HomeMy WebLinkAbout91-059171 REL: 6/18/91 RESOLUTION NO. 91- 059 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 91-002, TO ALLOW, FOR A TWO-YEAR PERIOD, A REDUCTION IN THE OFF-STREET PARKING REQUIREMENTS FOR A COURT REPORTING SCHOOL IN AN OFFICE BUILDING LOCATED AT 1200 NORTH MAIN STREET WHEREAS, this Council held a public hearing on June 17, 1991, on Variance Application No. 91-002, to allow a reduction in the off-street parking requirements for a court reporting school in an office building loctated at 1200 North Main Street; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Council finds and determines as follows: A. Because of special circumstances applicable to the subject property, the strict application of the off-street parking requirements in the zoning regulations would deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter; It is possible that parking facilities may be constructed in the area of the subject site in two years. To deny any reduction in parking for such time p~riod would be to preclude economic use of the subject building for such time period. B. That the granting of a variance is necessary for the preservation and enjoyment of one or more substantial property rights; A reduction in parking requirements is necessary to allow economic use of the subject building. c. That the granting of a variance will not be materially detrimental to the public welfare or injurious to surrounding property; Although the reduction in parking requirements may result in some additional parking problems in the area, such condition will be for a temporary period. At the end of such period, if new parking facilities are not available, the subject building will be required to conform to the off-street parking requirements. D. That the granting of a variance will not adversely affect the General Plan of the City; The General Plan designation for this area is General Business District (GBD), which allows for the development of commercial and retail uses. The granting of this variance for a reduction of off-street parking requirements for a two-year period will have no direct detrimental effect on the General Plan. 2. Subject to the conditions set forth below, Variance No. 90-016 is hereby approved for a period ending on July 1, 1993, after which such variance shall be of no further force or effect. 3. The approval of Variance No. 90-016 is subject to the following conditions: The applicant shall provide a parking layout on the lot intended to be purchased for the school. The applicant shall provide documentation for remote parking lot or lots used by the owner for the court reporting school.
