May RO, 1963
The meeting was called to order at 7:30 p.m. Roll call was answered by
Councilmen Hubbard, Harvey, Gilmore, Schlueter and Mayor Hall. Following
the Pledge of Allegiance to the Flag, the Invocation was delivered by the
Reverend Quinn Beebe of St. Luke's Methodist Church.
MINUTES APPROVAL
On motion of Counc~lmsn Hubbard, seconded
by Councilman Schlueter and carried, the
Council approved the minutes of the Regular
Meeting of May 6, 1963.
BID AWARD On motion of Councilman Hubbard, seconded
RECONSTRUCTION OF by Councilman Harvey and carried, Council
EUCLID AVENUE received and ordered filed a tabulation
of bids received for the reconstruction
of Euclid Avenue; approved award of the contract to Warren Southwest Inc.
in the amount of $28,612.60; and rejected all other bids.

Council received and ordered filed a
tabulation of bids received for the
construction of a parking lot on Fifth Street; approved award of the contract
to Miller-Bonsall Company in the amount of $8,660.15; and rejected all other
bids.
HEARING APPEAL 8h, Mayor Hall opened the hearing on Appeal
VA 176~SY DEV. CO. 84 filed by SY Development and McFadden
Homes, appealing Conditions 13 and l~
imposed by the Planning Comission in
its approval of Variance Application 1760 to construct apartments on C 4
property at Fairview and Sullivan Streets.
Council heard Dale H. Heinly~ 611 West 8th Street, attorney for the
appellant, who protested full improvement of Sullivan Street at the
beginning of the development, and the paving of a 5' sidewalk on Fairview
before any utilities are released. Because of the size of the property,
the developer asked to construct street improvements in stages.
On motion of Councilman Hubbard, seconded by Councilman Harvey and carried,
Council approved.a change in Condition 14 to allow sidewalk construction
on Fairview in tWo~'stages, and in Condition 13 to order street improvements
on Sullivan to be constructed all at one time, with the City constructing
the emit side of Sullivan e~ncurrently.
HEARING APPEAL 83, Mayor Hall opened the hearing on Appeal
VA 1759, Bowms~ 83 filed by Thomas J. Bowman, appealing
the Planning Commission's denial of
Variance Application 1759 to construct
a new wrecking yard office and sales building in the C 2 and R 2 districts
at 3117 W. 5th Street.

Council heard Dale Heinly, 611 W. 8~h~$~r~e~attorney for the appellant, who
explained that the purpose of Variance Application 1759 was to build an eight-
foot wall in order to hide the unsightliness of the Junk yard and to build
a new wrecking yard office and sales building, neither of which would in any
way expand the business.
Warren Finley, attorney representing George Thompson and Willowick Golf Course,
spoke in opposition, submitting that granting of the variance would be an
expansion of the non-conforming use. There being no further testimony, the
hearing was closed.
It was moved by Councilman Harvey, seconded by Councilm~ Hubbard and carried,
that the City Council overrule the action of the Planning Cc~mission, grant
Variance Application 1759 subject to the construction of an eight-foot wall
all around the property and other applicable conditions; and instruct the
City Attorney to prepare a resolution setting forth the Council's decision.
~gHEARING - A.A. 439 M~yor Hall opened the hearing on
Amendment Application 439 for
reclassification from the A i to
the C 4 and R h districts,
property on the north side of Santa Clara between Tustin and the Newport
Freeway. Planning Cc~m~ission Resolution 5614 recommended denial of the
application.
The Clerk reported that a petition had been filed, signed by five adjacent
property owners, favoring the reclassification, and a letter protesting
the reclassification had been filed by the Grovemont Homeowners Association.
It was moved by Councilman Hubbard, seconded by Councilman Schlueter and
carried that the communications be received and ordered filed.
In response to the Mayor's call for testimony, George Buccola, 3700 Newport
Blvd., Newport Beach, spoke in support of the application.
Speaking in opposition, was Jack Turley, 17161 Grovemont Street, representative
of a large group attending the meeting. Mr. Turley stated that additional
shopping centers were not needed, that the additional noise created would
be objectionable, and that property values would decrease. Mr. Turley
then submitted a petition signed by 91 home owners who protested the pre-
zoning. On motion of Councilman Hubbard, seconded by Councilman Schlueter
and carried, the petition was received and filed. There being no further
testimony, the hearing was closed.
On motion of Councilman Harvey, seconded by Councilman Schlueter and carried,
Council approved the reclassification and instructed the City Attorney to
prepare an amending ordi~mnce according to Exhibit AA 439 A.
HEARING - A.A. 440 Mayor Hall opened the hearing on Amend-
~ ment Application ~40 filed by Thomas
R. Coughlin to reclassify from the
A I to the R ~ district, property
located north of Millwood Streetand Sherry Lane.
There being no response to the Mayor's call for testimony, the hearing was
closed.
On motion of Councilman Hubbard, seconded by Councilman GiLmore and carried,
Council approved the reclassification and instructed the City Attorney to
prepare au amending ordinance according to Exhibit h40 A.

Amendment Application 441 filed by
Laurence E. Nelton to reclassify
frcm the R 2 and R 3 to the C 5
district, property on the south side of 17th Street between Fairmont and
Santiago. Planning Commission Resolution 5617 recommended denial of the
application.
C. Arthur Nisson, Jr., 2014 N. Broadway, attorney, stated that the Planning
C~m,~ission was not unanimous in its decision and the classification change
was in conformity with the planning study in the area. Mr. Sanders of
Sanders Realty, 826 East 17th Street, asked that a map of 17th Street study
be sho~n. Although the map was not available, Mr. Evans of the Planning
Department confirmed that properties were recommended for C-5.
On motion of Councilman Gilmore, seconded by Councilman Harvey and carried,
Council approved the reclassification and instructed the City Attorney
to prepare an amending ordinance according to Exhibit 441 A.

by Carl C. Hillgren, to reclassify
from the M i and R i to the R 4
district, property on the west side of Lyon Street south of Warren Street.
Planni~ Commission Resolution 5617 recommended denial of the application
without prejudice.
Richard F. Featherstone, 1021 Ravencrest Road, spoke on behalf of the
applicant, stating that the parcel suffers from dual zoning and since the
City presently has a surplus of M i property, the rezoning would be more
consistent with land uses and future land utilization. Mr. Featherstone
read from a brief and submitted a copy to the Clerk. Orville Milliken,
514 So. Lyons, opposed the reclassification because of additional traffic.
There being no further response to the Mayor's call for testimony, the
hearing was closed.
It was moved by Councilman Harvey, seconded by Councilman Schlueter, that
the reclassification be denied. The motion was defeated on roll call vote:

NEWPORT & DYER Samuel Hurwitz, acting as Special

agreement between the City of Santa Ana and the Irvine Co. and recommaended
the addition of a clause to Paragraph 7 of Page ll "except as otherwise as
specifically provided in this agreement," and a correction from "62" to
"61" on the fifth line free the bott~n of the legal description in Exhibit C.
Mr. Hurwitz also submitted the concurrent agreement between the City of Santa
Ana, the Irvine Company, and the City of Tustin.
On recommendation of Mr. Hurwitz and William French Smith, attorney for The
Irvine Co., it was moved by Councilman Gilmore, seconded by Councilman Schlueter,
that the settlement agreement and the concurrent agreement be approved and

STREET IMPROVEMENTS On motion of Councilman Hubbard, seconded

agreement with Santa Ana Unified School
District relative to construction and cost for street improvements adjacent
to McFadden Jr. High School and LincoLn Elementary School.

SHOEMAKER CLAIM Acting on the recom~endation of the
City Attorney, it was moved by

that the Council deny the claim of Clyde Shoemaker relative to damages
to real property by reason of unlawful seizure for dam site.
17TH STRzm"±' PARKING
MANAGER'S REPORT
The City Manager reported on his meeting
with the businessmen of 17th Street,
regarding the parking limitations along
17th Street, and outlined a three-point
program as follows:
An experiment with short-term parking zones and stalls on streets
entering into 17th Street from the north and south. Only 24 minute
and one hour parking would be permitted, thereby eliminating the
all day parking.
2. An investigation of the possibility of actually widening the south
side of 17th Street between Bush and Spurgeono
A study of the other areas, on the north and south sides of 17th between
Main and Broadway to evaluate the possibility of a construction project
which would place new curbs and gutters in this area, reduce the side-
walk width, and still provide necessary drainage, with the reco~endation
that the expense involved be undertaken by the abutting properties.
On motion of Councilm~u Hubbard, seconded by Councilman Schlueter and carried,
the Manager's report was received and ordered filed; and authorization was
granted to proceed with the preparation of design specifications for the
~south side of 17th Street between Bush and Spurgeon.

meeting to discuss negotiations with consulting firms regarding the General
Plan, City Center Plan, 20-Year Capital Improvement Program, and Five-Year
Capital Budget.
SOLICITATION REQUEST On motion of Councilman Hubbard,

by Leukemia Society for permission
to conduct a fund raising campaign during the latter part of May and the
month of June.

MERIT SALARY INCREASES

ALONA PARK BASEBALL Wanda Holloway, 1936 N. English Street,
protested the continual playing of
baseball in Alona Park, which is
directly behind her property. She
stated that baseballs were constantly bouncing into her yard so that she
was afraid to sit in her patio; and that recently one had broken her
plate glass window.
On motion of Counc~lmsn Hubbard, seconded by Councilman Schlueter and
carried, letters frGn Horace M. Lee and Louis M. Morgan, containing
similar protests were received and ordered filed, and the matter was
referred to the City Manager for investigation and recommendation.
SANITATION DISTRICT It was moved by CounciLman Schlueter,

carried, that Vice-Mayor Royal E. Hubbard
be named as Alternate Director to Orange

their home. Mrs. Joe Trantham, ~17 E. Pine, spoke in defense of her actions.
Mayor Hall suggested a meeting between the participants and the City Attorney
in order to resolve the situation.

Council heard statements from Mr. Gould and Mr. Adam Schleining, President of
Santa Ana Commercial COo, Inc., regarding their position in the matter~
On motion of Councilman Schlueter, seconded by Councilman Harvey and carried,
Council instructed the City Manager to prepare specifications for the trash
and garbage collection contract, to be submitted for discussion at the June
3, 1963 meeting.
Councilman Gilmore returned to the Council Chamber and resumed his seat at
the Council table.

unanimously carried, that the meeting
