HomeMy WebLinkAbout91-095RESOLUTION NO. 91-095 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING CRITERIA FOR CHARITABLE PAYROLL DEDUCTIONS, REPEALING RESOLUTION NO. 79-172, AND AUTHORIZING UNITED WAY OF ORANGE COUNTY NORTH/SOUTH AND THE ENVIRONMENTAL FEDERA- TION OF CALIFORNIA TO CONDUCT CHARITABLE FUND DRIVES AMONG CITY EMPLOYEES. WHEREAS, Section 1157.2 of the Government Code provides that "With the approval of the governing body of a public agency and under such regulations a sit may prescribe, employees of the public agency may authorize deductions to be made from their salaries or wages either for the payment of contributions to bona fide charitable organizations or for the payment of designated sums to a nonprofit California corporation which is compelled by its bylaws to make, and which does expend such sums solely by the making of, contributions to bonafide charitable organizations;" and WHEREAS, the City of Santa Ana desires to minimize loss of productive work-time from public business by City employees occasioned by charitable fund drives in City facilities; and WHEREAS, the City Council of the City of Santa Ana considers a combined fund drive on behalf of charitable organizations to be more efficient and equitable than multiple fund drives and, thus, in the best interests of the City and its employees; and WHEREAS, the city Council of the City of Santa Ana considers Section 13923 of the Government Code relating to charitable payroll deductions for state officers and employees to be an appropriate and desirable precedent for application by the city of Santa Ana. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. The City Council hereby approves and provides subject to such regulations as this Council may prescribe that charitable payroll deductions from the salaries or wages of city of Santa Ana employees are available for charitable contributions to that Agency which conducts the principal combined fund drive in the City of Santa Ana, which Agency shall be determined by the City Council based upon the following criteria: The number of charitable agencies operating within the city of Santa Ana which rely on the drive for their support. RESOLUTION NO. October 7, 1991 Page 2. 91-095 The number of dollars raised in Santa Aha during the last completed fund drive. The percentage of dollars dispersed to agencies as a result of the fund drive. De The willingness of the combined fund drive to submit its application in the form prescribed by the Council, including an agreement to abide by applicable portions of Section 663, Title 2, Calif. Administrative Code, entitled "Payroll Deductions for Charitable Contributions." The use of the American Institute of Certified Public Accountants AICPA standards of accounting for financial reporting by the combined fund drive. 2. Resolution No, 79-172 is hereby repealed. 3. The City Council finds and determines that United Way of Orange County North/South and the Environmental Federation of California meet the established criteria and are hereby authorized to conduct charitable drives among city employees for payroll deductions.
