HomeMy WebLinkAbout91-050 ~ D DY: ORD/R °'"=~ 0 DATE: ~-/. 0'"- ~ ,~..~ RESOLUTION NO. gl- 050 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA SETTING DRAINAGE AREA FEES WIIEREAS, sections 34-91 through 34-195 of the Santa Aha Municipal Code ("SAMC") establishes the authority for the City of Santa Aha to establish fees to pay for drainage facilities required to meet drainage needs crested by development; and WHEREAS, pursuant to SAMC section 34-194, thirteen such drainage areas have been established within the City of Santa Aha; and WHEREAS, tn accordance with SAMC section 34-193, the drainage area fee shall be specified by resolution of the City Council; and WHEREAS, the City Council does now find it necessary to increase the drainage area fees. Nog, THEREFORE, SE IT RESOLVED BY THE CITY COUNCIL OF TIlE CITY OF SANTA ANA AS FOLLOWS: 1. In the drainage areas of the City of Santa Aha, the fees charged pursuant to SAMC section 34-193 shall be as follows: Drainage Area Fee/Acre I $3850 II $3690 Il! $4160 IV $2750 V $4130 VI $3070 VII $3540 VIII $2810 IX $2210 X $3010 XI $3650 XII $1400 XIII $1220 023 RESOLUTION NO. 91- 050 PAGE 2. In accordance with SAMC section 34-191, the purpose of the drainage area fee is to provide for drainage facilities required to meet the drainage needs created by aubdtvtsion or other development of properties within local drainage areas which tncreaae storm water runoff by coverage of absorption areaa and increase demand for protection from storm water. 3. In accordance with SAMC section 34-192, the use to which the above said fee will be put is the construction, or reimbursement for construction, of drainage facilities within the local drainage area from which the fee waa collected. The public facilities to be financed by the fee are identified in Exhibit A, attached hereto and incorporated herein. 4. The fee applies to all types of development project, including residential, commercial, office and industrial, which will increase storm water runoff by coverage of absorption areas and increase demand for protection from storm waters. The use of the fee for drainage facilitiea and the need for auch facilities is reasonably related to all types of development projects which have such effects because all soch development projects generate storm water run-off or receive the benefit of protection from storm waters provided by such facilities. The restriction of the use of fees to drainage facilities which are within the local drainage areas from which the fees are derived assures that the feea derived from any given development project are used to provide those drainage improvements which most directly addreas the needs created by such development project. 5. As used hereinafter "project" means proposed construction activity which Is subject to the payment of a drainage area. fee under SAMC sections 34-191 through 34-195 and as to which construction pursuant to a validly issued building permit has not commenced as of the date of adoption of this resolution. 6. All previous resolutions of the City Council establishing or increasing drainage area fees are superseded by this resolution, and fees established by this resolution shall apply to all projects except as otherwise hereinafter provided. 025 RESOLUTION NO. 9l- 050 PAOE THREE 7. Any project for which a building permit has been issued prior to the adoption of this resolution shall be subject to the drainage ares fee which applies to such project immediately prior to the adoption of this resolution unless such building permit expires without commencement of construction.
