HomeMy WebLinkAbout93-026 - Conveyance of Real Property Located on the East Side of Ross StreetRESOLUTION NO. 93- 026 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA MAKING CERTAIN FIND- INGS WITH RESPECT TO THE CONVEYANCE OF REAL PROPERTY LOCATED ON THE EAST SIDE OF ROSS STREET BETWEEN FOURTH AND FIFTH STREETS BY THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA TO THE UNITED STATES OF AMERICA AND APPROVING THE TERMS AND CONDITIONS OF SAID CONVEY- ANCE WHEREAS, the Community Redevelopment Agency of the City of Santa Ana is engaged in activities necessary to execute and implement the Redevelopment Plan for the Santa Ana Redevelopment Project; and WHEREAS, in order to implement the Redevelopment Plan, the Agency has agreed, subject to the approval of this Council, to convey certain real property in the Project Area, located generally on the east side of Ross Street between Fourth and Fifth Streets in the city of Santa Ana, pursuant to the terms and provisions of that certain agreement between the Agency and the United States of America (the "Agreement"), which is on file in the office of the Executive Director of the Agency, in which said real property (hereinafter referred to as the "Site") is more specifically described; and WHEREAS, the Agency has prepared, and the City Council has reviewed and considered a Summary Report setting forth the cost of the Agreement to the Agency, the estimated value of the interests to be conveyed, and other matters, and has made said Summary Report available for public inspection in accordance with the California Community Redevelopment Law; and WHEREAS, pursuant to sections 21090 and 21166 of the Public Resources Code, no subsequent or supplemental environmental impa~t report is required for the approval of the Disposition Agreement; and WHEREAS, pursuant to the provisions of the California Redevelopment Law, the Agency and the city Council have held a duly noticed joint public hearing on the proposed sale of the Site and the proposed Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, AS FOLLOWS: 1. The City Council hereby finds and determines as follows: 1200 RESO O XON S -O S PAGE 2 The federal court building to be constructed on the Site will be of benefit to the project area. No other reasonable means of financing the federal courthouse building are available to the City of Santa Ana. The consideration for the conveyance of the Site pursuant to the Disposition Agreement is less than the fair market value of the Site determined at the highest use permitted under the Redevelopment Plan, but such lesser consider- ation is necessary to effectuate the purposes of the Redevelopment Plan. 2. The conveyance of the Site by the Agency to the United State~ of America upon the terms and conditions contained in the Disposition Agreement is hereby approved. 3. The City shall not apply any section or part thereof of the Amended Redevelopment Plan for the city of Santa Ana Redevelop- ment Project adopted by Ordinance No. NS-l173 on July 2, 1973 and amended by Ordinance No. NS-1258 on June 2, 1975, and on file with the Clerk of the Council of the City of Santa Ana, to the Site so long as the Site is owned by the United States. 4. The City will not attempt to assess the Site or include the Site in any municipal improvement, utility or maintenance district(s) so long as the Site is owned by the United States.
