HomeMy WebLinkAbout91-072REL: 7/5/91 RESOLUTION NO. 91-072 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN OF THE CITY OF SANTA ANA (GPA 90-9, AS IT PERTAINS TO THE AREA NORTH OF FIRST STREET BETWEEN SPURGEON AND LAcY STREETS) WHEREAS, the Planning Commission of the City of Santa Ana, after duly noticed public hearing, approved an amendment to the General Plan of the City of Santa Ana as hereinafter set forth; and WHEREAS, this Council has reviewed and considered the initial environmental study and negative declaration prepared for such proposed General Plan amendment; and WHEREAS, this Council, after duly noticed public hearing, concurs in the Planning Commission's approval of said General Plan amendment; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. The adoption of the said General Plan amendment will not have a significant effect on the environment, and the negative declaration prepared for said amendment is hereby approved. 2. That exhibit numbered 4, attached hereto, is hereby incorporated herein by reference. 3. The "Land Use Plan" of the Land Use Element of the General Plan of the City of Santa Ana is hereby amended in the following particulars. The following areas delineated in Exhibit 4 is rede- signated from their current land use categories to the land use categories specified for them respectively hereinbelow: Exhibit Area Category 4 3 4 4 General Business District Medium Density Residential 4. Any real property which on or before the date of this Resolution meets either or both of the following conditions shall, at the option of the owner of the property, be subject to the land use and density limitations of the General Plan as it existed immediately prior to its amendment by this Resolution: RESOLUTION 9 -072 ' 5?2 PAGE 2 (a) Development was approved for the property through the approval of a conditional use permit or a tentative subdivision map. (b) Application for' a permit for such development has been filed pursuant to Chapter 3 of the Building Code; provided, however, this section shall cease to apply to any development for which a conditional use permit or tentative map was approved if the conditional use permit or tentative map expires or is revoked for good cause, or to any development for which a building permit application expires without issuance of the building permit, or to any development for which a building permit is issued but expires without the commencement of construction.
