REL: 6/6/95 RESOLUTION NO. 95-025 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 95-2 TO ALLOW A DRIVE- THRU WINDOW FOR A RESTAURANT AT 2300 SOUTH MAIN STREET WHEREAS, this Council held a public hearing on June 5, 1995, on Conditional Use Permit Application No. 95-2, to allow a drive- thru window for a restaurant at 2300 South Main Street; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Council finds and determines as set forth in Exhibit A, attached hereto and incorporated herein. 2. Conditional Use subject to the conditions and incorporated herein. Permit No. 94-22 is hereby approved set forth in Exhibit B, attached hereto ADOPTED this 19th ATTEST: //~nice C. The proposed drive-thru window for a freestanding restaurant use will provide e service to the neighborhood by allowing the expedient purchase of food and an option for patrons to purchase food without exiting their vehicle. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity? The proposed drive-thru window will not he detrimental to the health or safety cf property in the area as numerous mitigating features, such as hedges surrounding the drive-thru lane, will be used to minimize the impact to adjacent properties. Ce Will the proposed use adversely affect the present economic stability or future economic development of properties surrounding the area? The drive-thru window will enhance the economic development in the area by providing an alternative method of purchasing food. Additionally, the site, which is currently vacant, will boost the economic development of the area and provide jobs with the construction of the restaurant. Will the proposed use comply with the regulations and conditions specified in Chapter 41 ~or such use? The proposed facility will comply with the regulations and conditions specified in Chapter 41 for this use. Will the proposed use adversely affect the General Plan or any specific plan of the City? The proposed drive-thru window will not adversely affect the General Plan as the restaurant and drive-thru window are consistent with the goals and objectives of the General Plan designation of General Business District. EXHIBIT A 004" RESOLUTION 95-025 Conditional Use Permit No. 95-2 June 5, 1995 Page I of 3 ~ogditions for ADn~ovel Should Conditional Use Permit No. 95-2 be approved, the project shall comply with all applicable sections of the Santa Aha Municipal Code, the california Administrative Code, the Uniform Flre Code, the Uniform Building code and all other applicable regulations. In addition, it shall meet the following conditions~ Ao D V 0 Submit elevations of the remote order booth prior to submittal of plans into building plan check. Provide flowering vines on the trash enclosure walls in order to reduce graffiti. Prior to obtaining building permitm, submit two copies of the landscaping and access and egress easements to the Planning Division for review. Maintain the landscaped easement along the south property line for a period of one year. Submit two copies of the recorded access and egress easements to the Planning Division prior to certificate of Occupancy. The conditional use permit will be reviewed by the Planning Commission in 12 months to determine compliance with the prescribed conditions. Police Department Provide a secured cover on top of the trash enclosure as approved by the Police Department. 2. No exterior pay phones will be allowed. The Conditional Use Permit shall be reviewed by the Police Department after issuance: at six months and one year, and shall thereafter be reviewed annually for any modification to the conditions of approval. These modificati6ns may include restrictions on the hours of operation of the drive-thru. C. Public Works Aaane¥ Prio~ to submitting plans into Building Plan Check, complete the following: Revise the site plan to depict and dimension a new 10 foot wide sidewalk to be constructed on Main Street, including the area south of the proposed driveway. EXHIBIT B RESOLUTION 95-025 005 Conditional Use Permit No. 95-2 June 5, 1995 Page 2 of 3 Revise the site plan to depict and dimension a 30. foot wide reciprocal easement for ingress and egress and drainage over the northerly 15 feet of the southerly adjacent property and southerly 15 feet of the subject property. 3. Revise the site plan to labs1 all on-mite easements. Revise the site plan to depict on-site, right turn only signs at the Warner Avenue and northerly Main Street driveways. Prior to the issuance of a building permit, complete the following: 1. Dedicate Warner Avenue for a distance of 60 feet from street centerline. Dedicate Main Street for a distance of 70 feet from street centerline. West property line shall taper from 70 feet west of street centerline at south driveway "top of X" to 60 feet west of street centerline, 62 feet southerly. Dedicate a 25 foot by 25 foot corner cut-off at the intersection of Warner Avenue and Main Street. Dedicate easements for street and highway purposes around the disabled access drive approaches to be in compliance with Title 24 requirements. submit for review and approval Assessor Parcel Nos. 410-372-2, easement areas. and then record CC&R's over Orange 3, 4, and 5 for maintenance cf all 6. Record all easements per approved site plan. Prior to issuance of a utility release, complete the following improvements to Warner Avenue: Remove existing curb and gutter and construct new curb and gutter 50 feet south of street centerline per approved street improvement plan. Construct new pavement from good edge of existing pavement to new gutter per approved street improvement plan. 3. Construct new 10 foot wide sidewalk. Construct driveway per City Standard $1112, Case 2, W~30', AmS0', X~4' and with title 24 accessibility. Construct a 35 foot radius curb return with wheelchair ramp at the intersection. Pave the 25 foot by 25 foot corner cut-off at the intersection with 4 £nnh.concrete. RESOLUTION 95-025 Conditional Use Permit No. 95-2 June 5, 1995 Page 3 of 3 7. Relocate utilities per approved plane. 8. Plant minimum 24 inch box trees per City Standard ~1124 at locations in accordance with approved improvement plans. 9. Furnish ornamental street lighting with underground service ae directed by the City Engineer. 10. Install "NO STOPPING ANYTIME" zone. 11. Modify traffic signal at the intersection per approved traffic signal plan. 12. Construct stripping and signage including stripping to restrict left turns in and out of the Warner Avenue driveway, per approved channelization plan. Prior to issuance of a utility release, complete the following improvements on Main Street: 1. Remove existing curb and gutter and construct new curb and gutter 60 feet west of street centerline per approved street improvement plan. 2. Construct new pavement from good edge of existing pavement to new gutter per approved street improvement.plan. 3. Construct new 10 foot wide sidewalk per approved street improvement plane. 4. Construct two driveways per City Standard #1112, Case 2, W~30', X=4' and with title 24 accessibility. 5. Relocate utilities per approved plans. 6. Plant minimum 24 inch box trees per City Standard #1124 at locations in accordance with approved improvement plans. 7. Furnish ornamental street lighting with underground service as directed by the City Engineer. 8. Install "NO STOPPING ANYTIME" zone. 9. Construct striping and signage per approved channelization plan. 10. Construct bus pad per approved street improvement plan.
