RESOLUTION NO. 92- 028
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA DENYING CONDITIONAL
U~E PEP~MIT APPLICATION NO. 91-011, WHICH
SOUGHT TO ALLOW A RECREATIONAL AND
ENTERTAINMENT USE OF PROPERTY LOCATED AT
2101 EAST EDINGER AVENUE
WHEREAS, this Council held a public hearing on March 16, 1992,
on Variance Application No. 91-011, which sought to allow a
recreational and entertainment use of property located at 2101 East
Edinger Avenue;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing this Council finds and determines as follows:
A. The proposed use will not provide any service or facility
which will contribute to the general well being of the
neighborhood or the community.
The existing restaurant/dance hall operation has shown
itself to be detrimental to the area in which it is
located by the high crime rate associated with it. There
is no good reason to think that its continued operation
will be significantly better in this regard.
B. The proposed use will, under the circumstances of the
particular case, be detrimental to the health, safety or
general welfare of persons residing or working in the
vicinity.
Because of the increasing criminal activity associated
with the subject business operation (a 93% increase
within the last calendar year), the use has been and will
continue to be a threat to the safety and welfare of
persons working in the area.
C. The proposed use will adversely affect the present
economic stability and future economic development of property
in the surrounding area.
The economic viability of the surrounding area has been
decreasing due directly to the increase in criminal
activity associated with the subject business operation.
Its continuation may drive successful businesses away
from the area.

D. The proposed use will not comply with the regulations and
conditions specified in Chapter 41 of the Municipal Code.
The subject business operation is short approximately 24%
of the parking spaces called for by the off-street
parking standards set forth in Chapter 41.
E. The proposed use will adversely affect the general plan
of the City.
The subject business operation does not promote the
general plan goals and objectives which are designed to
promote a safe and secure economic climate for business
in general.
