RESOLUTION NO. 95- 070
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA APPROVING CONDITIONAL
USE PERMIT NO. 95-20 TO ALLOW A GAS
STATION/MINIMARKET/CAR WASH AT 2650
NORTH GRAND AVENUE
WHEREAS, this Council held a public hearing on October 16,
1995, on Conditional Use Permit Application No. 95-20, to allow a
gas station/minimarket/car wash at 2650 North Grand Avenue;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing, this Council finds and determines as set forth in Exhibit
A, attached hereto and incorporated herein.
2. Conditional Use Permit No. 95-20 is hereby approved
subject to the conditions set forth in Exhibit B, attached hereto
and incorporated herein, and subject to the additional condition
that the mini-market shall be closed to the public between the
hours of 12:00 a.m. and 5:00 a.m.

Will the proposed use provide a service or facility to
contribute to the general well being of the neighborhood or
community?
The proposed gas station, car wash and mini-market will
provide a service to the surrounding properties, the
community and commuters in the area. It will contribute to
the well being of th~ of the neighborhood through the
development of a new use on vacant property.
Will the proposed use, under the circumstances of the particular
case, be detrimental to the health, safety, or general welfare
of persons residing or working in the vicinity?
The proposed gas station, car wash and mini-market will not
be detrimental to the health, safety or welfare of the
area. It will provide a service to people which live and
work in the area.
Will the proposed use adversely affect the present economic
development of property in the surrounding area?
The proposed gas station, car wash and mini-market will
assist in the economic viability of the area. Development
of this vacant parcel will improve the property, providing
new revenue sources to the city. It will contribute to the
economic health of the antire area ~y complementing current
businesses and their customers, ~as well as. attracting new
customers to this area.
Will the proposed use comply with the regulations and conditions
specified in this chapter for such use?
The proposed gas station, car wash and mini-market complies
with all regulations and conditions specified in the Santa
Ana Municipal Code.

CONDITIONS OF APPROVAL
Should Conditional Use Permit No. 95-20 be approved, the project must
comply with all applicable sections of the Santa Ana Municipal Code,
the California Administrative Code, the Uniform Fire Code, the Uniform
Building Code and all other applicable regulations. In addition, it
shall meet the following:
A. Planninq Division
No mechanical, electridal or other equipment is to be
placed on the outside of the building. Such equipment is
to be placed within the footprint of the building.
Construction activity is to be limited to between the hours
of 7:00 a.m. and 8:00 p.m. Monday through Saturday· No
construction is permitted on Sunday and federal holidays.
The entire wall around the property'is to be not less than
six feet in height.
The car wash will only be open during daylight hours,
however, no earlier than 7:00 a.m· or later than 9:00 p.m.
B. Police Department
1. Ail pay telephones shall be located inside the premises.
The Conditional Use Permit shall be reviewed at six months,
at one year and then annually thereafter by the Police
Department for any modification to the conditions of
approval. This includes noise and site lighting concerns.
B. Public Works Aqency
A. Prior to site plan approval, complete the following:
Revise the site plan to depict the 48 inch striped
pedestrian access out of the proposed southerly drive
approach on Grand Avenue.
Revise the site plan to depict the removal of the
proposed 2 foot concrete swale and new catch basin,
located at each proposed drive approach.

Prior to issuance of a building permit, complete the
following:
1. Dedicate a 17' x 17' corner cut-off area at the
southwest corner of Grand and Fairhaven Avenues.
Prior to the utilities release, complete the following:
1. Improve Grand Avenue as follows:
Remove and replace existing street pavement for
the existing curb lane matching to good edge of
existing pavement from southerly property line to
centerline of Fairhaven Avenue per approved
improvement plan.
Construct a 12' x 60' bus pad at the existing bus
stop location per approved improvement plan.

Construct the two drive approaches per City
Standard #1112, Case 2, W=38', A=38', X=3' and
approved improvement plan.
Close existing drive approaches with full height
curb and full width sidewalk per City Standards
and approved improvement plan.
Underground the existing power poles per approved
improvement plan.
f. Install "NO STOPPING ANYTIME" zone.
Improve the southwest corner of Grand and Fairhaven
Avenues as follows:
Construct 12" grooving border in the new concrete
paving at the top of the existing wheelchair ramp
at the southwest corner of Grand and Fairhaven
Avenues per City standard #1122A and approved
improvement plan.
Construct concrete paving in the 17' x 17' corner
cut-off per City standards and approved
improvement plan.
3. Improve Fairhaven Street as follows:
close existing drive approach with full height
curb and full width sidewalk per City Standards
and approved improvement plans.
