A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA AUTHORIZING A REWARD FOR INFORMA-
TION LEADING TO THE IDENTITY, APPREHENSION AND
CONVICTION OF ANY PERSON CAUSING GRAFFITI
WITHIN THE CITY OF SANTA ANA.
WHEREAS, Government Code Section 53069.5 and the City Charter
of the City of Santa Ana authorize the City to offer and pay a
reward, the amount thereof to be determined by the Council, for
information leading to the identity, apprehension and conviction of
any person who willfully damages or destroys any property.
WHEREAS, it is in the public interest and the benefit of the
City of Santa Ana that vandals who willfully damage property by
inscribing thereon graffiti shall be brought to justice.
WHEREAS, the inscribing of graffiti on structures and of
objects located on public or privately owned real property without
the consent or permission of the owner is a public nuisance and
obnoxious because such markings result in blight and deterioration
of the property with a resulting loss of property values and
business values in the community.
WHEREAS, the purpose of offering rewards is to encourage
people to give assistance to the Santa Ana Police Department so
that the police department may better protect the City's property
and the property of persons within the City by identifying,
apprehending and convicting persons responsible for inscribing
graffiti within the City of Santa Ana.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA AS FOLLOWS:
1. The City Council hereby authorizes a reward of Five
Hundred Dollars ($500.00) for information leading to the identity,
arrest and conviction of any person whose willful misconduct
results in the perpetration of, or aid in, causing graffiti to be
inscribed on any structure on publicly owned or privately owned
property within the City of Santa Ana. "Graffiti" shall have the
meaning as defined in Section 1410.5(1) of the California Evidence
Code which provides that graffiti consists of written words,
insignia, symbols, or other markings which are placed on structures
without the permission of the owner. "Conviction" shall mean the
conviction in a court of law of a person charged with the crime of
inscribing graffiti on a structure or in the case of a juvenile,
the judgment or finding of the Juvenile Court that the juvenile
inscribed graffiti on a structure within the City of Santa Ana.
The City Council hereby appropriates the sum of Two Thousand Five

Hundred Dollars ($2,500.00) to pay such rewards, and no rewards
pursuant to this ordinance shall be paid in excess of this amount.
A claim for the reward shall be made to the City not later than
sixty (60) days after the conviction of the perpetrator.
2. Any person who has willfully damaged property by
inscribing thereon graffiti as defined in this resolution, shall be
liable for the amount of any reward paid under this resolution
pursuant to the provisions of Section 53069.5 of the California
Government Code, and if he or she is an unemancipated minor, his or
her parent or guardian shall be liable for that amount.
3. The City Manager is hereby authorized and directed to
provide any court finding any person guilty of the act of vandalism
as defined in Section 594 of the California Penal Code for
inscribing graffiti within the City of Santa Ana with information
concerning the cost to the City of cleaning up the graffiti or the
cost to the private property owner of cleaning up the graffiti, and
to request the court to require the convicted person, or if such
person is an unemancipated minor, to require the parent or guardian
of such person, to reimburse the city and the private person for
the cost of clean-up and to require such person to physically
assist in cleaning up graffiti.
