HomeMy WebLinkAbout91-064Resolution No. 91- 064 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING RESOLUTION NO. 82-110 TO PROVIDE FOR FEDERAL GOVERNMENT MANDATED RETIREMENT BENEFIT FOR PART-TIME, TEMPORARY AND EMERGENCY CLASSES OF EMPLOYMENT CONTAINED IN THE CITY'S BASIC CLASSIFICATION AND COMPENSATION PLAN WHEREAS, on August 2, 1982, the City Council passed and adopted Resolution No. 82-110 revising and re-establishing the Basic Classification and Compensation Plan for Officers and Employees of the City of Santa Ana; and WHEREAS, Section 1004, Article X of the City Charter of the City of Santa Aha requires the City Manager to prepare, install and maintain a position classification and pay plan subject to civil service rules and regulations and the approval of the City Council; and WHEREAS, City Council has from time to time amended said Resolution; and WHEREAS, Federal Government through adoption of Omnibus Budget Reconciliation Act of 1990 has mandated that all part-time, temporary and emergency employees not covered by an existing retirement system be covered by Social Security or other qualified retirement plan; and WHEREAS, the city staff has evaluated all options and now recommends that all eligible employees be covered by a qualified retirement plan such as a Section 457 Deferred Compensation Plan with a required total contribution of 7.5% of employee wages; and WHEREAS, the City has met and conferred with SEIU and has reached an agreement whereby represented part-time employees will contribute 3.75% of their wages into a qualified retirement plan and the city will match their contribution by depositing 3.75% in employee's retirement account; and WHEREAS, it is now desired to provide for a similar benefit to the eligible part-time, temporary and emergency employees who are not represented by the Union (SEIU). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: 1. That Resolution No. 82-110, as amended, is hereby further amended by adding in proper numerical sequence a new Section 3.6 to provide for the following federally mandated retirement benefits to all unrepresented eligible part-time, temporary and emergency employees as set forth below: 3.6 Mandated retirement benefits for all eligible part- time, temporary and emergency employees.
