OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA, CALIFORNIA
June 17, 1963
The meeting was called to order at 7:30 p.m. Roll call was answered by
Councilmen Harvey, Gilmore, Schlueter and Hubbard. Mayor Hall was absent.
Following the Pledge of Allegiance to the Flag, the Invocation was delivered
by the Reverend Daniel Rider, First Baptist Chmrch.
MINUTES APPROVAL
On motion of Counc~lm-~ Harvey, seconded
by Councilman Schlueter and carried, the
City Council approved the Minutes of the
Regular Meeting of June 3, 1963, as mailed.
LIABILITY INSURANCE Council received the City Manager's report
g~· of proposals received for liability insurance
coverage for the three-year period beginni~
July 1, 1963. It was moved by Councilman
Gilmore, seconded by Counc~lm~n Schlueter and carried, that the report be
received and filed, that the contract be awarded to Allstate Insurance, and all
other proposals be rejected.

received for pressure reducing and flow
control facilities; approved award of contract to the Hood Corporation in the
amount of $192,751.00; and rejected all other bids.

HEARING - APPEALS $6 Vice Mayor Hubbard opened the hearing on an
and 87 V.A. 1773 - appeal filed by John Dykstra objecting to
DYK~TRA & MINTER the height of a sign approved by Plan~ing
C~ission in Variance Application 1773,
at 1320 N. Grand. On motion of Counc~l,~n Gilmore, seconded by Councilman
Sch!ueter and carried, Council received and ordered filed a petition presented
by the :;ppellant which was signed by his neighbors in protest a;:~inst the
height of the sign.

of other signs in the area of similar size.
Robert Stopher, 1251 E. l~th Street, and
Robert J. Grey, 1326 N. Eastwood, spoke
in opposition to the sign. There being
no further testimony the hearing was
closed.
On motion of Councilman Harvey, seconded by Councilman Schlueter and carried,
Council sustained decision of the Planning C~ission and denied Appeal 86.
Vice-Mayor Hubbara opened the hearing on Appeal 87 filed by Louis B. Minter,
requesting waiver of right of way dedication imposed by Planning Co~n~ission as a
condition to approval, of Variance Application 1773- Gene Maxwell, 107 W. 6th' Street,
representing Louis B. Minter, appellant, submitted photographs in support of his
appeal, noting that the dedication would cost the appellant and the City two or
three parking spaces. Tl~e appellant suggested that an agreement be executed which
woui.d require the appellant to pay the cost of moving the sign in the event the
City decides to condemn the five-foot strip. There being no further testimony,
tne hearLing was closed. On motion of Councilman Harvey, seconded by Councilman
C:il~nore aaa carried, Council instructed the City Attorney to prepare a resolution
overruling tr~e Fiauning Commission deleting the conGition requiring five-lOot
right of way deification on Grand Avenue provided the applicant enters into an
agreement co remove 'the encroaching sign at no cost to the City.
~EAt~ING - APPEAL 8) Vice-Mayor Hubbare opened the hearing
~['~l'~ continued irom June 3, 1963. The City
Council received a report that the Plann-
ing Commission in its reconsideration
of Variance application 1752 had approved the variance to convert a single family
residence into ousiness office facilities at 819 Spurgeon. The hearing was then
closed and no further action taken.

the Plannin4 Commission to reclassify

Place. There being no response to the call for testimony, the hearing was closed.
On motion of CounciLman Gilmore, seconded by Councilman Harvey and carried, the
City Council spproved the reclassification and directed the City Attorney to
prepsre an amending ordinance according to Exhibit
HE~EING - AMEND. Vice-Mayor Hubbard opened the hearing on
APP. ~h2 Amendment Application 442 filed by Dr.
Lock Gee Ding to reclassify frc~ the R 1
~ to the P District property located on the
west side of Broadway between Edinger and Pomona. There being no response to the
call ~or testimony, the bearing was closed.
On motion of Councilman Harvey~ seconded by Councilman Gilmore and carried, the
City Council approved the reclassification and instructed the City Attorney to
prepare an amending ordinance according to Exhibit AA

611 W. 8th Street, attorney representing the applicant, agreed to accept CD
zonl~.
On motion of Councilman Harvey, seconded by Councilman Schlueter and carried,
City Council approved the reclassification frc~ R 1 to CD and instructed the
City Attorney to prepare an a~ending ordinance.
HEARING - EAST FIRST Vice-Mayor Hubbard opened the hearing on the
STREET ANNEX ~3 proposed a-nexation of territory designated
EAST FIRST S~e~'i· AI~EX ~3- The Clerk reported
that proper notice of the hearing was published
and mailed as required by law, that evidence thereof was on file, and that no
written protests had been received. There being no response to the call for
testimony, the hearing was closed.

decision regarding the General Plan in
order that the Citizens Advisory C~ttee could evaluate the proposed agreement

Planning Commission to conduct a public meeting with the Citizens Advisory Committee
to acquaint them and the general public as well, with the details of the proposed
co~tract, and invited any comment by the advisory committee members to be made
to Council on July 15, 1963.

Council heard Robert B. Webb, 10~ W. ~th Street, attorney for Santa Ana
C~rcial Co., who cited various parts of the proposed contract which seemed
vaguely defined and requested a postponement for further study of the contract.
Robert S. Barnes, 1017 1~. Broadway, attorney for the Great Western Reclamation
¢o., stated that the contract appeared satisfactory, and requested the Council
to proceed with the call for bids.
Dale Heinly, 611 W. 8th Street, suggested a cove~t limiting stock transfer,
and a warranty by each stockowner that he owns the stock for his own investment
and is not holding it for a~y other person.
Mrs. Janice Boer, 912 N. Lowell, asked how many firms had been consulted for
suggestions before the specifications were prepared. The City Manager replied
that the experience gained frem existing specifications, the specifications of
other cities in California and books by experts in the field had been used as
resources; that information was sought frem two primary companies, with one
responding.
John Ackles, 1217 Rita Way, expressed surprise that collectors of refuse in
surrounding areas had not been notified of the proposed bidding. The City
Manager explained that as soon as the call for bids was approved by the Council,
the contract would be advertised publicly.
Mrs. Robert Baxter, 2~0~ So. T.~-da Way, asked the purpose of having an open
bid, and was told by the Vice-Mayor that the City government operates as a
public agency and is not in a position to refuse a request for open bidding.
Ada~ Schleining, present contract holder, discussed the possibility of the
dumps being closed at night and then withdrew his c~a~any's objections to
the specifications.
On motion of Councl~-~- Harvey, seconded by Council--- Schlueter and carried,
Council approved the specifications suhaitted by the City Manager with
a~endments to be added to said specifications, as follows:

Each owner of 5% or more of stock in a corporation making a proposal
shall file, with such proposal, a verified statement declaring and
warranting that he does not hold any portion of said stock intrust
for any other person except as disclosed in said statement.

Council adopted a Minute Order authorizing the Purchasing Agent to advertise for
the receipt of sealed proposals for refuse collection services, to be opened on
July l, 1963 at 10:O0 A.M.

Vice-Mayor Hubbard explained that since the ten-day period for filing a protest
had lapsed, the Council could take no action. On motion of Councilm-n .Harvey,

Mr. Robinson's letter.
