HomeMy WebLinkAbout96-044 - Approving Conditional Use Permit No. 96-08051 REL: 4/16/96 RESOLUTION NO. 96-044 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 96-08 TO ALLOW A DELI/ BAKERY LOCATED AT 1442 SOUTH BRISTOL STREET TO REMAIN OPEN AFTER 12:00 A.M. FOR A PERIOD OF ONE YEAR WHEREAS, this Council held a public hearing on April 15, 1996, on Conditional Use Permit Application No. 96-08, to allow a deli/ bakery located at 1442 South Bristol Street to remain open after 12:00 a.m.; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Council finds and determines as set forth in Exhibit A, attached hereto and incorporated herein. 2. Conditional Use Permit No. 95-30 is hereby approved for a period of one year co~mencing on the date of this resolution, subject to the conditions set forth in Exhibit B, attached hereto and incorporated herein. 3. Planning staff shall review this Conditional Use Permit six months from the date of this resolution to determine whether there has been compliance with all conditions of approval. E1 Gallo Giro serves the community by providing convenience foods and baked goods for the surrounding co~umercial businesses and residential neighborhoods. The proposed after hours service allows patrons unrestricted access to hot Mexican foods and fresh baked goods. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety or general welfare or persons residing or working in the vicinity? The proposed late night operations will not be detrimental to persons residing and working in the area. The use, as conditioned, will not create any new impacts on the surrounding land uses. E1 Gallo Giro offers a service when other commercial operations are closed. Ce Will the proposed use adversely affect the present economic stability or future economic development of properties surrounding the area? Allowing the after hour operations contributes to the economic stability of the area by providing additional opportunities for generating revenue. De Will the proposed use comply with the regulations and conditions specified in Chapter 41 for such use? The proposed after hour operations will be in compliance with all applicable conditions of Santa Ana's Municipal Code Chapter 41, upon approval of Conditional Use Permit 96-08 and compliance with the CUP conditions. Will the proposed use adversely affect the General Plan or any specific plan of the City? The proposed after hour operations will not adversely affect the General Plan. The deli and bakery operation is a use permitted within the General Business District (GBD) designation. It is also incompliance with the Bristol Street Specific Plan. EXHIBIT 054RESOLUTION 96-044 Conditional Use Permit No. April 15, 1996 Page i of 2 96-08 Conditions for ~Dmrov~l Should Conditional Use Permit No. 96-08 be approved, the project shall comply with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. In addition, it shall meet the following conditions: A. Planninq Division 1. Remove. all illegal signage including window and awning slgnage. 2. Remove exterior public phones. 3. Remove tables and return outdoor dining patio to its original use as a sidewalk. 4. Remove illegal exterior decorative lighting. 5. Obtain building permit for awning on south remove. elevation or Upgrade front setback landscaping in northeast corner. Reseed grass and add sidewalk or a stone walkway to prevent future deterioration. e Conditional Use Permit No. 96-08 will expire 18 months upon approval with City Council. B. Police Department The existing parking lot, within 60 feet of the restaurant must conform with the provisions of Chapter 8, Article II, Division 3 of the Santa Aha Municipal Code (Building Security Ordinance). The applicant shall be responsible for maintaining the premises free of graffiti. A1 graffiti shall be removed within 24 hours of occurrence. Cash register must be visible from the street at all times and shall not be obstructed at any time by temporary or permanent signage. Window displays must be kept to a minimum for maximum visibility and shall not exceed 25 percent of window coverage. EXHIBIT B Conditional Use Permit No. 96-08 April 15, 1996 Page 2 of 2 Window displays and racks must be kept to a maximum height of three feet including merchandise and cannot obstruct the cashiers view. 6. There shall be no coin operated games maintained on the premises at any time. 7. Ail pay telephones shall be located inside the premises. 8. The Conditional Use Permit shall be reviewed at six months, at one year and then annually thereafter by the Police Department for any modification to the conditions o~ approval. 9. No loitering signs in both English and Spanish shall be posted in the parking lot. 10. Install a silent armed robbery alarm system.
