HomeMy WebLinkAbout97-027 - Approving Conditional Use Permit No. 97-11!83 RESOLUTION NO. 97- 027 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 97-11 TO ALLOW DRIVE- THROUGH SERVICE AT A RESTAURANT TO BE LOCATED AT 3361 SOUTH BRISTOL STREET WHEREAS, this Council held a public hearing on June 2, 1997, on Conditional Use Permit Application No. 97-11, to allow drive- through service at a restaurant to be located at 3361 South Bristol Street; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the above said hearing, this Council finds and determines as set forth in Exhibit A, attached hereto and incorporated herein. Will the proposed use provide a service or facility which will contribute to the general well being of the neigh- borhood or community? The construction and operation of In-N-Out Burger at this location will provide an additional opportunity for convenient dining for shoppers and residences within the area. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety or general welfare of persons residing or working in the vicinity? The project will enhance the environment of the immediate area through its remediation of the existing contaminated soil. The establishment of a drive-through restaurant will have no negative impacts on the health of persons residing or working in the area. Will the proposed use adversely affect the present economic stability or future economic development of property in the surrounding area? Developing a vacant site and with a well known, success- ful restaurant will enhance the economic viability of the surrounding commercial environment. 184 RESOLUTION 97-027 Will the proposed use comply with the regulations and conditions specified in the chapter of the Santa Ana Municipal Code for such use? Upon approval of the requested discretionary actions, the project will be in compliance with all regulations and exceed parking as required by code. Ze Will the proposed use adversely affect the General Plan of the City? The proposed project and affiliated discretionary actions are in compliance with the General Business District land use designation of the General Plan. 2. Conditional Use Permit No. 97-11 is hereby approved subject to the conditions set forth as follows: A. Planninq Division The hours of operation are limited to 5:00 a.m. and 1:30 a.m. When site remediation work is completed, the area for this activity must be reverted to a landscaped area of a minimum dimension of eight and one half feet in width by 18 feet in length. The remaining portion may be used for parking, provided that it meets the dimensions of a standard parking stall per City codes. B. Public Works Aqency Improve Bristol Street per approved improvement plan, as follows: a) Close the existing southerly drive approach with a new eight foot full width sidewalk, curb, and gutter. b) Reconstruct the damaged sidewalk adjacent to the southerly existing drive approach in conjunction with a new sidewalk for the drive approach closure. c) Reconstruct the existing wheelchair ramp per City Standard #1122A at the corner of Bristol Street and MacArthur Boulevard. d) Remove the planter-curb ad the monument sign from the 25' x 25' corner cut-off dedicated area. RESOLUTION 97-027 185 e) Install a yellow stripe at the travel aisle to Bristol Street. f) Construct a street tree well and plan a mini- mum 24 inch box street tree (one Queen Palm) per City Standard #1124 at location in accor- dance with approved improvement plan. g) Install landscaping in the dedicated area from the existing sidewalk to the new property line. Improve MacArthur Boulevard per approved improve- ment plan, as follows: a) Reconstruct the existing easterly drive ap- proach to be per City Standard #1112, Case 2 (W=30~ A=40', X=3'). b) Close the existing westerly drive approach with a new 10 foot full width sidewalk, curb, and gutter. c) Construct a street tree well and plant a minimum 24 inch box street tree (one Canary Island Pine) per City Standard #1124 at loca- tion in accordance with approved improvement plan. d) Install landscaping in the dedicated area from the existing sidewalk to the new property line. 3 RESOLUTION 97-027 ADOPTED this 2nd ATTEST: ~ca~eiCe C.
