Hubbard, Henry H. Schlueter, Dale H. Heinly, Bob Brewer, A. A. Hall Absent: Councilmen None The Pledge of Allegiance was given. ~vocation was given by Reverend Lloyd Munger, First Baptist Church of Santa Ana. !Each member of the City Council having received copies of the Minutes of July 17 and July 27, 1961, reading of the Minutes was dispensed with and approved as mailed on motion of Councilman Heinly, seconded by Hubbard and carried. W. Annex" Ordinance Hersey-Sparling Meter Company was accepted for Item No. 1, at the unit price of $330.21, in the total amount of $6,604.20, and the lowest bid of Badger Meter Mfg. Company was accepted for Item No. 2, at the unit price of $475.11, in the total amount of $4,751.10, and all other bids rejected. This being the date set for hearing on the annexatic~ of property consisting of approximately ten acres, located on the east side of Wright Street, beginning at a point approximately 200 feet north of Twentieth Street, designated as "Twenty-First and Lyon N. W. Annex"; the Mayor asked the Clerk if any written protests had been received, and she replied there were none. On motion of Councilman Heinly, by Hubbard and carried, the Affidavits of Publication were received and filed. No protests were received and the hearing was closed. On motion of Councilman Heinly, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance declaring the annexation of that certain territory designated 'Twenty-First and Lyon N. On motion of Councilman Heinly, seconded by Hubbard and carried, the conm~mications and Resolution were received and filed. George M~ax~ell, Coordinator of Endustrial Development Division, lllO Eastside Avenue~ urged consideration of the abandonment and referenced the nine reasons for the action taken by the Executive Committee. Mr. H. E. Freeman, 1631 So. Lewis Street, ^naheim~ representing Southern Pacific Railrond Company, supporte said abandonment and stated it would stimulate the business of the railroad as well as South Main Street, but opposed the extension of St. Andrews Place across their right-of-way. Orson H. Hunter~ 816 South Ross Street, stated he owns commercial property at 830 So. Main Street~ and, as Chairman of the South Main ~treet Improve- ment Association, is very much interested in the c~amercial welfare of South Main Street, and the free access of traffic to that area through improved east-west streets. Mr. R. F. Kalbus, Vice President, Alexander H. Kerr & Company~ Inc. 1221 E. St. ~ndrews Place, stated the ~oposed abandonment is requested for the expansio~ of additional plants for which a track has been acquired on the south side of St. Andrews Place, and the additional employment should be beneficial to the South Main Street merchants. Raymond Gentry~ Chief Planning Engineer, Alexander H. Kerr & Ccmpany~ Inc., 217 E. Pnmona Street, stated the abandonment action was instituted only after an engineering study was made to develop the two properties involved~ an¢ a spur with double trackage is required across East St o Andrews Place to provide adequate rail service to their present and future plant facilities. J. Ogden M~rke~ 1814 So. Parton Street, expressed hope that the area could be retained and maintain~ as an entrance to the South Ma~ping District, and stated there are many mer- chants in the vicinity who have looked to the east of St. Andrews Place as a future development for traffic ingress and egress. Nine people stood in protest of the proposed abandonment. Glen Layton~ 1235 W. Santa Clara ~venue, protested the aban- donment, stati~ he has property at 1~69 South Main Sbreet and there is considerabl~ undeveloped acreage f~mediately to the east of Standard ~venue. Ben Sherwood, 1907 So. Cedar Street, representing home owners of the area, protested the noise nuisance fram the manufacturing plan%s and stated it is short-sighted for indus.- ~ries to build in desirable areas where acoustical means are not used to control the noise and the properties improved to m~ke the plant areas attractive. James Scobie, 917 W. 17th Street, Realtor, stated several years ago he sold land to Kerr Glass and last February an additional twelve acres was purchased to the sout! of this property, the north end of which adjoins St. Andrews Place, and this Company has shown interest in the City. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard~ seconded by Schlue. ter and carried, the following Resolution entitled: "Resolution No. 61-186 ordering vacation of a portion of St. Andrews place between Standard Avenue and the Southern Pacific Railroad Right-of-Way" was considered and passed by the following vote: Ayes, Councilmen Royal E. Heinly, Bob Brewer Absent, Councilmen None This being the date set for hearing to vacate a portion of Sixth Street, between Mabury Street and the Santa Ana Freeway; no protests were received and the hearing was closed. On motion of Councilman Hubbard, seconded by Brewer and carried, the Affidavit of Publication was received and filed. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Brewer and carried, the following Resolution entitled: "Resolution No. 61-187 ordering vacation of a portion of Sixth St~reet between Mabury Street and the Santa Ana Freeway, reserving therefrom a public utility easement" was considered and passed by the following vote: Ayes, Councilmen Royal E. On motion of Councilman Heinly, seconded by Hubbard and car- ried, the reports on "Master Plan for Rainfall Drainage System Development, August 1960," by Voorheis-Trindle-Nelson, Inc., and the "Master Plan for Storm Drains for the City of Santa Ana," January, 1961, by Boyle Engineering, as submitted rela- tive to the drainage problem, were approved, received and filed. The Council havi~ unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Schlueter and carried, the following Resolution entitled: "Resolution No. 61-188 adopting a map entitled 'Drainage -- A Phase of the Public Services and Facilities Element of the Oeneral Plan of Commaunity Development" and a pamphlet bearing the same title and dated July, 1961, as based upon two studies -- one entitled 'City of Santa Aha, California Report on Master Plan For Rainfall Drainage System, August, 1960' as prepared by Voorheis, Trindle and Nelson of Westminster, California; and the other entitled 'Preliminary Engineering Report of the Master Plan for Storm Drains for the City of Santa Aha, Orange County, California, January, 1961' as prepared by Boyle Engineering of Santa Ana, California" was considered and passed by the following vote: Ayes, Councilmen Royal E. Hall Noes, Councilmen None Absent, Councilmen Hone Appeal Application No. 31 of William Acker ~s presented on Variance ~pplication No. 1505, to establish an ambulance service with less than required off-street parking, on property at 2227 South Bristol Street, in the C-5 District, wherein Applicant appeals the six-months' limitation of the Variance as unrealistic and should be granted for five years. Attorney Stanley C. Gould, 325 No. Broadway, re- presenting the applicant stated two ambulance services are located on North Main Street and his client is attempting to establish a service in the south part of the City. This property would be conducive to an ambulance service, because all indus- try is located in the v~cinity. In order to establish such a service, a period of five years, or even three years, is necessary and Mr. Acker intends to purchase property next to his for a medical supply house. There would be ample parking if a five-foot setback is not required, with sufficient turning radius for one ambulance only driving onto the street. The Council having unanimously waived the reading of the Resolution, on motian of Councilman Heinly, seconded by Hubbard and carried, the following Resolution entitled: "Resolution No. 61-190 granting Variance on Application No. 1505 of William Acker where one condition imposed by the Planning Cvmmisston was modified" for a period of one year, was considered and passed by the following vote: Ayes, Councilmen Rc~j~al E. Hall Noes, Councilmen None Absent, Councilmen HOne Appeal Application No. 32 of Harry Tancredi Co~apany was presented on Variance Appli cation No. 1509, to erect a 2~-unit apartment house on property at 806-10-1~ South Cypress Avenue, in the R-2 District, wherein Applicant appeals denial of Zoning Administrator, for reasons that 26 Variances were granted on Cypress Avenue, for R-3~ R-2, C-l, P and PK Districts, and states the City Council instructed the Plan- ning Department to hold hearings to change zoning to R-3 on Cypress Avenue. Harry Tancredi, ll06 E. 17th Street, stated each unit would have 1006 square feet, with sufficient side yards and one covered parking space for each apartment, and enumera ted Variances granted for multiple units in the area. Mrs. Mabel Ellen Gowman, 2032 No. Main Street, requested a solid fence between her property at 818 So. Cypre; Avenue and the adjoining proposed property,to which the Applicant agreed. Kokx, dividing a large parcel of industrial land, located at the northwest corner of McFadden ue and Lyon Street, subject to conditions; and Preliminary Record of Survey Map No. 211, filed by Alfredo Ledda, dividing a large lot into three residential lots, located on the north side of Roosevelt apprc~imately 565 feet west of Verano Street, subject to conditions. On motion of Councilman Heinly, seconded by Hubbard and carried, Map of Tract No. 424~, filed by Montgomery Park, for the dedication of Harbor Boulevard, Kent Crystal Lane, Lehnhardt Avenue, Figueroa Street and Jackson Street for public use for street purposes, and Lot A to be used for water, sewer, and storm drain purpose and water easement as shown, was approved, subject to the submission of a bond in the sum of $90,000.00 and the approval of the Attorney as to form; license fee in the sum of $3,850.00 accepted, and agreement covering improvements ordered signed. On motion of Councilman Heinly, seconded by Hubbard and carried, proper officials were authorized to execute the following agreements: No. UA6105-26 with the County Flood Control District and the City of Garden Grove to relocate two water lines on West Fay Circle and Morningside Avenue, in connection with the construction of the East Garden Grove-Wintersburg Channel fr~n Newhope Street to Haster Retarding Basin, Project C5; Permit No. 07061 with the 0ounty Flood Control District, granting permission to Permittee to construct a reinforced concrete b~x inlet and concrete slope prote¢ tion within district's right-of-way of East Garden Grove-Wintersburg Channel at approximately Engineer's Sta. 402+80.95 for the City of Santa Ana's construction C-5-F Channel, in accordance with sheets l, 5 and 6 of the approved plans; and With the County, dated August 7, 1961, for Arterial Highway Ftuancing Program for Fairview Street, Talbert to Segerstrc~n Avenues, Project No. 96, where project limits (lines 31 and 32) were improperly stated. On motion of Councilman Heinly, seconded by Brewer and carried, proper officials were authorized to execute agreement with Santa Ana Neon Company and L. J. and Priscilla E. Holmberg, to construct an electric sign in front of 3331 Bolsa Avenue which extends over and upon the established setback line, subject to of the City Attorney to waive the standard requirements. On motion of Councilman Heinly, seconded bYHubbard and carried~ proper officials were authorized to execute an agreement with William T. and. Louise M. Reetz, and E. C. ^gnew, dba Santa ~na Neon Company, Tenant, for the Owners to pave a cer- tain portion of Santiago Street, located south of Washington ;~venue, in accordance with City standards, except that the requirement of curbs, gutters and sidewalks be waived until such time as the property fmmediately south of Owners' parcel is im- proved. Termohlen, 16~8 E. 17th Street, requested the City Council to accept a study of the feasibilit of high-rise structures in low density areas, which will be submitted within the ninety-day period of the interim Ordinance, and on motion of Councilman Mubbard, seconded by Brewer and carried, the offer was accepted, and the report is to be submitted within the ninety-day interim period of the Ordinance. Webb Brown, 1701 No. Flower Street, protested the Ordinance, stating there were no sky rights laws, and the ninety-day stop gap to build higher than two stories has already increased property prices south of 17th Street. John Faught, 2002 No. Broad~ay, protested the Ordinance as there is danger of it being permanent, and it discriminates agains those desiring to build higher than two stories, where four-story builaings already exist. Attorney C. Arthur Nisson, Jr., 2014 No. Broadway, representing property owners Of the North Broadway area, requested that the Ordinance not be adopted. There is a great deal of valuable property involved in the North Broadway area, north of 17th Street, and the property owners should be able to protect their in- vestments. Nr. E. Sherrard, 1922 No. Broadway, objected to the adoption of the Ordinance, and stated he had paid a premium for his property. Dr. Norman King Beals, Jr., ll20 W. Warner Avenue, stated he and his associates planned to construc two six-story retirement centers that will be an asset to the conm~mity, and the City's progress depends upon buildings of height. Hall Noes, Councilmen None Absent, Councilmen None The Council having unanimously w~ived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Heinly and carried, the following Resolution enti- tled: "Resolution No. 61-203 prohibiting parking in excess of two hours on the north side of Washington Avenue between Main Street and Sycamore Street" whereby no person shall park any vehicle on the north side of Washington Avenue, be- tween Main Street and Sycamore Street, and leave the same so parked for a period of time longer than two hours, between the hours of 7:00 A.M. and 6:00 P.M. of any day, except Sundays and holidays; and establishing 2h-Minute Parking Zones on the west side of Sycamore Street, between Washington Avenue and Fifteenth Street, reference request of Patio Restaurant, was considered and passed by the following vote: Ayes, Councilmen Royal E. Recruiting Officers' vehicles at 223 North Broadway, and a report from the Department of Public Works reccm~nending the following Section be added to the new proposed Traffic Ordinance, and that the Ordinance, including the following Section, be adopted: "Section 3253 (d) The Chief of Police may issue parking meter hoods (at no charge) for official United States Government vehicles which are used directly by Recruiting Offices of the United States Armed Forces." On motion of Councilman Hubbard, seconded by Heinly and car- ried, the c~unication and report were received, filed, and the following Ordinance entitled: 'Adding Section 3311.7 to the Santa Aha Muncipal Code pro- viding United States Government Recruiter Parking Meter Hoods" was introduced, considered and placed on file for second reading. On reco~aendation of the Department of Public Works, and on motion of Councilman Hub bard, seconded by Heinly and carried, the request of Elmer W. Meislahn, 605 South Broadway, was denied for the removal of No Parking signs in the 500 block of South Flower Street. Petition was presented signed by approximately B7 persons protesting the traffic situation on Tam~ Lane (between Honer Plaza and Santa Clara ~venue) during the hours of 4:30 P.M. and 5:~0 P.M., and requesting a traffic study, in the interest of the 265 Limited Parking on 117th and English Sts. Randolph Fulcher, 2122 Tam~ Lane, pre. sented a petition signed by sixty persons requesting alleviation from the traffic conditions existing on Tamy Lane each week-day evening between 4:30 P.M. and 5:00 P.M. On motion of Councilman Hubbard, seconded by Schlueter and carried the petition was received, filed, and the matter referredtO the Department of lic Works for recommendation and report. On recc~mendation of the Department of Public Works, the request of Marianne 1702 No. English Street, Ariel Realty~was denied for Lfm~ted Parking on Seventeenth and English Streets.. Miss Marianne Patton stated the cars of personnel of nearby offices are parked in front of her real estate office, and requested two-hour parking, rather than 24- minute parking, for the clients. On motion of Councilman Brewer, seconded by Hub- bard and carried, the matter was referred to the Curb Usage C~-...fttee for further study with reference to Limited Parking. On motion of Councilman Hubbard, seconded by Brewer and carried, the request of Ray L. Musick, 161~ North Towner Street, for angle parking in the North Towner Street cul-de-sac, was postponed to the next meeting. Cv~nication was presented frc~ Harold C. Dow, A.I.A., San Francisco, requesting permission to use terrazzo in the entry and extending into the sidewalk of the United Title Guaranty Company office building, located at Eighth and Ross Streets. On motion of Councilman Hubbard, seconded by Brewer and carried, permission ~s furnish granted to use terrazzo if it is of the non-slip type, also/evidence of insurance so that the City is protected frc~ any liability. On motion of Counc~l~Au Hubbard, seconded by Schlueter and carried, the request of John K. Colwell, City Attorney, was granted to leave the State, beginning August and returning August 15, 1961, at no expense to the City.
