On recommendation of the Manager, and on motion of Councilman Hubbard, seconded by
Schlueter and carried, the lowest and best bid of A. H. Famularo was accepted at
the unit prices and in the total amount of $24,326.64, and all other bids rejected.ii
Councilman Brewer stated the Council has been aware of the traffic situation at the
intersection of Edinger Avenue and Greenville Street, and since the removal of the
stop signs there has been an increase in vehicular traffic and school children.

signs which were removed six months ago at said intersection, be Immediately re-
placed, with proper street markings; and the Department of Public Works be instru~!
ed to make a finding as to the best location for a mechanical traffic control devi(
at either Edinger Avenue and Greenville Street or Edinger Avenue and Center Street
and present the Council with the information regarding the cost of installation an~
location at the next meeting. John C. Briley~ 2218 West Borchard, expressed appre-
ciation, on behalf of the residents in the area, for the Council's consideration of
the problem.
This being the date set for hearing on Amendment Application No. ~81, filed by L.
L. and Juanita Conkle, amending Sectional District Map 16-5-10, to reclassify fram
the A-1 District to the R-3 and C-1 Districts, property at the northeast corner of
Verano and Sugar Streets, all as shown on Exhibit A .A. ~81A; Planning Commission
recommended approval of Exhibit A.A. sS1c, rezoning all property to the R-4 Distri¢

C~mication was presented/Stanley ~ J, Jr.~ and Dorothy L. Hadsel~requesting
denial of Amendment Applicatio~ ~81, and rec~ending the adoption by the Council
of Special Study 19 so this area may remain a residential area, as it is becoming
one of the better areas in the City. Communication was presented fr~m Attorney
Robert S. Barnes, lO16 North Broadway, constituting an appeal from the action of
the Planning C¢~ssion in denying requests for reclassification of certain proper-'
ty. On motion of Councilman Hubbard, seconded by Schlueter and carried, the commu~
ications were received and filed. Douglas Clark, 1510 North Mar-Less Drive, state
he felt that Special Study 19, adopted by the Planning C~mission, was against the
construction of multiple apartment dwellings in the area in question; and quoted
sections of Resolution 55~7, adopted by the Planning C~m~ission April 2, 1962.
Delbert W. Michael, 917 South Toland Street, stated this was not a hardship case
as the property had been sold as R-l; and the residents had hopes of getting Speci~
St into action to insure the future of the area. Attorney Robert S. Barnes,
10i6 North Broadway~ presented a statement from Shell Oil Company confirming the
plans and intention to construct a special two-bay ranch style service station
(with pergola) on the subject location, if proper zoning is granted. On motion of
Councilm~u Hubbard, seconded by Schlueter and carried, the statement was received
and filed. Mr. Barnes stated a Variance would probably be filed if the request fo~
a zone change was denied. Arturo Mirano~ 630 South Corta Drive, stated he had pre.
sented affidavits at a previous meeting, and now he wished to restate that the res~
dents still desire the area to remain predominately residential. Hearing closed.
The Council having unanimously waived the reading of the Ordinance, on motion of
Councilman Hubbard, seconded by Schlueter and carried, the following Ordinance en-

C~nication was presented from Carl Arthofer, 218h Harbor Boulevard, requesting
reconsideration of Amendment Application No. B82, filed by Ralph J. Cover, amending
Sectional District Map 16-5-10, to reclassify from the R-2 and A-1 Districts to the
R-3 and C-1 Districts, property at the northeast corner of Sugar (McFadden) Avenue
and Newhope Street (a parcel approximately h37 feet on Sugar Avenue by 371 feet on
Newhope Street, which was denied by Council May 18, 1962. Carl Arthofer, 218~ Har-I
bor Boulevard, stated he owned a portion of the property in question and was re-
questing C-1 and R-B; also an individual is being denied the r~ht to conduct a
business, and this would be an ideal location for a small business, which would up-
grade the neighborhood. Mr. Arthofer further stated there were a number of people
in the audience who had not been notified of the hearing date and desired to be
heard at this time. William F. Wakeham, 2622 West Toy Place, stated small business.

development of the City. Lloyd Kinsley, 4209 West Flight Avenue, stated the plan-
ning Commission adopted an excellent plan for this area; the residents are in acco~
with it and feel it should be carried out. Joe L. Serna, 4~29 West Sugar Avenue,
stated this would be an ideal location for a shopping center, and almost all of the
tracts now reserve a portion of the laud for shopping centers. Ben Munoz, 4801
Sugar Avenue, stated there are expensive homes in the area, and favored businesses
at this location. N.W. Quick, 610 South Newhope Street, stated the majority ~of
the people opposed to commercial or R-4 zoning are newto the area, and the'10ng
time residents are aware of the increased revenue to the City from taxes:and favor
the commercial or R-4 zoning. Mrs. Douglas Clark, 15lO North Mar-Less Drive,
stated if 25 people are in favor and ~00 against, which ones are going to be heard.
Arturo Mirano, 630 South Corta Drive, stated a shopping center has Just been com-
pleted on Edinger Avenue and is nearby, and questioned the purpose of making a City
plan if it is net going to be adhered to. Delbert W. Michael, 917 South Toland
Street, stated o~e of the reasons presented in favor of the commercial zoning Was
difficulty, due to traffic, in reaching the shopping centers in other locations,
and he disagrees with this as he has no difficulty reaching the shopping center~.

the request for reconsideration on Amendment Application No. 382, filed by Ralph J.
Cover, was denied, and the previous decision of the Council, denying the Applicatio$,
was upheld.

the Department of Public Works was approved for payment to Paul Toberty, 1605
Spurgeon Street, in the amount of $1,963.35, for street improvements on Memory Lane
at Flower Street, in exchange for right-of-way dedication, reference Purchase
No. J-04870 and Minute Order dated November 6, 1961, of which several adjustments
in the actual quantities of work done have increased the cost to the City.
On motion of Counc~l,mu Hubbard, seconded by Schlueter and carried, the request of
the Department of Public WorksLwas approved, and the proper officials authorized
execute letter agreement dated May 28, 1962, with James M. MOntgcmery, Consulting
Engineers, Inc., for a Hardy Cross System Analysis of the City's water system, at
cost not to exceed $5,000.00.

the Department of Public Works was approved to increase the upper limit of Consult-
ing Engineering Service Fees for Bristol Street Pumping Station from $7,500.00 to

tion with a north-south alley and Bush Street, as the alley has not been used as
such for several years. On motion of Councilman Hubbard, seconded by Schlueter and

Garden Grove, on behalf of Paul Belrose, a cerebral palsy victim~ who desires to
peddle in the City during the balance of May and the month of June, requesting con?
sideration concerning the $5.00 per day license fee as it decreases his earnings
considerably. On motion of Council-~u Hubbard, seconded by Brewer and carried,

Comm~nications were presented from Mrs. C. D. Mitchell, 2517 West Pomona Street,

tion of a traffic signal at the intersection of Edinger Avenue and Greenville
Street. On motion of Councilman Hubbard, seconded by Brewer and carried, the com-~
munlcations were received and filed.
~The N~nager orally reported on October 16, 1961, the City Council received a re-
quest from the Off-Street Parking Co~.~-~ssion that the City undertake a study of
the feasibility and economics of a potential relocation of the parking area operat
ed and controlled by the C.~--.tssion, said present area to be sold to the Telephonei!
Company and to be replaced by the purchase of property on the south side of Fifth ii
Street between Bush and Spurgeon Streets. The Council then requested my office
undertake a survey of the matter and:to make a report. We found at the very be-
ginning of the study that merely making estimates of costs and investigations of
procedure would not be adequate, in that the complexities of multiple property
ownership and existing leases, on the relocation properties were such that it was
necessary to enter into direct negotiations with property owners and to take actions
in regard to the encumbering leases. During this period of study and negotiation ~,
the Council has authorized the filing of condemnation actions which, if prosecuted?
to completion, would accomplish the purchase of the relocation properties. I n°w
wish to report as follows: --]
(A). The property held in trust by the First Western Bank may be purchased
on an agreed upon satisfactory price but will require the filing of a condemnation~
action in order to assure that all parties concerned are adequately protected
against any possible conflicts of interest;
(B). The properties owned by a variety of ~wners.having
undivided partial interests, but primarily under a trusteeship located in San Fran~
cisco, can be pmrchas~lupon a fair and agreed upon price with but one complicatioa,

the necessity for supplying a substitute stock and materials unloading area
the basement of an adjacent store;
(C). The Lyons property on the corner of Fifth and Bush Streets will require
the filing of condemnation action, not only to clear up the question of any values
appertaining to an~ existing lease, but also to remove a multitude of clouds now
existing in the title information supplied by the Orange County Title C~pany.
I further wish to report that 'it is the opinion of the City Attorney and myself
that these property procurement procedures may be completed within a reasonable
period of time and that the Telephone Cure, any has been informed of these factors
and have indicated that the time for completion of the purchase of the properties,
and thereby making space available for the relocation of the parking lot~ are with-
in their time schedules for the use of the present parking lot area. A
of the cost of the relocation of this parking lot, including the cost of propertie~
court expenses, Title Company charges, negotiations expenses, payment of remaining
par/~ing district assessments, demolition of present buildings and complete prepara-
tion of the new area for use as a parking lot, can be accomplished at the total
cost of $215,000.00. The representative of the Telephone Company has made a firm
offer of $160,000.00 for the present parking lot, which is considerably in excess
of the value of the property as contained in an appraisal made for us by a lic,
appraiser. I rec~end to the Council that the City go forward with the necessary
hearings as required by the Off-Street Parking District Act for such a transaction
that the negotiations and/or condemnations of properties be continued to cc~ple-
tion~ that the legal steps be taken for the sale of the present parking lot, and
that the City negotiate an agreement with the Off-Street Parking District
sion for the loan of not more than $55,000.00 to the Co,r~ssi~n, frcm the City's
Parking Meter Fund, in order to make up the difference between the cost of the new
lot and the price offered by the Telephone C~m~any for the present lot. I further
rec~end that such a loan should permit the Off-Street Parking C~....t ssion to re-
tain $6,000.00 from the annual amount earned from the lot, these moneys to be used
for distribution to the assessed properties within the district, and that any
moneys in excess thereto each year shall be paid to the City of Santa Aha as
payment of the loan, and that as soon as the total assessed charges to properties
in the District shall be repaid from such earnings, all further earnings shall be
paid to the City of Santa Aha until the entire loan amount of not more than
$55,000.00 shall be completely repaid. On motion of Cot~lc~lmau Hubbard, seconded
by Schlueter and carried, the Manager was authorized and directed, in accordance
with his recommendation, to arrange the necessary hearings and arrange for the
necessary escrows to carry out the sale of the parcel of property to the Telephone
Company, and the condemnation of the property required to replace it for the Park-
lng District. It is the declared intent of the City Council to negotiate a loan
of $55,000.O0, from the Parking Meter Fund, to the Parking District for the purpose
of acquiring the new property and placing it in operation.

M_rs. E. R. Hanson, 730 South Broadway, stated the problem still exists, concerning
the three Siamese cats retained at the rear of the pr~mtses at 726 South Broadway,
as the owners of the cats have not complied with the suggestions of the Police Depa~
ment in cleaning the facilities and cage, or with keeping the cats within the house
from 7:00 P.M. to 7:00 A.M., and questioned whether the Council had the authority
to order the owners to do so. Mayor Hall stated it was not within the authority of
the Council at the present time, as the City does not have an Ordinance regulating
