RESOLUTION NO. 96- 086
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA DENYING CONDITIONAL
USE PERMIT APPLICATION NO. 96-025, WHICH
SOUGHT TO ALLOW A RESTAURANT WITH A
DRIVE-THROUGH WINDOW SERVICE AT 2660
NORTH MAIN STREET
WHEREAS, this Council held a public hearing on September 3,
1996, on Conditional Use Permit Application No. 96-025, which
sought to allow a restaurant with a drive-through window service at
2660 North Main Street in the C2 use district;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid hearing
this Council finds and determines as set forth in Exhibit A,
attached hereto and incorporated herein.
2. Conditional Use Permit Application No. 96-025 is hereby
denied.

Findinqs
Will the proposed use provide a service or facility which will
contribute to the general well being of the neighborhood or the
community?
Drive-through window service is not in keeping with the
professional uses in the area and therefore will not contribute
to the general well being.
Will the proposed use, under the circumstances of the particular case,
be detrimental to the health, safety or general welfare of persons
residing or working in the vicinity?
A drive-through restaurant may adversely impact persons residing
or working in the vicinity. Commercial uses require signage in
excess of that required by professional uses. Typical signage
for a drive-through restaurant would detract from the character
of the area which has subdued signage due to the destination
character of the uses. Further, a drive-through use may create
trash issues beyond the limits of the restaurant property.
Will the proposed use adversely affect the present economic stability
or future economic development of property in the surrounding area?
A drive-through restaurant would not be in character with this
segment of Main Street. Land uses in this area are destination
oriented and not dependent upon excessive signage to attract
customers that traditional general commercial users require.
The lack of excessive signage along this segment contributes
significantly to the image and character of this district as a
high quality professional office district.
Will the proposed use comply with the regulations and conditions
specified in this chapter for such a use?
Because the project has not completed the City's required review
process, compliance with code requirement has not been achieved.
Site issues involving circulation, property lines, signage and
architecture remain outstanding and cause the project to be
deemed not in compliance.
Will the proposed use adversely affect the General Plan of the City
or any specific plan applicable to the area of the proposed use?
The area surrounding the project has developed as a high quality
mid-rise office district acting as a gateway to the MainPlace
District Center from downtown. The professional uses within
this segment of Main Street provide a sensitive and compatible
transition to the adjacent residential land use. A drive-
through restaurant would not be in character with the
established office land use pattern.
