HomeMy WebLinkAbout95-042 - Approving a Mitigated Negative Declaration for the Mater Del High School Projects099 RESOLUTION NO. 95- 042 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING A MITIGATED NEGATIVE DECLARATION FOR THE MATER DEI HIGH SCHOOL PROJECT AND ADOPTING A MITIGATION MONITORING PROGRAM WHEREAS, the Diocese of Orange Education and Welfare Department proposes to undertake the expansion and remodelling of the physical improvements of Mater Del High School (the "Project") and has applied for a general plan amendment, a change in zoning designation, and the approval of a development agreement with the City of Santa Ana to facilitate the Project; and WHEREAS, in accordance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the Environmental Rules of the City of Santa Ana, the Environmental Coordinator of the City of Santa Ana has prepared a mitigated negative declaration for the Project; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. The City Council has considered the proposed mitigated negative declaration and any public comments received during'the public review process. 2. The City Council finds and determines, on the basis of the initial study and any comments received, that there is no substantial evidence that the Project as mitigated will have a significant effect on the environment. 3. The mitigated negative declaration is hereby approved. 4. That certain mitigation monitoring program attached hereto as Exhibit A and incorporated herein by this reference is hereby adopted for the Project. 5. The Environmental Coordinator shall maintain in the offices of the Planning and Building Agency the documents and other material which constitute the record of proceedings on which the decision of the City of Santa Ana to approve a mitigated negative declaration for the Project is based. As part of CEQA environmental review procedures, AB 3180 requires a public agency to adopt s monitoring and reporting program for assessing and ensuring efficiency of any required mitigation measures applied to proposed developments. As stated in Section 21081.6 of the Public Resources Code: '...the pubhc agency shall adopt a reporting or monitoring program for the changes to the project which it ~ adopted, or made a condition or project approval, in order to mitigate or avoid significant affects on the environment" Section 21081.6 provides general guidelines for implementing monitoring and repoRing programs. Specific reporting and/or monitoring requirements, to be enforced during project implementation, shall be defined prior to fuml approval of the project proposal by the responsible decision maker(s). In response to established CF. QA requirements and those of Public Resources Code Section 21000 et seq., the proposed mitigation monitoring program shall be submitted for consideration prior to completion of the environmental review process to enable the decim'on maker's appropriate response to proposals. The mitigation monitoring program mus~ be provided as pa~ of the F'mal Mitigated Negative Declaration. The mitigation monitoring program is presented in this section. Each recommended mitigation measure is listed and categorized by impact topic, with an accompanying discussion of: The pa~y/agency responsible for implementation of mitigation measure. The phase of the project during which the measure should be monitored. The method of verifying compliance with mitigation measure. The agency responsible for monitoring compliance with mitigation measure. The monitoring agencies shall oversee elements of the mitigation monitoring program and review compliance through the use of compliance verification forms to be developed by the City and supported by a mitigation monitoring consultant. A sample of a "Compliance Verification" form is provided in Attachment A. Designated monitors shall ensure compliance verification forms are filled out correctly and proper action is being taken on each z--~,~,re. Desi.-nated monitors will also be responsible for filing and updating the verification forms during all phases of the project. During design and construction phases, the designated monitors from the Planning and Building Agency will determine the need for a measure to be modified and ensure the -~ of a mitigation speclali~ if technical expertise beyond the monitor's ability is required. If it is found that an adopted mitigation measure is not being properly implemented, the designated monitors shall require corrective actions to ensure adequate implementation. Tracks carrying excavated materials from the site shall be covered or maintain adequate freeboard and shall have their tires and undercandages washed prior to exiting the site. D. Paving of exposed di~ surfaces shall be done as quickly as possible. E. Streets affected by fugitive dust shall be swept regularly.
