HomeMy WebLinkAbout92-012I29 REL: 2/4/92 RESOLUTION NO. 92-012 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DENYING VARIANCE APPLICATION NO. 91-005, W~ICH SOUGHT TO ALLOW ANOFF-PREMISE ADVERTISING SIGN TO BE MAINTAINED AT VARIANCE WITH THE OFF- PREMISE SIGN REGULATIONS AT 225 SOUTH GRAND AVENUE W~EREAS, this Council held a public hearing on February 3, 1992, on Variance Application No. 91-005, which sought to allow relief from the City's off-premise advertising sign regulations and nonconforming use regulations for property located at 225 South Grand Avenue. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Council finds and determines as follows: A. The strict application of the zoning regulations will not deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter; The existing building on the site may be maintained as a legal nonconforming use and provides the owner of the property with a viable economic use of that property. The subject sign is not necessary to the owner's economic use of the site. B. That the granting of a variance is not necessary for the preservation and enjoyment of one or more substantial property rights; The existing building on the site may be maintained as a legal nonconforming use and provides the owner of the property with a viable economic use of that property. That the granting of a variance will be injurious to surrounding property; The subject sign is one of five within a limited area. The granting of a variance for the subject sign would perpetuate off-premise advertising sign clutter within that area and sustain the unsightly appearance and RESOLUTION 92-012 Page Two blighting influenoe which is detrimental to the economic base and property values of the neighborhood and the community. D. That the granting of a variance will not adversely affect the General Plan of the city; The subject sign is contrary to the goals and objectives of the General Plan insofar as they seek to promote non- blighting economic development. 2.
