HomeMy WebLinkAbout95-046 - Approving Conditional Use Permit No. 95-10REL: 8/21/95 RESOLUTION NO. 95-046 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA Ai~PROVING CONDITIONAL USE PERMIT NO. 95-10 TO ALLOW A GAS STATION/MINIMARKET AT 1351 EAST DYER ROAD WHEREAS, this Council held a public hearing on August 7, 1995, on Conditional Use Permit Application No. 95-10, to allow a gas station/minimarket at 1351 East Dyer Road; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Council finds and determines as set forth in Exhibit A, attached hereto and incorporated herein. 2. The proposed projec: complies with the regula:ione and co:dj:ions specified in the San:a Aha Municipal Code pertaining to the rehabilitation of an existing gas station use. Will the proposed use adversely affect the General Plan of the Ci:y or any specific plan applicable =o the irma of the proposed use? Curren:ly there is a conflict between ex~sting zoning on this property and the City's General Plan. As :he result of this project this conflict will be eliminated by bringing the zoning designation for this proper:y into conformance wi=h the City's General Plan. Therefore, ~he proposal will no= adversely affect the General Plan EXHIBIT A EXHIBIT B RESOLUTION 95-046 Conditional Use Permit No. 95-10 August 7, 1995 Page I of 2 Conditions for AnDroval Should Conditional Use Permit No. 95-10 be approved, the project must comply with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. In addition, it shall meet the following conditions~ A. Fire Department Ail underground fuel dispensing systems must be approved by Santa Ana Fire Department, Underground Tank Division. B. Planninq Division Sign clips to be removed from light standards and no signage of any kind to be allowwed on light standards. C. Police Department Ail existing structures and parking lots must conform with the provisions of Chapter 8, Article II, Division 3 of the Santa Ana Municipal Code (Building and Security Ordinance). These code conditions will require that the existing project's lighting, door/window locking devices and addressing be upgraded to current code standards. Lighting standards can not be located within required landscape planters. The applicant shall be responsible for maintaining the premises free of graffiti. All graffiti shall be removed within 24 hours of occurrence. The Petitioner(s) shall be responsible for maintaining free of litter the area adjacent, to the premises over which they have control. There shall be no coin-operated games maintained upon the premises at any time. The petitioner(s) shall post a placard prohibiting loitering on the premises. The posted sign must conform to SAMC Section 10-96(c). 6. Ail exterior public telephones must be restricted to outgoing calls only. Close southerly driveway with curb and full width sidewalk. b. Install "NO STOPPING ANYTIME" zone. c. Modify the driveways to be in compliance with Title 24. 2. Improve Dyer Road (subject properties frontage) as follows: a. Install "No Stopping Anytime" zone. b. Modify the driveways to be in compliance with Title 24.
