HomeMy WebLinkAbout95-078 - Approving Conditional Use Permit No. 95-19Z95 RESOLUTION NO. 95- 078 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 95-19 TO ALLOW A RETAIL USE AT 1502 EAST EDINGER AVENUE IN THE Mi (LIGHT INDUSTRIAL) DISTRICT WHEREAS, this Council held a public hearing on November 6, 1995, on Conditional Use Permit Application No. 95-19, to allow a retail use at 1502 East Edinger Avenue in the Mi (Light Industrial) district; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Council finds and determines as set forth in Exhibit A, attached hereto and incorporated herein. 2. Conditional Use Permit No. 95-19 is hereby approved subject to the conditions set forth in Exhibit B, attached hereto and incorporated herein, and subject to the additional condition that the exterior restroom doors shall be kept locked and closed at all times between the hours of 11:00 p.m. and 5:00 a.m. ADOPTED this 4th ATTEST~ COUNCILMEMBERS: Pulido Aye Richardson Aye Espinoza Aye Lutz Aye McGuigan Aye Mills Aye Moreno Aye day of Decen~er , 1995. The proposed convenience store within the existing service station will provide a service to the neighborhood by providing a retail sales component within a predominantly industrial area. This will allow service station customers or workers in the area the ability to purchase grocery items in the immediate area. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity? The proposed retail use will not be detrimental to the health or safety of residence in the area as no residential units are located in the immediate area. The retail use will also not be detrimental to persons working in the area as the store will predominantly sell food items only, with no alcoholic beverage sales from the facility. Will the proposed use adversely affect the present economic stability or future economic development of properties surrounding the area? The proposed use will enhance the economic viability in the area by providing an small retail component within the industrial area. In addition, the conditional use permit will allow the service station owners the ability to modernize the facility, thus becoming more economically competitive with similar surrounding uses. Will the proposed use comply with the regulations and conditions specified in Chapter 41 for such use? The proposed facility, with the exception of the front yard landscaped setbacks, will comply with the regulations and conditions specified in Chapter.41 for this use. However, additional on-site landscaping and landscape upgrades are being provided to bring the site into close compliance with Chapter 41. EXHIBIT A RESOLUTION 95-078 Conditional Use Permit No. November 6, 1995 Page 2 of 2 95-19 Will the proposed use adversely affect the General Plan or any specific plan of the city? The proposed use will not adversely affect the General Plan as the convenience store is a minor component of the service station use. In addition, a service station use is consistent with the goals and objectives of the General Plan designation of Industrial. RESOLUTION 95-078 Conditional Use Permit No. 95-19 November 6, 1995 Page 1 of 2 Conditions for ADDrevaI Should Conditional Use Per, it No. 95-19 be approved, the project shall comply with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. In addition, it shall meet the following conditions: A. Plannlnq Division Ail signage for the site will need to be in conformance with the provisions of the Sign Code. Ail on-site trees need to be upgraded to a minimum of 24 inch box size or larger as shown on the approved landscape plan. Plant flowering vines on the block walls and trash enclosure in order to reduce graffiti. The convenience store will be limited to operating between the hours of 5:00 a.m. and 12:00 a.m. Development is to proceed consistent with Site Plan Review DP No'. 94-65 B. Pollce Department The existing building and parking lot must conform with the provisions of Chapter 8, Article II, Division 3 of the Santa Ana Municipal Cede (Building Security Ordinance). These code conditions will require that the existing project's lighting, door and wihdow locking devices and addressing be upgraded to current code standards. Light standards cannot be located in required landscape planters. EXHIBIT B RESOLUTION 95-078 Conditional Use Permit No. November 6, 1995 Page 2 of 2 95-19 Ce Public Works Agency Prior to building permit issuance, complete the following: Construct a street tree well and plant a minimum 24 inch box tree on Grand Avenue per City Standard No. 1124 at the location in accordance with the approved improvement plan. Remove and replace approximately 110 linear feet of damaged curb and gutter located west of the easterly drive approach on Edinger Avenue per City Standards and the approved improvement plan.
