HomeMy WebLinkAbout94-060 - Approving Conditional Use Permit No. 94-02RESOLUTION NO. 94-060 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 94-02 AND VARIANCE NO. 94-1, TO ALLOW A CAR WASH AT 930 NORTH GRAND AVENUE WHEREAS, this Council held a public hearing on September 19, 1994, on Conditional Use Permit Application No. 94-2, to allow a car wash at 930 North Grand Avenue, and Variance Application No. 94-1, to allow said car wash to be developed with the following variations from zoning code standards: ae A reduction in minimum lot size from 15,000 square feet to 13,285 square feet. be A reduction in minimum landscaped setbacks from 15 feet to 5 feet along Grand Avenue and to between 5 and 15 feet along Stafford Street. A reduction in the distance required between the Stafford Street driveway and the corner radius and Stafford and Grand. Use of the landscape planter along the west property line as a two-foot vehicle overhang for parked vehicles. Se Reduction in the size of the vehicle drying area from the 20 parking place standard to an area that will accommo- date approximately five vehicles. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Council finds and determines as set forth in Exhibit A, attached hereto and incorporated herein, with regard to Condi- tional Use Permit application No. 94-2. 2. Based upon the evidence submitted at the abovesaid hearing, this Council finds and determines as set forth in Exhibit B, attached hereto and incorporated herein, with regard to Variance application No. 94-1. 3. Conditional Use Permit No. 94-2 and Variance No. 94-1 are hereby approved subject to the conditions set forth in Exhibit C, attached hereto and incorporated herein, subject to the following changes: R SOLUT ON 94-060 2?3 Page 2 Fire Department condition B.2. is waived subject to the applicant's submittal of a letter requesting waiver to the Fire chief. Planning Division condition C.3. is amended to read as follows: The two detail bays shall be allowed to have broom arches directly overhead each bay for waxes/water with a mode applicator mounted in the wall. The detail bays shall not at any time be converted to a coin-operated or self-service car wash. The hours of operation of the detail bays shall not extend beyond 8:30 p.m. Planning Division condition C.4. is subject to possible deletion or modification by the Planning Commission after a hearing on the issue of signage, or by the City Council on appeal from the decision of the Planning Commission on that issue. This project will revitalize an old property and when completed will continue to provide a service to the motoring public by providing a facility where their cars can be washed and detailed. The rehabilitation of this site will contribute to the general well being of the neighborhood and the community. Will the proposed use, under the circumstances of the particular casa, be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity? There is already a full service car wash and auto detailing taking place at this location. This projec= will legalize the auto detailing by locating this use within a struc=ure enclosed on three sides and will also relocate the vacuuming operation for the car wash - which is currently au=side of an enclosed building - inside the existing car wash structure. These changes should reduce any noise impacts to adjacent residential property. Since the car wash ham resided at this location without any known complaints from the community, this uae ia not anticipated to be detrimental to the health, safety or general welfare of persons residing or working in the area. Will the proposed use adversely affect the present economic stability or futura economic development of property in =he surrounding area? This projec= will take a deteriorating property and help revitalize its operation. Site appearance will be enhanced at the completion of this project. Therefore, this project should contribute to the economic stability or future economic development of the surrounding area. Will the proposed uae comply with the regulations and condi%lons specified in this chapter for such a use? The proposed car wash will comply with all regulations and conditions specified in the Santa Aha Municipal Code pertaining to car wash establishments. Will the proposed use adversely affect the General Plan of the city or any specific plan applicable to the area of the proposed use? The addition of two de=ail bays =o an existing car wash will not have an adverse affect on the General Plan land uae designation of General Business District (GBD). The two detail bays are incidental to the car wash use which is permitted in the General Business District designation. EXHIBIT A Variance No. 94-1 AuqusC 15, 1994 Page 1 of 1 That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive =he subject props=fy Qf privileges not otherwise at variance with the intent and purpose of the provisions of this chapter. This project rehabilitates a site with an existing car wash and when completed will substantially upgrade, landscaping, signage and overall site appearance. Due to the existing building location and existing site cons=taints, this project requires variances from City landscaping setback and parking codes. The majority of the variances required for this project ere for existing conditions and not due to the construction of the two detail bays on this site. Although this site does not meet all aspects of the City's landscape code, tree and plant s~zes have been upgraded and additional landscaping has been provided in the parking and waiting areas to help compensate for chose areas where this project is deficient from City landscape codes. That =he granting of a variance is necessary for =he preservation and en~o~ment of one or more substantial property rights. The granting of the variances will allow the property owner a reasonable addition =o his business while improving the overall appearance and function of the site. That the granting of a variance will not be materially detrimental to the public welfare or injurious to surrounding property. The project will bm a benefit to surrounding property owners by substantially upgrading building elevations, landscaping and overall site appearance. The project will also benefit the community by providing a service where members of =he community can take their vehicles to be cleaned and de=ailed. Z77 EXHIBIT RESOLUT O 94-060 Page 5 2 7 Variance No. 94-1 and Conditional Use Permit No. 94-2 August 15, 1994 Page 1 of 3 conditions for A~oroval Should Variance No. 94-1 and Conditional Use Permit 94-2 be approved, the project shall comply with all requirements and applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire code, the Uniform Building Code and other applicable regulations, In addition, the project shall comply with the following conditions: A. ~uildina Safety Division The project owner/developer shall designate a contact person who has the authority to act on behalf of the owner to coordinate and provide consistency for all of the plans required for the project including landscaping, grading, pedestrian protection, architecture, structural, electrical, mechanical and plumbing. Note on the drawings the contact person's name, position, business address, telephone and development processing numbers. Fire Deoartment Prior to the issuance of any building permit for this project, the remediation equipment shall be installed and in use (operational). Prior to issuance of a building permit, the owner shall commit to providing either an on-site fire hydrant and fire lane or sprinklers for the existing and new buildings on this site. The remediation plume shall be defined and the definition approved by the Fire Department prior to Building Department Plan check. The building permit will not be finialed if remediation is discontinued during the construction of the new building. C. Planninq Division Street sweepers or other commercial vehicles shall not be parked or stored on this site. No automobile repair or any other type of mechanical servicing of vehicles is permitted on this site. The proposed auto detail bays shall not be used to wash vehicles. All vehicles shall be washed, if necessary, within the exiet£ng fully enclosed car wash building adjacent to Grand Avenue. The detail bayB shall not at any time be converted to a coin operated car wash, self service car wash or any other type of car wash without an amendment to the Conditional Use Permit. EXHIBIT C · RESOLUTION 94-060 281 Page 6 Variance No. 94-1 and Conditional Use Permit No. 94-2 August 15, 1994 Page 2 of 3 40 The existing pole sign shall be removed and all signega on the existing building and the site shall be brought into conformance with current sign codes prior to the issuance of a building permit for this project. Placement of remediation equipment shall be approved by the Planning Division and not be located in any required setback areas. The remediation operation shall not interfere with parking or circulation on this sits. The site shall be resurfaced and res=riped to City Standards. Due to potential noise impacts upon the adjacent residential property, all vacuuming of vehicles shall take place within the existing car wash building as shown on the site plan. D. police Department The new detail bays shall be equipped with sliding according style security gates or other style approved by the Police Department and Planning Division. All existing structures and parking lots must comply with the provisions of Chapter 8, Article Il, Division 3 of the Santa Asa Municipal Code (Building Security Ordinance). These code conditions will require that the existing project's lighting, door/window locking devices and addressing be upgraded to current code standards. Lighting standards cannot be located in required landscape planters. E. ~ubltc Works Aaencv Prior to issuance of a building permit, complete the following: 1. Construct street tree wells and plant minimum 24 inch box trees per City Standard #1124 at locations in accordance with the approved improvement plans for Grand Avenue. Construct a drive approach on Stafford Street per City Standard $1112, Case 2, W=28', A~38', X~4' and approved improvement plan. Close existing drive approach on Stafford Street with new curb and gutter as required per City Standards and approved improvement plan. Construc= new sidewalk per City Standards and approved improvement plan on Stafford Street. Appropriate backflow protection devices will be required on both domestic and fire service connections in conformance with all rules, regulations, and code requirements, whether such devices are shown on the project plans or not. Approved backflow protection shall be installed by your contractor and the cost will vary depending on size and type of device required, and complexity of the installation. Install double sided "Exit Only - Do Not Enter / Right Turn Only" signage at the drive approach's northerly "W" on G~and Avenue per City Standards and approved improvement plan. Install "Exit Only - Do Not Enter" signage southerly "W" on Grand Avenue per City improvement plan. at the drive approach's Standards end approved Should the developer choose to start building construction prior to the required street improvements, the developer must provide the public works agency with a cash deposit of $13,040.00 to quarantee the completion of the required improvements. The cash deposit shall be refunded after the improvements have been satisfactorily completed, and the street work permit has been signed off by the Public Works Agency's Construction Inspector.
