HomeMy WebLinkAbout93-065 - Approving Variance No. 92-008· 07 1 RESOLUTION NO. 93- 065 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 92-008, TO ALLOW A REDUCTION IN MINIMUM LOT SIZE AND A REDUCTION IN LANDSCAPED PLANTER SIZE FOR A PROPOSED COMMERCIAL BUILDING LOCATED AT 2629 WEST WESTMIN- STER AVENUE WHEREAS, this Council held a public hearing on July 6, 1993, on Variance Application No. 92-008, to allow a reduction in minimum lot size and a reduction in landscaped planter size for a proposed commercial building located at 2629 West Westminster Avenue; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Council finds and determines as follows: A. Because of special circumstances applicable to the subject property, the strict application of the minimum lot size and minimum planter size requirements in the zoning regulations would deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter; As the site is surrounded by residential and commercial uses, it is unlikely that additional land can be acquired to obtain compliance with minimum lot size standards. The small size of the lot makes compliance with planter size standards infeasible. However, side yard setback standards can be maintained by a modest reduction in building size. B. That the granting of a variance is necessary for the preservation and enjoyment of one or more substantial property rights; The granting of the variance as to minimum lot size and planter size is necessary to allow development of the site. C. That the granting of a variance will not be materially detrimental to the public welfare or injurious to surrounding property; The granting of the variance will allow a beneficial use of the property, will promote the removal of a dilapidat- ed structure now on the property, and will provide for RESOLUTION 93-065 Page 2 073 additional landscaping on the property that will be an aesthetic benefit to the neighborhood. D. That the granting of a variance will not adversely affect the General Plan of the city; The General Plan designation for this area is General Business District (GBD), which allows for the development of commercial and retail uses. 2. Subject to the conditions set forth below, Variance No. 92-0008 is hereby approved as to minimum lot size and minimum planter requirements. It is disapproved as to a waiver of building setback requirements. 3. The approval of Variance No. 92-008 is subject to the conditions set forth in Exhibit A, attached hereto and incorporated herein by reference, and to the following additional conditions: There shall be a 20-foot landscaped building setback on Sydney Street and the walkway shall not encroach into this required landscaped setback area. The wall on the east side of the property shall be replaced with a wrought-iron fence with masonry pillars. ADOPTED this 19th day of July , 1993. Variance NO. 92-8 May 17, 1993 Page 1 of 2 Condi%ions for Approval Should Variance No. 92-8 be approved, the project must comply with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. In addition, it shall meet the following: A. Planninq 1. A bicycle parking area shall be provided for the project. Building and parking lot lighting shall be decorative in nature and match the building design. The project shall comply with all conditions of Site Plan Review Number DP 91-60. Public Works Aqency Prior to Site Plan approval, complete the following: Revise the site Plan to depict the two driveways to be per City Standard #1112, Case 2. 2o Revise the Site Plan to depict and to dimension an existing 25 feet radius property line spandrel at the Northeast corner of Westminster Avenue and Sydney Street. Revise the Site Plan to depict the relocation of the existing power pole and guy down, adjacent to the proposed Sydney Street driveway, a minimum of 10 feet from new driveway "Top of X". Revise the Site Plan to depict the closure of all existing driveways with curb and full width sidewalk. Prior to Release of Utilities, complete the following on Westminster Avenue: 1. Close existing driveway with curb and full width sidewalk. Construct new driveway per City Standard #1112, Case 2 (W= 28 feet, A= 36 feet, X= 4 feet). 3. Construct new driveway per City Standard ~1112, Case 2. Remove existing asphalt pavement in the parkway, and construct new full width sidewalk. Relocate existing power pole and guy down a minimum of 10 feet from new driveway "Top of X". Remove existing curb, and construct new curb and gutter per approved improvement plan. Remove existing pavement, and construct new pavement from street centerline to new edge of gutter per approved improvement plan. Construct one street tree well and plant one street tree per City Standard #1124 as may be required by the Senior Maintenance Supervisor. Furnish ornamental street lighting with underground service as directed by the City Engineer. Install "No Stopping Anytime" zone.
