RESOLUTION NO. 90-~0
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AMENDING THE LAND USE
ELEMENT OF THE GENERAL PLAN (GPA 90-7)
WHEREAS, the Planning Commission of the City of Santa
Ana, after noticed public hearing, approved an amendment to the
General Plan of the City of Santa Ana as hereinafter set forth;
and
WHEREAS, this Council has reviewed and considered the
initial environmental study and negative declaration prepared
for such proposed General Plan amendment; and
WHEREAS, this Council,
hearing, concurs in the planning
General Plan Amendment;
after duly noticed public

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA as follows:
1. The adoption of said General Plan amendment will
not have a significant effect on the environment, and the nega-
tive declaration prepared for said amendment is hereby approved.
2. The "Land Use Plan" of the Land Use Element of
the General Plan of the City of Santa Ana is hereby amended to
redesignate that area of the city shown on Exhibit A, attached
hereto and incorporated herein, from the "Medium Density Resi-
dential'' category to the "Low Density Residential" category.
3. The "Low-Medium Density Residential" land use
category is hereby reestablished in the general plan, with
maximum density of eleven (1t) dwelling units per acre.

4. The "Land Use Plan" of the Land Use Element of
the General Plan of the City of Santa Ana is further amended
to redesignate those areas of the city shown on Exhibit B, at-
tached hereto and incorporated herein, from the "Medium Density
Residential" category to the "Low-Medium Density Residential"
category.
5. Except as otherwise provided in paragraph 6
hereinbelow, any real property which on or before meets either
or both of the following conditions may be developed in accord-
ance with the density limitations of the General Plan as it
existed immediately prior to its amendment by this Resolution:
(a) Residential development was approved for the

property through any one of the following discretionary
actions:
(1) Approval of a conditional
use permit.
(2) Approval of a tentative sub-
division map.
(3)
Approval of a development project
plan (commonly refered to as a "site
plan") for the property pursuant to
sections 41-688, et seq., of the
Santa Ana Municipal Code, or, as to
property in an SD (Specific Develop-
ment) district, pursuant to the pro-
cedures set forth in the applicable
specific development plan.
(b) Application for a building permit for such de-
velopment has been filed pursuant to Chapter 3 of the Build-
ing Code.
6. Any property which qualifies for development in ac-
cordance with the General Plan density limitations as they existed
immediately prior to this General Plan Amendment pursuant to sec-
tion 5 hereinabove, shall lose such qualification, and thereafter
be subject to the General Plan density limitations established by
this General Plan Amendment, in the following circumstances:
(a) Where such qualification is based upon
approval of a conditional use permit: if such conditional
use permit is revoked for good cause or expires due to
nonuse.
(b) Where such qualification is based upon
approval of a tentative map: if such tentative map ex-
pires without approval of a final map or parcel map.
(c) Where such qualification is based upon
development project plan ("site plan") approval: if
application for a building permit for such development
pursuant to Chapter 3 of the Building Code is not filed
within one (1) year after the date of this resolution.
(d) Where such qualification is based upon
the filing of an application for a building permit pur-
suant to Chapter 3 of the Building Code: if such build-
ing permit application expires without issuance of the
building permit, or, as to any development for which a

building permit is issued, if such building permit ex-
pires without the commencement of construction pursuant
thereto.
