A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA SUMMARILY VA-
CATING AN UNIMPROVED EXCESS RIGHT-
OF-WAY PORTION OF ARNETT DRIVE.
WHEREAS, this Council finds and determines that certain
portion of Arnett Drive lying west of the intersection with Main
Street, more specifically described hereinbelow, is excess right-
of-way not required for street purposes, for the following reasons:
A. Realignment of the I-5 Santa Ana Freeway has resulted in
the remaining portion of Arnett Drive to be unimproved and no
longer required for street or highway purposes;
B. The said portion of Arnett Drive lies within property
under one ownership, to wit, the Community Redevelopment Agency of
the City of Santa Ana, does not continue to through to any other
property and therefore is not necessary to provide access to
abutting property owners; and,
WHEREAS, this Council finds and determines that there are no
in-place public utility facilities in the abovesaid portion of
Arnett Drive that are in use and would be affected by the vacation
of said portion of Arnett Drive;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA AS FOLLOWS:
1. Pursuant to the provisions of Chapter 4 of Part 33 of
Division 9 of the Streets and Highways Code of the State of
California, and, in particular, § 8334 thereof, that portion of
Arnett Drive in the City of Santa Ana lying west of Main Street is,
under the facts hereinabove recited, hereby summarily vacated and,
from the date this resolution is recorded in the office of the
Recorder of Orange County, shall no longer constitute a street or
any portion thereof.
2. The Clerk of the Council is hereby directed to cause a
certified copy hereof, attested by her under seal, to be recorded
in the office of the Recorder of Orange County, at such time as the
Clerk of the Council receives a written request from the Executive
Director of the Public Works Agency, and upon the conditions of
recordation of dedication or reservation of necessary easements for
right of way or public services.
