Present Councilmen Royal E. Hubbard, Dale H. Heinly, Bob Brewer, A. A. Hall Absent Councilmen Report City Attorney Boundary C~mis- sion findings "Newport and Dyer S. E. Annex" Henry H. Schlueter The Attorney orally reported he and the Director of Public Works attended the Boundary Cus~Ission meeting held at ll:04 A. M., this date, and the Boundary Commis- sion found the boundaries of the proposed annexation of territory to the City, des~i ignated "Newport and Dyer S.E. Annex~' were not definite andcertain, due to the omission of a phrase in the legal description. ~ir. Foreman orally reported the portion cmitted was the book and page number reference the recording of the deed for the right-of-way the State acquired for the San Diego Freeway. It was moved by Councilman Heinly, seconded by Hubbard and carried, that the oral reports of the Attorney and the Director of Public Works be accepted, and a copy of the boundary description be corrected to show the course emitted and resubmitted to the Boundary Cu~aission for their determination. Councilman Heinly stated the phrase left out was not part of the legal description, but merely a reference to the recording of C~-w, unication Glenn E. Mathis, et al, exclusion of property "Newport and Dyer S.E. Annex" the instrument. The Clerk presented and read a co,,,~nication signed by Glenn E. and Charlotte M. Mathis, and First Western Bank and Trust Company, Trustee under its Trust No. lO0- B/Mathis, consenting to the exclusion of the site of the residence dwelling, owned and occupied by thom, from the reminder of the property, owned by thom, in fixing the boundaries of the territory proposed to be annexed to the City; and stating that the boundary lines drawn to exclude the site of their residence dwelling and to include the remainder of the property owned by them, even though said dwelling site is contiguous and adjacent to the remainder of their property, was drawn at their consent. On motion of Councilman Heinly, seconded by Brewer and carried, the Pet it ion Ross W. Cortese, et al, request annexation "Newport and Dyer S.E. Annex" Protest The Irvine Co. "Newport and Dyer S. E. Fuglie as Assistant Secretary of Rossmoor Leisure World, requesting annexation of territory to the City of Santa Ana designated "Newport and Dyer S. E. Annex." On motion of Councilman Hubbard, seconded by Heinly and carried~ the petition was received and filed. A communication was presented and read by the Clerk, signed by Charles S. Thomas, President, The Irvine Cd, party, advising The Irvine Company is unalterably opposed to the proposed "Newport and Dyer S. E. On motion of Councilman Brewer, seconded by Heinly and carried, the communication was received and filed. A c~m~unication was presented and read by the Clerk, signed by L. E. Cox, Business and Finance Officer, The University of California~ requesting that no part of the University Co~ma~nity be included in the proposed "Newport and Dyer S. E. Annex," or any annexation in the future. On motion of Councilman Heinly, seconded by Hubbard and carried, the communication was received and filed. The Council having unanimously waived the reading of the Resolution, on motion of Counci~m~n Heinly, seconded by Hubbard and carried, the following Resolution en- titled: "Resolution No. 62-110 initiating proceedings for the annexation of territory to the City of Santa Ana designated an appropriate name for said territory of 'Newport and Dyer S. E. Annex' and giving notice of protest hearing thereon" setting the hearing date on July 23, 1962, was considered and passed by the follow- lng vote: Ayes, Councilmen Royal E. Hubbard, Dale H. Schlueter Councilman Heinly stated the Council members were cognizant of Resolution No. 60-77 adopted April 18, 1960, and the proposed annexation is cutting across Just a tip of The University of California property as a straight line is being follow~d, and it would be better to follow section lines and take a portion of that particular piece of property. Time and circumstances have a tendency to change things, and this Cit has not com~lained about other cities annexing close to or around the University Campus. Councilman Heinly further stated we have our choice of acquiring this annexation and technically violating our Resolution of Intent, but the spirit Santa Aha and substance of the Resolution is being complied with. Mayor Hall stated/histori- cally has not been one ~oaggressively expand its territory, and Santa Ana is follow ing the same principle as outlined in the past. On motion of Councilman Hubbard, seconded by Heinly and carried, the request of Wallace Utterback, Bud's Trading Post~ was granted to hold an auction June 16, 196; at 3026 West Fifth Street, of miscellaneous items and fixtures, for the liquidation of the business. Auction to be conducted by Vernon "Gus" Anglin. On motion of Councilman Hubbard, seconded by Heinly and carried, the City Council adjourned to 7:30 P.M., Tuesday, June 12, 1962.
