RESOLUTION 97-001 003
Variance No. 96-05
~cember 16, 1996
~age 1
Findings
Special circumstances exist on this property, including size, shape,
topography, location or surroundings, where the strict application of
the zoning ordinance is found to deprive the subject property of
privileges not otherwise at variance with the intent and purpose of
the provisions of this chapter.
The variances are a benefit to the developer and center as they
will increase the exposure and advertising for the development,
which is currently difficult due to the size and shape of the
property. This in turn will benefit the community.
The granting of a variance is necessary for the preservation and
enjoyment of one or more substantial property rights.
The requests are necessary to increase the visibility for
businesses in the proposed retail center.
The granting of a variance will not be materially detrimental to the
public welfare or injurious to surrounding property.
Approving the variances would not have a negative impact on the
surrounding property or the public in general. The retail
center will provide a benefit to the community. Mitigation
measures are being required where necessary and appropriate.
The granting of a variance will not adversely affect the general plan
of the city.
The variance will not have a negative effect on the General
Plan.
