cations were received end filed. Mrs. Hartel objected to a change of zone for this area, stating it is an attractive, re- sidential single-family section, and granting the Variance would similarly encourag, the owners of surrounding property. Mrs. J. E. O~Neill, 4621 Sunswept Avenue, ob- Jected to the drainage problem from a septic tank to the rear of her property, and an additional unit on one lot would depreciate the area. The applicant stated that nearby property in the City of Garden Grove had been zoned Central Manufacturing, and the proposed R-2 use of his parcel should not be adverse to the c.'-,!~!~unity; als¢ adequate parking would be provided and a capacity cesspool to take care of the proE lem. On motion of Councilm~n Hubbard, seconded by Brewer and carried, Map of Traet No. hO40, filed by Practical Builders, Inc., for the dedication to the public use for street purposes King Street, Washington Avenue, 12th Street and Cascade Street, and bond in the sum of $23,000.00 were approved; license fee in the sum of $1,000.00 accepted, and agreement covering improvements ordered signed. Cn~munication was presented from the Planning Department recommending approval of Preliminsry Record of Survey Map No. 208, filed by Leland N. Hills, creating two lots located on the east side of Bewle~ Street, appraximately 150 feet south of Eleventh Street, subject to conditions. Mrs. Margaret Hills, lO12 No. Bewley reqUested clarification of Condition "e" as to the business license tax payment of $100.00, and was advised by the Planning Director that the tax payment is $50.00 not $100.00, due to a lot split. Parton Street, questioned the Resolution vacating a portion of St. Andrew Place, between Standard Avenue and the Southern Pacific Rail. for co~ls~der~$1on road right-of-way, and presenmed/a Ma0or ~mreet Plan, dated September 20, 1955, stating St. Andrew Place is indicated thereon as a potential artery to connect wit! the South Main Street business area. On motion of Counci~m~u Hubbard, seconded b~ Schlueter and carried, the map of the Major Street Plan was received and filed. A petition was presented signed by approximately 88 persons protesting the continue use of certain newly installed equipment at the Arrow Laundry & Cleaners, 620 E. Sixth Street, stating its operation shakes the ground, has broken windows and cause other structural damage to buildings within a four-block area. Approximately 25 persons stood in protest of the operation. On motion of Councilman Hubbard, secon- ded by Schlueter and carried, the petition was received and filed. The Attorney stated that in response to calls the Police and Building Departments have investi- gated the condition, and a report has been requested from the Building Department, as well as the Police Department, relative to the nuisance of the vibration. The Mayor asked the Attorney if the problem is a public or a private nuisance, and the Attorney stated sufficient information is not available to determine the nuisance definition. On motion of Counci~ Hubbard,. secc~ded by B~ewer and carried, the Manager and Attorney were instructed to make the necessary determination, before the next meeting, as to whether or not the operatian of the laundry is a public or a private nuisance, and to proceed with the necessary action, and the spokesman be advised as to what avenues are open to them. Mr. C. V. Robinson, 603 E. Sixth Street, stated when the Variance was approved by the City Council in 19B7, the Variance was protested as it is a residential area, and we were assured there woul~ be no disturbance from the laundry and no heavy machinery would be installed.
