RESOLUTION NO. 96- 065
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA APPROVING CONDITIONAL
USE PERMIT NO. 96-010 TO ALLOW AN EATING
ESTABLISHMENT LOCATED AT 320 EAST SEVEN-
TEENTH STREET TO REMAIN OPEN DURING THE
HOURS BETWEEN MIDNIGHT AND 5:00 AM
WHEREAS, this Council held a public hearing on June 3, 1996,
on Conditional Use Permit Application No. 96-010, to allow an
eating establishment located at 320 East Seventeenth Street to
remain open during the hours between midnight and 5:00 am;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing, this Council finds and determines as set forth in Exhibit
A, attached hereto and incorporated herein.
2. Conditional Use Permit No. 95-30 is hereby approved,
subject to the conditions set forth in Exhibit B, attached hereto
and incorporated herein.

The restaurant assists in the economic viability of the
area by providing a service to residents, business owners
and commuters, This use is a revenue source for the City
and contributes to the economic health of the entire area
by complementing current businesses and their customers, as
well as attracting new customers to this area.
Will the proposed use comply with the regulations and conditions
specified in this chapter for such use?
The restaurant complies with all regulations and conditions
specified in the Santa Ana Municipal Code. ~

the City or any specific plan applicable to the area of the
proposed use?
The restaurant zoning, use and other applicable items are
in compliance with the General Plan.

Con~itions for Approval
Should Conditional Use Permit No. 96-010 be approved, the project
shall comply with all applicable sections of the Santa Ana Municipal
Code, the California Administrative Code, the Uniform Fire Code, the
Uniform Building Code and all other applicable regulations. In
addition, it shall meet the following conditions:
A. Plnnning Division
Ail proposed site improvements shall conform with Site Plan
Review No. DP 96-002, unless amended by staff.
2. Conditional Use Permit No. 96-10 will be reviewed in six
months after approval by city Council of the after hour
operations.
B. Polio® DePartment
The existing parking lot, within 60 feet of the restaurant
must conform with the provisions of Chapter 8, Article II,
Division 3 of the Santa Ana Municipal Code (Building
Security Ordinance). Lighting in the parking lot shall be
directed/positioned (shielded) in such a manner so as not
to unreasonably illuminate the window area of nearby
residents.
The applicant shall be responsible for maintaining the
premises free of graffiti. All graffiti shall be removed
within 24 hours of occurrence. ~
Cash register must be visible from the street at all times
and shall not be obstructed at any time by temporary or
permanent signage.
Window displays must be kept to a minimum for maximum
visibility and shall not exceed 25 percent of window
coverage.
Window displays and racks must be kept to a maximum height
of three feet including merchandise and cannot obstruct the
cashiers view.
6. There shall be no coin operated games maintained on the
premises at any time.
7. Ail pay telephones shall be located inside the premises.

The Conditional Use Permit shall be reviewed at six months,
at one year and then annually thereafter by the Police
Department for any modification to the conditions of
approval.
No loitering signs in both English and Spanish shall be
posted in the parking lot.
Install a silent armed robbery alarm system.
