RESOLUTION NO. 97-020
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA APPROVING VARIANCE NO.
97-03, TO ALLOW RELIEF FROM CERTAIN
PARKING, SETBACK, AND LANDSCAPING RE-
QUIREMENTS FOR THE DISCOVERY SCIENCE
CENTER LOCATED AT 2522 NORTH MAIN STREET
WHEREAS, Santa Ana Municipal Code Section 41-638 provides for
the granting of a variance from the provisions of the Santa Ana
Municipal Code;
WHEREAS, this Council held a public hearing on April 21, 1997
on Variance Application No. 97-03, to allow:
(1) A reduction in the passenger bus parking space require-
ment from 22 spaces to five spaces.
(2) A waiver of the front yard, freeway, and creek area
setback requirements; and
(2) A waiver of the perimeter landscaping requirements.
for the remodeling and expansion of the existing building to become
the home of the Discovery Science Center located at 2522 North Main
Street;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid hearing
this Council finds and determines as follows:
A. Because of the special circumstances applicable to the
subject property, including the property's geometric size,
shape, topography, location and surroundings, resulting from
the freeway widening and Santiago Creek bed, the strict
application of the landscape, setback, and parking require-
ments in the zoning regulations would deprive the subject
property of privileges not otherwise at variance with the
intent and purpose of the provisions of this chapter.
B. That the granting of a variance is necessary for the
preservation and enjoyment of one or more substantial property
rights inasmuch as this project, or virtually any other
development, would not be feasible without granting the
required variances.

C. That the granting of a variance will not be materially
detrimental to the public welfare or injurious to surrounding
property in that the project has provided for additional
landscaping in other areas of the site where the geometric
configuration of the lot allows, and parking has been relocat-
ed to an off-site public facility without any detrimental
impacts to the public.
D. That the granting of a variance will not adversely affect
the General Plan of the City in that the project is a permit-
ted use under the Professional and Administrative Office
General Plan designation for this area and advances the
implementation of the goals in the General Plan.
2. Subject to the conditions set forth below, Variance No.
97-03 is hereby approved.
3. The approval of Variance No. 97-03 is subject to the
following conditions:

Prior to the issuance of any building permits, the
lot line adjustments, all deed restrictions, cove-
nants and dedications related to the project must
