Hubbard, Henry H. Schlueter, Bob Brewer, A. Allen Hall Absent: Councilmen: Dale H. Heinly The Pledge of Allegiance was given. Invocation was given by Rev. james Turner, Camile Christian Church. Each member of the Council having received copies of the Minutes of August 20, 1962, reading of the Minutes was dispensed with. The Clerk reported that this was the time and place fixed for the hearing of protests or objections against the work or the District, as described in Resolution of Intention No. 52-156, in the matter of the construction of certain sewer lines together with appurtenances and appurtenant work within the City of Santa Ana for the use and benefit of the City of Santa Ana Assessment District No. 218 in said City, as described in said Resolution of Intention No. 62-156. The Clerk also reported that affidavits in support of the publication of the Resolution of Intention, the mailing of printed notices of the adoption of said Resolution, and the posting of the Notice of Improvement, as required by law, had been made and are on file in the office of the Clerk of the Council!. The Mayor then inquired of the Clerk if any written protests or objections against the work or the District had been filed with her in said matter. The Clerk reported that no written protests had been filed with her prior to the time set for the hearing. The Mayor then announced that the City Council would also hear any persons present who desired to be heard orally and who had any protests or objections against the work or assessment as set forth in the Resolution of Intention hereinabove mentioned. There were none present at the meeting who protested or objected orally. No protests being Hearing Reso. No. 62-122 "Newport & Dyer, S. E. Annex" received, the hearing was closed. On motion of Councilman Hubbard, seconded by publication, Brewer and carried, the Affidavits of/posting and mailing were received and filed. It was moved by Councilman Hubbard, seconded by gchlueter and carried, that all protests be over-~led and the hearing closed. Heinly This being the date set for continued hearing on annexation of territory designated "Newport and Dyer, S.E. Annex," the Mayor asked if there were any persons present desiring to speak in favor of the annexation. A "Report of the Annexation Ccmmaittee" recommending the annexation was read by William B. Kohl, Assistant Manager of the Santa Ana Chamber of Commerce~ which was signed by Paul White, Chairman, and ten members. Statements in favor of the annexation were also made by the following: J. Ogden Markel, 1814 So. Parton; Lewis Letson, Golden Range Foundation, Rossmore; Joe Lozano, 4609 W. Oakfield, Union Representative speaking for the Orange County Educational Cc~mittee; Douglas Clark, 1510 N. Mar-Les Drive; Delbert Michael, 917 S. Toland Avenue, who submitted a list of names of interested persons as follows: Howard Croswhite, 4410 W. Regent Drive; Anthony Alvarez, 4210 W. Kent; Frank Reg~ni, 916 S. Toland; A1 Vigil, 912 S. Mayor Hall read a telegram addressed to the City Manager from Joe A. O'Campo, congratulating him on his stand favoring the annexation, and one to the Councilmen from Rudy E. Gallegos, giving his wholehearted support to the annexation. Also presented were letters of approval from the following: Marie Edmonds, 4213 W. Flight; Lola V. Kinsley, 4209 W. Flight; Lloyd E. Kinsley, 4209 W. Flight; Fortunato F. Gonzales, Jr.~ Howard D. Croswhite and Joanna Croswhite, 4410 W. Regent Drive; Anthony Alvarez, 4310 W. Kent Street; Adam Hopp, Sr., 4218 W. Flight; Delbert W. It was moved by Councilman Brewer, seconded by Hubbard and carried, that the co~m~uications be received and filed. The Mayor asked if there were any persons desiring to speak in protest of the annexa- tion, and the following persons were heard: William French Smith, 634 So. Thomas, President of The Irvine Cempany, with exhiblts~ Affidavit by Raymond L. Curran relative to moving people off the land; statement of ' William L. Pereira and Associates dated July 20, 1962 in opposition to the aunexation~ Affidavit of William H. Spurgeon, Vice President of Irvine Cempany, dated July 23, 1962; and statement in opposition to annexation by Raymond L. Watson, A.I.A., M~nager of Planning, The Irvine Company. It was moved by Councilman Brewer, seconded by Hubbard and carried, that the documents be received and filed. It was moved by Councilman Hubbard~ seconded by Brewer and carried~ that the official protests be received and filed as a matter of permanent record. Mrs. Janice Boer, 912 N. Lowell, made a statement regarding her opposition to the annexation. On motion of Councilman Brewer, seconded by Hubbard and carried, the hearing was continued for further consider- ation to · 0 7.3 P.M. September 10, 1962, in the Council Chambers. Hearing This being the date set for hearing on ~mendment Application No. 400 filed by State Amend. Appl. No. 400 State Farm Mutual Farm Mutual Automobile Insurance Co., requesting an amendment of Sectional District Map Automobile Ins. Co. d ~ ~ ~ 2-5-10, reclassifying property situated at the northwest corner of West Seventeenth Street and College Avenue, from the R-1 District to the P District, all as shown on Exhibit A.A. 400A. Nelson Kogler, 2315 Santiago, Attorney, spoke on behalf of the insurance cc~panyo No protests were received and the hearing closed. On motion of CounciLman Hubbard, seconded by Brewer and carried, the Amendment Application 400B was adopted and passed to second reading without further reading. Appeal Appl. No. 67 Letter from Bruce W. Sumner, Attorney for L. L. and Juanita Conkle, requesting that the VA-1657 L.L. & Juanita Conkle Appeal Application be continued to October 15, 1962. The City Manager rec~mnended that (cor. Sugar & Verano) 0 ~ ;3 the matter be deferred until November 5, 1962. It was moved by Hubbard, seconded by Brewer and carried, that the Appeal Application be continued to November 5, 1962, and the people be notified of the hearing date. Hearing This being the date set for hearing on Amendment Application No. 402 filed by Thomas T. Amend. Appl. No. 402 Thos. T. Russell Russell, 8111 Stanford Avenue, Garden Grove, requesting an amendment of Sectional Dis- 4120 W. Fifth ~ trict Map 9-5-10, reclassifying property situated at 4120 West Fifth Street, which is appraximately 132 feet by 677 feet, from the A-1 District to the M-1 District, all as shown on Exhibit A .A. 402A. Mr. Russell stated that since neighbors were not in favor of such a change, but did not object to a C-zone, he wished to revise his plans. He was told that the Planning Department will assist him. The hearing was closed, and on motion of CounciLman Hubbard, seconded by Schlueter and carried, the Amendment Applica- tion was denied. Arthur Guy, Attorney, 900 N. Broadway, spoke on behalf of Pabst Brewing C~mpany. On motion of Councilman Hubbard, seconded by Brewer and carried, the Amendment Application No. 403A was passed to second reading without further reading. Appeal Appl. No 68 Appeal Application No. 6~ was presented on Variance Application No. 1665 filed by Lola VA-1665 Lola L. Raupe (Plummet L. Raupe (Plum~er), llR9 So. Flower, to convert existing hobby rooms into living quar- 1129 So Flower d~/~ ters. Letters of approval were presented by the Clerk from Mrs. Mamie Tunstall, owner of property at 1124 So. Flower and Mrs. Linnie L. Cruzen, lll9 So. Flower. Also, a protest letter from Mr. and Mrs. R. R. Harris, 1133 So. FLower. Don Anderson, lll8 So. Garnsey, spo~e against granting ox the Variance. The Mayor read a petition signed by 34 persons living in the area, who protested granting of the Variance. On motion of Councilman Hubbard, seconded by Schlueter and carried, the communications were received and filed. Webb Brown, 1701 N. Flower~ Agent acting for Mrs. Plu~mner, stated that there are a number of rental units in this area. He requested that the names on the petition be checked against the registered owners. On motion of Councilman Hubbard, seconded by Brewer and carried, the Appeal Application was denied. Appeal Appl. No. 69 Appeal Application No. 69 was presented for Conditional Use Permit No. ll4 filed by CUP No. ll4 Beatrice Han~n and Beatrice Hamm and James Vanderford, 2032 So. Cypress, to expand the existing six guest James Vander ford P.~! ~ rest home to a capacity of 15 guests in the R-2 District. Mr. Vanderford stated that he wished to request a revision to a 12 guest h~ne, using the plans submitted. It was moved by Councilman Bmewer, seconded by Hubbard and carried, that the Appeal Applica- tion be continued to September 17 and the Planning Department have an opportunity to Request-Traffic Report Santa Clara & Bristol Roger E. Harvey review the plans. Roger E. Harvey, 2214 N. Forest, spoke regarding the need for a traffic guard at the he stated corner of Santa Clara and Bristol, which/has become a dangerous intersection for school children. Interested members of the audience had been requested to stand and there was a showing of about thirty. There followed considerable discussion as to the warrants for use of crossing guards or school patrols~ and their significance and comparative weight. It was agreed that Warrant No. 2 needed clarification. Mr. Harvey also stated that the Principal of Santiago Elementary School will not consider a school patrol. CounciLman Brewer made a motion that the adult traffic guard be reinstalled until the school boy patrol is in effect, ~r if not~ that the adult traffic guard remain. The motion died from lack of a second. Webb Brown, 1701 No. Flower~ property owner~ stated that his tenants refuse to park along this street, it has become so hazardous, and he gave illustrations of recent accidents at this corner. Proposed Annexation Harbor & Edinger East Preliminary Records of Survey - 275-276-277-278 Final Map No 4749 It was moved by Councilman Schlueter, seconded by Brewer and carried, that a traffic officer be installed at the intersection for two weeks while a study and survey is made, with recommendations being presented to the Council on September 17. The City Manager requested specific instructions, and the following information is to be obtained: (1) Count of traffic at this and similar crossings. (2) Speed of traf- fic. (3) Number of students using crossing. On motion of Councilman Hubbard, seconded by Schlueter and carried, letter frmn the Planning Con~nission recom~ending approval of proposed annexation to be known as the "Harbor and Edinger East Annexation" was received and filed. It was moved by Council- man Hubbard~ seconded by Schlueter and carried, that a Resolution be adopted indicat- ing intention to annex property designated as "Harbor and Edinger East Annexation." On motion of Councilman Hubbard, seconded by Brewer and carried~ the following tract maps were approved subject to conditions: Preliminary Record of Survey No. 275 filed by Alpha Beta Markets, Inc., creating ~parcels located generally at the northwest corner of Sullivan and McFadden. Preliminary Record of Survey No. 276 filed by C. Michael creating 2 parcels located at the northeast corner of Fairview and Warner. Preliminary Record of Survey No. 277 filed by Neal Minter creating 3 parcels located at the northwest corner of Memory Lane and Bristol Street. Agreement No. 1355 Construct Traffic Signal Broadway-N. Park Blvd & Santa Clara Avenue Escrow Instructions Preliminary Record of Survey No. 278 filed by Vina Harmer Marsh creating 4 par- cels located southeast of Silver Drive and Gates Street. and that Final Map of Tract No. 4749 filed by Irving C. On motion of Councilmen Hubbard, seconded by Brewer and carried, requested approval of City-State partiCil~a~' Agreement No. 1355 for construction of traffic signal system at intersection of Broadway with North Park Boulevard-Santa Clara Avenue~ was approved. It was moved by Councilman Hubbard~ seconded by Schlueter and carried, that escrow instructions be approved and signed for certain properties and with the following persons: No. ~7943-C, dated June 11, 1962 with Newton N. Minow, Chairman, Federal Communi- cations Commission, for United States of America, for an easement for street purposes. No. ~8069-C, dated July 16, 1962 with Joe M. and Llla N. Rodriguez for an ease~-~b for street purposes. No. 48226-C, dated August 16, 1962 with Viola Griset, Ida H. Ashley, and Roy F. Grlset for property described in Escrow Instructions, in the amount of $47,675.00. Reso. Annex was cc~tinued to September 17, 1962. Councilman Hubbard announced that while it did not appear on the Agenda, the Ordinance that was given first reading on July 23rd could now be considered. The Clerk read the Ordinance entitled: "Ordinance No. NS-601 Declaring the Annexation of Territory Designated '~Newport and Dyer, S. E. Heinly advising that as of September 4, 1962 his residence officially changed from 1118 Hickory Street (Ward 2) to 2014 N. Louise Street, which disqualifies him from serving any longer on the City Council, per the City Charter. Councilman Heinly expressed his appreciation for having worked with one of the best City Councils in the State of California, stating also that personalities had not interfered with decisions affecting the welfare of the citizens of the corm~unity. On motioa of Councilman Hubbard, seconded by Schlueter and carried, bonds were released filed by San Gabriel Construction Company for Tract No. 3669, Fifth Street and Rosita~ and Tract No. 3711, Mcfadden Avenue and ~iamond Street~ filed by Brentwood Downs, Incorporated. On motion of Councilman Hubbard, seconded by Schlueter and carried, request to solicit funds by Western Missionary Army~ Inc., E. D. Harris, President, was denied. This being the date set for hearing on the 1962-63 Budget, the Mayor asked if there were any protests. Mrs. Janice Boer, 912 N. Lowell, stated that the budget was too high. The hearing was closed~ and on motion of Councilman Hubbard, seconded by Schlueter and carried, the budget was approved subject to corrections recommended by the Council. It was moved by CounciLman Hubbard, seconded by Schlueter and carried, that the budget be declared an emergency appropriation and the Ordinance entitled: "Ordinance No. NS-602. An Ordinance Adopting the Annual Budget for the Fiscal Year Commencing July l, 1962 and Fixing the Limitations of Expenditures for the Several Funds and the Functions, Departments and Activities Carried Under Such Funds?' was considered and passed as an emergency Ordinance by the following vote: Ayes, Councilmen: Royal E. Hubbard, Bob Brewer, Henry H. Schlueter, A. A. Hall Noes, Counciimen: None Absent, Councilmen: Dale H. Heinly It was moved by Connciiman Hubbard, seconded by Brewer and carried, that sanitary sewer mains, laterals, manholes and appurtenant facilities be constructed in Assessment Distric 219 consisting of portions of Hazard, Seventh, Sixth, and Fifth Streets between Euclid (Verano) Street and Rosita Street; in portions of Eaclid (Verano) Street between Bolsa Avenue and Hazard Avenue; and in portions of Rosita Street between Fifth Street and Hazard Street under the provisions of Section 5lO1 of the Improvement Act of 1911~ and that Public Works be authorized to proceed with plans and specifications. It was moved by Councilman Hubbard~ seconded by Schlueter and carried, that the City Manager be instructed to proceed with the City of Costa Mesa to establish a traffic signal at the intersection of Harbor Boulevard and Talbert Avenue~ and authorizing the proper authorities to execute an agreement to that effect. the following items On motion of CounciLman Hubbard, seconded by Schlueter and carried, were granted: Request for permission to advertise for bids to furnish Estimated Asphaltic Concrete requirements, Paving Machine Spread as Item i and Truck Spread as Item 2 for Fiscal 1962-63, in accordance with Specification 488-12. Bids to be opened Sept. 17, 1962. Request for permission to advertise for bids to furnish magazines for 1963 for the Santa Ana Public Library. Estimated list price, $3,341.00. Bids to be opened September 17, 1962. Request for permission to dispose of two bicycles which are surplus to the Finance Department. Traffic Control Devices Installed or Removed Extra Work Project S-32; Construction of a sanitary sewer in Wright Street, Santa Clara Avenue and Grand Avenue, correcting amount from $806.88 to $906.88. On motion of Councilman Hubbard, seconded by Schlueter and carriedj reports on traffic devices installed or removed by departmental traffic order during the period August 6, 1962 through August 16, 1962, and August 16 through August 30, 1962, were received Appointment to Board of Parking Places and filed. On motion of Councilman Hubbard, seconded by Schlueter and carried, the appointment of one member to the Board of Parking Place Commissioners to fill vacancy, was post- Authorization of Payment Proposed Stadium Robert Hernandez Clearance of Signs from Street Right of Way Appointment to Council James Gilmore poned to the next meeting. On motion of Councilman Hubbard, seconded by Schlueter and carried, payment to Architect Robert Hernandez as set forth in the contract with him, was authorized. On motion of Councilman Hubbard, seconded by Brewer and carried, recommendation to clear signs, etc., from street right of way on business streets was continued to September 17, 1962. On motion of Councilman Hubbard, seconded by Schlueter and carried, James Gilmore was appointed as Councilman for Ward 2 to fill the vacancy left by Councilman Dale H.
