RESOLUTION NO. 97-005
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AUTHORIZING THE CHIEF
OF POLICE TO ENTER INTO PAY-TO-STAY
AGREEMENTS WITH JAIL INMATES.
WHEREAS, the new Santa Ana jail will implement several
contract-inmate revenue generating programs to defray the cost of
operating the jail; and
WHEREAS, one such program is a pay-to-stay agreement with
inmates; and
WHEREAS, this agreement would allow an inmate sentenced to do
jail time by any court in California to serve the sentence in the
Santa~Ana jail upon payment by the inmate of a per diem rate; and
WHEREAS, the sentence structure, actual dates, times, and
specific conditions of incarceration are to be dictated by the
court order authorizing the inmate's incarceration and contained in
the "Pay-to-Stay" agreement, a form of which is attached as Exhibit
A; and
WHEREAS, the program will be limited to individuals who reside
or work in Santa Ana.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA that the Chief of Police, or his designee, on behalf
of the City of Santa Ana, is authorized to enter into "Pay-to-Stay"
agreements, in a form substantially similar to the attached Exhibit
A, with inmates who are under court order to serve jail time, and
choose to do so in the Santa Ana Jail.

understand and agree to the following conditions and terms of incarceration at the
Santa Ana Jail, a city jail, and by my own volition, request to be allowed to complete
my jail sentence at the Santa Aha Detention Facility.
General Terms and Conditions:
I waive separation by classes as described by CPC 4002 and understand
that my dayroom activities will be among the general population of the
facility.
2. I agree to follow and abide by the facility's inmate rules and regulations.
Payment is due prior to incarceration at the rate of $ a day. I
am required to submit payment for the number of days I intend to
serve, not the entire sentence, if that number is greater than what I
intend to serve at booking.
Payment must be a money order, cashier check or cash. Money orders
or cashier checks are to be made out to the City of Santa Ana.
