RESOLUTION NO. 99- o 26
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA ESTABLISHING A
CREDIT CARD PROGRAM AS AN ACCEPTED
FORM OF PAYMENT
THE CITY COUNCIL OF THE
HEREBY RESOLVES, DETERMINES.,
FOLLOWS:
CITY OF SANTA ANA
AND DECLARES AS
WHEREA~S, pursuant to Government Code section 6159 (b), a city'or other public
agency may authorize the acceptance of a credit card for the payment of services rendered
by the city; and
WHEREAS, pursuant to Government Code section 6159 (b), a city or other public
agency may authorize the acceptance of a credit card for the payment of any fee, charge, or
tax due such city or other public agency; and
WHEREAS, a pilot program for the acceptance of credit cards, which proved
successful, was implemented within the Planning and Building Agency. Based upon the
success of such pilot Credit Card Payment Program, city staff is looking forward to
expanding the acceptance of credit cards as an approved and accepted form of payment on a
citywide basis; and
WHEREAS, an administrative fee is required to be paid by the payee in order to
cover the processing of such payment by credit card. The monetary amount of such
administrative fee shall be included in the Miscellaneous Fee Schedule as adopted
periodically by the Council. The Council finds that the administrative fee to be paid by
the payee represents a fair and equitable fee which is reasonably related to the City's cost
in administering the Credit Card Payment Program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SANTA ANA:
1. The Council hereby establishes a Credit Card Program authorizing staff to accept credit
cards as a valid form of payment for services rendered, as well as for the payment of any
fee, charge, or tax due to the City.

2. The Council authorizes the charging of a processing fee related to the use of a credit card as a
form of acceptable payment. :. '
3. If any section, subsection, sentence, clause, phrase or word of this Resolution is for any
mason held to be invalid by a court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this Resolution. The City Council hereby declares that it
would have passed and adopted this Resolution, and each and all provisions hereof, irrespective
of the fact that one or more provisions may be declared invalid.
