RESOLUTION NO. 99- 028
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA DENYING VARIANCES
FROM SEVERAL SECTIONS OF THE SANTA ANA
MUNICIPAL CODE FOR THE RELOCATION OF A
· CHURCH LOCATED AT 2012 SOUTH FLOWER
STREET
WHEREAS, the applicant is seeking several variances from the
Santa Aha Municipal Code Section for the relocation of a church
located at 2012 South Flower Street.
NOW, THEREFORE, BE IT RESOLVED BY TEE CITY COUNCIL OF THE
CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing this Council finds and determines as follows:
That because of special circumstances applicable to the
subject property, including size, shape, topography, location
or surroundings, the strict application of the zoning
ordinance is found to deprive the subject property of
privileges not otherwise at variance with the intent and
purpose of the provisions of this chapter.
The subject structure was built in 1953 and was in
compliance with applicable codes prevailing at that
time. However, the building was constructed to
accommodate retail and office uses and not parking
intensive uses such as a church. As a result, there
are no unique or special circumstances applicable to
this parcel that would deprive the subject property of
privileges enjoyed by other properties constructed for
their specific use.

That the granting of a variance is necessary for the
preservation and enjoyment of one or more substantial
property rights.
The granting of the variances are necessary for the
preservation of property rights as any other permitted
use in the community commercial zoning district would
need to obtain a variance as the site has been vacant
for over a one year time period. As a result, any new
use would be required to comply with the City's zoning
provisions, including parking, landscaping, setbacks
and circulation.

That the granting of a variance will not be materially
detrimental to the public welfare or injurious to surrounding
property.
Approval of the proposed variances may result in
further adverse impacts to the surrounding
.neighborhood, particularly parking. Two existing
churches are located near the subject site, on to the
north and one to the south, that are deficient in
parking and utilize street parking in the adjacent
neighborhoods. Approval of a third church that is
deficient in parking will further intensify the adverse
parking situation currently placed on the residents in
the neighborhood.

That the granting of a variance will not adversely affect the
General Plan of the City.
The granting of the variances for this project will not
adversely affect the City's General Plan in any way.
2. Variance No. 99-01 is hereby denied based on the
findings.
