A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA MAKING CERTAIN FIND-
INGS WITH REGARD TO AMENDMENTS TO THE
1994 EDITION OF THE UNIFORM PLUMBING
CODE AND THE 1993 EDITION OF THE NATION-
AL ELECTRICAL CODE
WHEREAS, the City Council proposes to approve an ordinance
adopting the 1994 edition of the Uniform Plumbing Code published by
the International Conferenoe of Building officials and the 1993
edition of the National Electrical Code published by the National
Fire Protection Association; and
WHEREAS, the City Council considers it necessary, because of
local climactic, geological or topographical conditions, to amend
certain building standards in the Uniform Plumbing Code, 1994
edition, and in the National Electrical Co~e, 1993 edition; and
WHEREAS, pursuant to sections 17958.5, 17959.7 and 18941.5 of
the Health and Safety Code of the State of California, the City
Council is required to make findings that such amendments are
necessary due to local climactic, geological, or topographical
conditions, and to file such findings, together with the amend-
ments, with the Department of Housing and Community Development of
the State of California;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA AS FOLLOWS:
1. Section 8-340 of the Santa Ana Municipal Code will amend
section 314.3 of the Uniform Plumbing Code to read as follows:
314.3 Piping in the ground shall be laid on a firm
bed for its entire length. Building drains, sewers
and storm drain piping systems in the ground, and
designed and approved at less than one percent
grade, shall be laid on a continuous firm bed, cer-
tified by a registered soils engineer as having a
compaction level of not less than ninety (90) per-
cent density. Where support is otherwise provided,
it shall be acceptable to the Administrative Au-
thority.
Also, Section 8-405 of the Santa Ana Municipal Code will amend
section 718.1 of the Uniform Plumbing Code by adding the following
paragraph thereto:
Building sewer piping systems designed for grades of

less than one percent shall be designed by a regis-
tered civil engineer. The engineer shall be respon-
sible for supervising the installation and shall
certify in writing that the sewer installation is in
compliance with the approved plan, relative to line
and grade.
With respect to these two amendments, the City Council finds
and determines as follows: These amendments are necessary because
of problems which have arisen in excessively flat-graded drain
systems. Santa Ana's sewer system in many areas is relatively
shallow. This has precluded the design and installation of
drainage systems with recommended grades. Additionally, many areas
of Santa Ana have a high water table which results in an unstable
soil condition. Pipe settlement due to uncompacted soil may result
in a drainage system which is flat or reverse graded, causing
stoppages or complete blockage of the drainage system.
2. Section 8-341 of the Santa Ana Municipal Code will amend
section 314.7 of the Uniform Plumbing Code to read as follows:
3~4.7 Horizontal cast-iron drain, waste, and vent
piping, and all other suspended horizontal piping
two and one-half (2~) inches and larger, shall be
supported with approved rod and hangers.
Exception: Plumbers tape (perforated strap-iron) may be
used to support piping 2" and smaller in type V (wood)
construction only. Plumbers tape shall be galvanized and
not less than 3/4" wide and 22 gage.
Also, Section 8-342 of the Santa Ana Municipal Code will amend
Table 3-1 of the Uniform Plumbing Code by adding footnote 2 to the
requirements for horizontal piping of the following materials:
Copper Tube and Pipe; Steel and Brass Pipe for Water or DWV; Steel,
Brass and Tinned Copper Pipe for Gas; Schedule 40 PVC and ABS DWV;
CPVC; and Lead.
With respect to these two amendments, the City Council finds
and determines as follows: These amendments are necessary to
provide proper support for all horizontal piping because of the
significant potential for damage due to seismic activity. Santa
Ana is in close proximity to major active fault systems in Southern
California. This area has been designated as seismic zone #4, the
highest seismic risk zone in a four-tiered hierarchy which rates
the potential risk for seismic activity by geographical areas.
3. Section 8-815 of the Santa Ana Municipal Code amends, and
will continue to amend, section 210-1 of the National Electrical
Code by adding a sentence to read as follows:

Ail sections of this National Electrical Code allow-
ing the use of aluminum conductors are subject to
the limitation that no aluminum conductor smaller
than No. 6 AWG shall be used.
The City Council hereby finds and determines that earthquakes
are a common occurrence in the local area; that earthquakes may
cause electrical connections and screws to loosen, causing heat
problems especially in the smaller sizes of aluminum wire; and that
the above amendment is necessary to address the risk of fire due to
such causes.
4. Section 8-942 of the Santa Ana Municipal Code amends, and
will continue to amend, section 336-4 of the National Electrical
Code to read as follows:
336-4. Uses Not Permitted.
(a) Type NM or NMe. Types NM and NMC cables shall
not be used: (1) in any dwelling or structure ex-
ceeding three floors above grade; (2) as service-
entrance cable; (3) in any nonresidential building
or structure; (4) in hoist-ways; or (5) embedded in
poured cement, concrete, or aggregate. For the
purpose of this article, the first floor of a build-
ing shall be that floor that has fifty percent or
more of the exterior wall surface area level with or
above finished grade. One additional level that is
the first level and not designed for human habita-
tion and used only for vehicle parking, storage, or
similar use shall be permitted.
(b) Type NM. Type NM cable shall not be installed:
(1) where exposed to corrosive fumes or vapors; (2)
where embedded in masonry, concrete, adobe, fill, or
plaster; (3) in a shallow chase in masonry, con-
crete, or adobe and covered with plaster, adobe, or
similar finish.
The City Council finds and determines that earthquakes are a
common occurrence in the local area; that, unlike wire installed in
conduit or raceways, non-metallic sheathed cable does not provide
the degree of protection that is needed in the event of an
earthquake; that exposed non-metallic sheathed cable is particular-
ly hazardous; and that this amendment is necessary to assure that
adequate protection is provided in the workplace and in other
places of public gathering.
5. The Clerk of the Council is directed to file a certified
true copy of this resolution with the Department of Housing and
Community Development of the State of california.
